Préambule
L’association ARRIVÉE FASTNET CHERBOURG, dont le siège social est situé́
à la 8 rue des Vindits
- 50130 Cherbourg-en-Cotentin, SIRET numéro 887 669 802 00019, organise un jeu en ligne
avec l’assistance de AGENCE OPALE COMMUNICATION (ci- après le “Jeu” ou “Jeu Concours”
pour la période du 1er mai 2021 au 9 mai 2021 00 H 00. Les jeux organisés sur la page
Facebook et le compte Instagram Rolex Fastnet Race Cherbourg sont gratuits et sans
obligation d’achat.
En prenant part au jeu via la page Facebook ou le compte Instagram de Rolex Fastnet Race
Cherbourg, les participants pourront accéder au tirage au sort permettant de gagner les lots
suivants : une balade en mer à bord du bateau L’Adèle pour 2 personnes, un Pass Annuel à la
Cité de la Mer accompagné d’un lot de produits de la boutique d’une valeur de 100€, un
chèque cadeau FCC (Fédération des Commerçants du Cotentin) d'une valeur de 50€.
ll est précisé que le Jeu Concours est développé et géré par ARRIVÉE FASTNET CHERBOURG à
l’exclusion de tout parrainage ou intervention des sociétés Facebook ou Instagram, n’assurant
que l’hébergement du Jeu Concours au sein de leurs Plateformes.
Le présent document est le règlement du Jeu Concours, ci-après dénommé le « Règlement ».
Il peut être complété et/ou modifié à tout moment pendant la durée du Jeu, par toute clause
complémentaire qui entrera en vigueur du seul fait de sa publication en ligne par ARRIVÉE
FASTNET CHERBOURG.
Toute personne est réputée avoir lu, compris et accepté, sans réserve, le Règlement dans son
intégralité, et notamment l’article relatif aux données personnelles dès lors qu’elle accède et
s’inscrit au Jeu.
L’ensemble des documents susmentionnés sont mis à disposition et accessibles à tout
utilisateur et participant pendant la durée du Jeu. ll est demandé à ces derniers d’effectuer
une copie de sauvegarde et/ou imprimer l’ensemble des textes susmentionnés afin de pouvoir
s’y référer, si nécessaire.
Article 1 : Conditions d’accès
1.1
La participation au Jeu concours est ouverte à toute personne répondant aux conditions
cumulatives ci-dessous :
(i) personne physique et majeure,
(ii) disposant d’un accès lnternet et d’une adresse e-mail personnelle valide,
(iii) disposant d’un compte Facebook ou d’un compte Instagram et accédant au Jeu Concours
via la Plateforme de jeu Facebook ou Instagram Rolex Fastnet Race Cherbourg pendant la
durée indiquée au sein de des publications de jeu concernées.
ARRIVÉE FASTNET CHERBOURG procèdera, dans la limite des moyens à sa disposition, à la
vérification du respect de ces critères. Dans l’hypothèse où l’un de ces critères ne serait pas
rempli, l’inscription au Jeu Concours ne pourra être validée.
1.2
La participation au Jeu Concours est limitée à une inscription au tirage au sort telle que
détaillée à l’article 2 ci-dessous.
Article 2 : Participation
2.1
Le Jeu Concours est ouvert à toute personne répondant à l’ensemble des conditions
mentionnées à l’article 1.1 ci-dessus.
Pour s’inscrire au tirage au sort et tenter de gagner le lot mis en jeu à l’article 3.1, tout
participant doit avoir réalisé les actions mentionnées ci-dessous:

– Se rendre sur une des publications dédiées
– Suivre les instructions de participation détaillées au sein des publications dédiées soit :
• Suivez la page Facebook / le compte Instagram.
• Aimez la publication.
• Commentez en mentionnant 2 ami(e)s avec lesquels vous aimeriez partager ces lots.
• Doublez vos chances en partageant cette publication.
– Lire, comprendre et accepter sans réserve le Règlement du Jeu disponible sur la page
Facebook ou le compte Instagram susmentionnés.
L’inscription au tirage au sort n’est effective qu’au terme de ces étapes.
ll est entendu que chaque participant s’engage à révéler des informations correctes le
concernant. ARRIVÉE FASTNET CHERBOURG se dégage de toute responsabilité dans le cas où
un participant utiliserait de faux noms et/ou prénoms associés à une adresse e-mail valide,
voire usurperait l’identité d’un tiers.
2.2.
La participation au Jeu Concours s’effectue exclusivement par voie électronique sur la
Plateforme de jeu Facebook ou Instagram de ARRIVÉE FASTNET CHERBOURG de manière
exclusive, le tirage au sort étant réalisé parmi les participants inscrits à ce dernier.
Toute participation au Jeu Concours sur papier libre ou sous toute autre forme est exclue.
2.3
La participation au Jeu concours ne sera valable que si les informations requises par ARRIVÉE
FASTNET CHERBOURG sont complètes et correctes.
Toutes inscