Article 1 : Société organisatrice
L’Office du Tourisme et des Congrès de Nice, Etablissement Industriel et
Commercial, loi du 11 Juillet 1964, N° Siret 395 235 047, Code NAF 633 Z,
dont le siège social est situé 5, Promenade des Anglais, BP 4079, 06302
NICE Cedex 04, ci-après dénommée « Société Organisatrice », organise du
25 Septembre (10h00) au 8 Octobre 2018 (11h00 heure française) un jeu
concours (quiz) intitulé « Jeu concours Séjour à Nice ».
Toute inscription en dehors de ces dates ne sera pas prise en compte.

Article 2 : Conditions de participation
2.1 La participation à ce jeu concours est ouverte à toute personne physique
et majeure résidant en France métropolitaine (Corse incluse) et à l’étranger, à
l’exception du personnel salarié de la société organisatrice.
2.2 Les personnes n'ayant pas justifié de leurs coordonnées et identités
complètes ou qui les auront fournies de façon inexacte ou mensongère seront
disqualifiées, tout comme les personnes refusant les collectes,
enregistrements et utilisations des informations à caractère nominatif les
concernant et strictement nécessaires pour les besoins de la gestion du jeu
concours.
2.3 La participation est strictement nominative (limitée à une seule personne,
mêmes nom et prénom, même adresse e-mail) sur la durée du jeu concours, il
est donc interdit d’y participer sous plusieurs pseudos ou pour le compte
d’autres personnes. La participation à ce jeu concours implique l’acceptation
sans restriction ni réserve du présent règlement, et la renonciation à tout
recours contre les décisions prises par les organisateurs de l’opération. A tout
moment, le joueur est responsable de l’exactitude des informations
communiquées.
2.4 La responsabilité des organisateurs ne saurait être engagée en cas de non
réception de la participation, notamment en cas de coupures de
communication, de difficultés de connexion, de pannes de réseau Internet
survenant pendant le déroulement de l’opération.
2.5 Les inscriptions contrefaites ou réalisées de manière contrevenante au
présent règlement entraînent la disqualification du participant. L’organisateur
du jeu concours se réserve le droit de procéder à toute vérification pour
l’application du présent article. La volonté de fraude avérée ou la tentative de
tricherie démontrée d’un participant pourra être sanctionnée par l’interdiction
formelle et définitive de participer à ce jeu concours.
2.6 La participation au jeu concours implique pour tout participant l'acceptation
entière et sans réserve du présent règlement. Le non respect dudit règlement
entraîne l'annulation automatique de la participation et de l'attribution
éventuelle de gratifications.
2.7 Décharge Facebook : cette application n’est pas gérée ou parrainée par
Facebook. Les informations que vous communiquez sont fournies à l’Office du
Tourisme et des Congrès de Nice et non à Facebook. Les informations que
vous fournissez ne seront utilisées qu’aux fins de gestion de votre
participation, pour la détermination des gagnants et pour l’attribution et
l’acheminement des lots.
Du fait de l’acceptation du règlement, les participants autorisent l’organisateur
à conserver les informations émises lors de leur inscription. Celle-ci s’engage
à ne divulguer les informations données par les joueurs à de tierces
personnes physiques ou morales.
Article 3 : Modalité de participation
Le Jeu se déroule comme suit : Le joueur peut se connecter sur l'adresse :

Séjour à Nice » ou utiliser le lien vers le microsite de la campagne :

! Le joueur devra remplir un formulaire de participation et répondre à 3
questions à réponses multiples. Seuls les utilisateurs ayant
correctement répondu aux trois questions seront habilités à participer au
tirage au sort.
! Le jeu sera organisé du 25 Septembre à 10h00 au 8 Octobre 2018 à
11h00 (heure française).
! Le tirage au sort, parmi les joueurs ayant correctement répondu aux 3
questions aura lieu, le 8 Octobre 2018 à 11h30.
! Le joueur pourra rejouer autant de fois qu’il le souhaite, tant qu’il n’aura
pas obtenu un score total de 3/3 bonnes réponses au quiz.
! Le joueur peut enfin inviter des amis à joueur et publier son score sur son
profil (non obligatoire)

Article 4 : Dotation
Le Jeu est composé de la dotation suivante :
- Hébergement 2 nuits en chambre double, petits-déjeuners inclus, à
l’hôtel West End**** (valeur : 450 euros) – La dotation est valable un an
à compter de la fin du jeu.
- 2 Billets d’avion avec la compagnie aérienne HOP à partir des principales
villes de la France Métropolitaine Strasbourg –Lille-Nantes – Metz –Bordeaux
– Rennes – Paris (Orly ouest) : 700 euros pour les 2 billets
- 2 French Riviera Pass 48 heures (prix unitaire : 38 euros par
personne)
Prix total de la dotation : 1226 € TTC
Article 5 : Conditions d’attribution
Le gagnant sera informé de sa désignation dans les deux jours suivant la fin
du jeu concours à l’adresse e-mail indiquée dans le formulaire de participation.
Le gagnant disposera d’un délai de 5 jours pour contacter la Société
Organisatrice à l’adresse e-mail qui leur sera communiquée dans la
notification électronique.
Si le gagnant prévenu ne se manifeste pas dans les 5 jours après l’envoi du
courrier électronique, ce dernier sera considéré comme ayant renoncé à son
lot et le lot restera la propriété de la Société Organisatrice.
Le gagnant devra se conformer au règlement. S’il s’avère que le gagnant ne
réponde pas aux critères (non membre de Facebook, n’ayant pas au moins 18
ans) du présent règlement, la Société Organisatrice ne pourrait alors lui
attribuer sa dotation.
D’une manière générale, si l’adresse électronique ne correspond pas à celle
du gagnant au moment de l’envoi d’informations relatives à son gain ou si des
problèmes de réseau, coupure de courant, devaient empêcher
l’acheminement de ces informations, la Société Organisatrice ne pourra en
aucun cas en être tenue pour responsable.
La dotation ne pourra en aucun cas être reprise ou échangée contre toute
autre dotation, ni transmise à des tiers. Cependant, en cas de force majeure
ou si les circonstances l’exigent, la Société Organisatrice se réserve la
possibilité de substituer à tout moment à la dotation proposée une dotation
équivalente.
Article 6 : Fraudes
La Société Organisatrice se réserve le droit s’il y a lieu d’invalider et/ou
d’annuler tout ou partie d’une participation s'il apparaît que des fraudes de
toutes sortes ou des dysfonctionnements sont intervenus sous quelque forme
que ce soit et notamment de manière informatique ou manuelle dans le cadre
de la participation à l’Opération ou de la détermination du gagnant. A cette fin,
La Société Organisatrice se réserve le droit notamment de faire procéder à
des comparaisons des données techniques sur ses serveurs (notamment les
IP) associées aux participations de l’Opération. La Société Organisatrice se
réserve le droit de demander à tout participant de justifier son identité, et
autres éléments justifiant le respect du règlement. La Société Organisatrice se
réserve, dans toutes hypothèses et même en cas de doute, le droit de
disqualifier les fraudeurs et/ou de poursuivre devant les juridictions
compétentes les auteurs de ces fraudes.
La responsabilité de La Société Organisatrice ne saurait être engagée au titre
de ce qui précède et les participants ne pourront donc prétendre à aucun
dédommagement ou indemnité de quelque nature que ce soit.
Article 7 : Modification du règlement
La Société Organisatrice se réserve le droit, si les circonstances l'exigent, de
modifier, écourter, prolonger ou annuler le jeu concours. Sa responsabilité ne
saurait être engagée de ce fait. La Société Organisatrice se réserve le droit de
modifier tout ou partie du présent règlement. Toute modification du règlement
fera l'objet d'une annonce sur la page
https://www.facebook.com/NiceTourisme et sera, le cas échéant, déposée si
un tel dépôt est requis.
Article 8 : Vérification de l’identité des participants
Pour assurer le respect du présent règlement, La Société Organisatrice se
réserve le droit de procéder à toute vérification de l’identité des participants,
leur lieu de résidence et leur appartenance au réseau social Facebook. Toute
indication d’identité ou d’adresse falsifiée, frauduleuse, fausse, mensongère,
incorrecte, inexacte entraine l’élimination de la participation.
Article 9 : Responsabilité
La Société Organisatrice ne sera pas responsable en cas de
dysfonctionnement du réseau internet empêchant l’accès au jeu concours ou
son bon déroulement. Notamment, elle ne saurait être tenue responsable
d’éventuels actes de malveillances externes.
Si La Société Organisatrice met tout en oeuvre pour offrir aux utilisateurs des
informations et /ou des outils disponibles et vérifiés, elle ne saurait cependant
être tenue pour responsable des erreurs matérielles (notamment d’affichage
sur les sites du jeu concours, d’envoi d’e-mails erronés aux participants,
d’acheminement des emails), d’une absence de disponibilité des informations
et/ou la présence de virus sur le site. La participation à ce jeu concours
implique la connaissance et l’acceptation des caractéristiques et des limites de
l’Internet, l’absence de protection de certaines données contre des
détournements éventuels ou piratage et les risques de contamination par des
éventuels virus circulant sur le réseau. Il appartient à chaque participant de
prendre toutes les mesures appropriées de façon à protéger ses propres
données et/ou logiciels stockés sur son équipement informatique et
téléphonique contre toute atteinte. La connexion de toute personne au site et
la participation au jeu concours se fait sous son entière responsabilité.
En outre, La Société Organisatrice n’est pas responsable en cas :
- De problèmes de matériel ou de logiciel
- De destructions des informations fournies par des participants pour
une raison non imputable à La Société Organisatrice
- D’erreurs humaines ou d’origine électrique
- De perturbations qui pourraient affecter le bon déroulement du
jeu concours
- De conséquences d’éventuels retard, pertes, vols ou avaries
des courriers postaux ou électroniques qui ne lui sont pas imputables.
Les réclamations doivent être formulées par les destinataires
directement auprès des entreprises ayant assuré l’acheminement
desdits courriers.
- D’utilisation des données personnelles par Facebook
Dans tous les cas, si le bon déroulement administratif et/ou technique du jeu
concours est perturbé par une cause échappant à la volonté de La Société
Organisatrice, celle-ci se réserve le droit d’interrompre le concours.
Toute fraude ou non-respect du présent règlement pourra donner lieu à
l’exclusion du jeu concours de son auteur, La Société Organisatrice se
réservant, le cas échéant, le droit d’engager à son encontre des poursuites
judiciaires.
Article 10 : Informatique et Libertés
Les informations recueillies dans le cadre du présent jeu concours sont
nécessaires à la prise en compte de votre participation. Ces informations sont
destinées à La Société Organisatrice, responsable du traitement, aux fins de
gestion de votre participation, pour la détermination des gagnants et pour
l’attribution et l’acheminement des lots.
En participant au Jeu concours «Quiz Gagnez votre séjour à Nice», le joueur
pourra également solliciter son inscription à un courrier électronique
d’information de La Société Organisatrice. Les données ainsi recueillies
pourront être utilisées dans le cadre légal (mail opt-in actif).
Conformément à la loi Informatique et Libertés, vous disposez d’un droit
d’accès, de modification, de rectification et de suppression des données vous

Article 11 : Litiges
Toute contestation ou réclamation relative à ce jeu concours devra être
formulée par écrit et adressée à L’Office du Tourisme et des Congrès de Nice
situé au 5, Promenade des Anglais, BP 4079, 06302 NICE Cedex 04
La Société Organisatrice tranchera toute question relative à l’application du
présent règlement, dans le respect de la législation française. Ces décisions
seront sans appel. La loi applicable au présent règlement est la loi française et
la langue applicable est la langue française. Tout différend né à l'occasion de
ce jeu concours fera l'objet d'une tentative de règlement amiable. A défaut
d'accord, le litige sera soumis aux juridictions compétentes dont dépend le
siège social de La Société Organisatrice, sauf dispositions d'ordre public
contraires. Aucune contestation ne sera plus recevable un mois après la
clôture du jeu concours.
Article 12 : Informations générales
Il ne sera répondu à aucune demande (écrite, téléphonique ou orale)
concernant les modalités ou le mécanisme du concours, l'interprétation ou
l'application du présent règlement. Toutefois les joueurs pourront être informés
du nom des gagnants en cas de demande une fois le jeu concours terminé en

Article 1 - Presentation and purpose:
Nice Convention & Visitors Bureau, Industrial and Commercial Establishment,

hereafter designated as “NCVB”, is organizing, from September 25 (10.00
am Paris time) to October 8 (11.00 am, Paris time), a contest (Quiz) entitled
“Win your stay in Nice with our partners Hop! and the West End Hotel”

Article 2 - Participation
2.1 Participation in this contest is open to all natural persons and adults, in
France or living abroad with the exception of the salaried personnel of the
NCVB, of the service providers having collaborated in the organization of the
contest.
2.2 Persons not having provided their complete identity and contact
information or who provided inexact or untruthful information shall be
disqualified, as will persons refusing the collection, recording and use of the
personal information concerning them, which is necessary for the needs of
managing the contest.
2.3 Entry is strictly nominative (limited to one person per registration, same
last name and first name (limited to one person, same first name and last
name, same email address) over the duration of the contest, it is thus
prohibited to participate under several pseudonyms or on behalf of other
persons. Participation in this contest implies acceptance without restriction or
reservation of the present rules, and the renunciation of all recourse against
the decisions taken by the NCVB of the operation.
At any time, the contestant is responsible for the exactness of the information
provided.
2.4 The responsibility of the NCVB may not be engaged in case of non-receipt
of the submission, notably in case of disruption of communication, difficulties
with connection, malfunctioning of the Internet network during the operation.
2.5 Registrations that are counterfeit or done in violation of the present rules
result in disqualification of the participant. For the contest, the NCVB reserves
the right to proceed with any verification for application of the present article.
The obvious desire to commit fraud or a proven attempt to cheat by a
participant, may be punishable by formal and definitive barring from
participation in this contest.
2.6 Participation in the contest results in pure and simple acceptance of the
present rules, in all their provisions, the rules of ethics in effect for the Internet,
as well as the laws and regulations applicable to free contests in France.
Non-respect of the conditions of participation stated in the rules shall result in
invalidation of the participation.
2.7 Facebook disclaimer: this application is not managed or sponsored by
Facebook. The information that you provide is provided to the Nice Convention
and Visitors Bureau not to Facebook. The information that you provide will only
be used for the purposes of managing your participation, determination of the
winners and assignment and delivery of the lots.
Because the participants have accepted the rules, they authorize the NCVB to
retain the information provided at the time of their registration. It agrees that it
will not disclose the information provided the participants to third parties, either
natural persons or companies.

Article 5 – Terms and conditions of attribution
General Information
The winner will be informed of his designation directly on the result page of the
contest at the email address indicated in the participation form.
The winner will have 5 days to contact the NCVB (expiration date) at the email
address indicated in the participation form.
If the winner does not contact the NCVB 5 days after receiving the email, it will
be considered as if he has abandoned its prize.
Article 6 – Fraud
NCVB reserves the right, if appropriate, to invalidate and/or cancel all or a
portion of an entry if it appears that fraud of any kind or malfunctions occurred
in any form at all, and notably of a computer-related or manual nature within
the framework of participation in the Operation or determination of the
Winner(s). For this purpose, NCVB reserves the right, notably, to have
comparisons performed of the technical data on its servers (notably the IP’s)
associated with the entries of the Operation. NCVB reserves the right to
request that any participant provide proof of his identity, and other information
demonstrating proof of respect of the rules. NCVB reserves, in all
circumstances and even in case of doubt, the right to disqualify cheaters
and/or prosecute the authors of these attempts before the competent
jurisdictions.
The responsibility of NCVB may not be engaged with regard to the foregoing
and the participants will therefore not be able to claim any compensation or
indemnity of any kind at all.
Article 7 - Modification of the rules
The NCVB reserves the right, if the circumstances require it, to modify,
shorten, prolong or cancel the Instant win contest. Its responsibility may not be
engaged as a result.
The NCVB reserves the right to modify all or a portion of the present rules. Any
modification of the rules will be announced on the page of
www.facebook.com/NiceTourisme and will be, if applicable, filed if such a filing
is required.
Article 8 - Verification of the identity of the participants
To ensure respect of the present rules, the NCVB reserves the right to carry
out any verification of the identity of the participants, their place of residence
and their enrolment in the Facebook social network. Any indication of identity
of address that is falsified, fraudulent, false, dishonest, incorrect or inexact
shall result in elimination of the entry.
Article 9 - Responsibility
The NCVB shall not be responsible in case of malfunction of the Internet
network preventing access to the photo contest or its proper execution.
Notably, the NCVB may not be held responsible for eventual external acts of
malice.
While the NCVB makes every effort to offer users information and/or tools that
are available and verified, it cannot, meanwhile, be held responsible for
equipment errors (notably displays on the sites of the contest, the sending of
erroneous emails to the participants, or the transport of emails), an absence of
availability of the information and/or the presence of a virus on the site.
Participation in this contest implies knowledge and acceptance of the
characteristics and limitations of the Internet, the absence of protection of
certain data against misuse and piracy and the risks of contamination by
eventual viruses circulating in the network. It is the responsibility of each user
to take all appropriate measures to protect his information and/or software
stored in his computer and telephone equipment from harm. The connection of
any person to the site and participation in the photo contest is done under his
entire responsibility.
In addition, the NCVB is not responsible in case:
- Of equipment or software problems
- Of the destruction of information provided by participants for a reason
that is not attributable to the NCVB
- Human errors of electrical origin
- Disturbances that could affect the proper execution of photo contest
- Eventual consequences of lateness, losses, thefts or damage from
postal or electronic letters which are not attributable to it. Complaints
must be formulated by the recipients directly to the companies having
transported said letters.
- Of use of personal information by Facebook
In all cases, if the proper administrative and/or technical execution of the
contest is perturbed by a cause which is beyond the control of the NCVB, it
reserves the right to interrupt the contest.
Any fraud or non-respect of the present rules will be able to result in exclusion
of the perpetrator from the contest, with the NCVB reserving, if applicable, the
right to take legal action against him.
Article 10 - Information systems and Freedoms
The information gathered within the framework of the present photo contest is
necessary for taking your participation into account. This information is
intended for Nice Convention and Visitors Bureau, responsible for the
processing, for the handling of your participation, for determination of the
winners and for the attribution and transport of the lots.
By participating in the contest, the player will also be able to request his
registration for an electronic letter of information from the OTCN. The
information thusly gathered will be able to be used within a legal framework
(mail opt-in active).
In conformity with the Law on Information and Freedoms, you have the
right to access, modify, rectify and remove the information which
concerns you. If you wish to exercise this right, you may write to the

Article 11 - Disputes
Any contestation or complaint relative to this contest will have to be sent in
writing to Nice Convention and Visitors Bureau at 5, Promenade des Anglais,
BP 4079, 06302 NICE Cedex 04.
The NCVB will decide on any matter relative to application of the present rules,
in respect of French legislation. These decisions will not be appealed. The law
applicable to the present rules is French law and French is the applicable
language. Any difference arising on the occasion of this contest shall be
subjected to an attempt at amicable resolution. In the absence of agreement,
the dispute shall be submitted to the competent jurisdictions in the location of
the headquarters of the NCVB, unless there are provisions of law and order to
the contrary. No contestation will be admissible one month after the close of
the contest.
Article 12 - General Information
1. No response will be provided to a request (written, by telephone or orally)
concerning the manner or mechanism of the contest, the interpretation or
application of the present rules. However, upon request, the contestants will
be able to be informed of the name of the winner once the contest has ended
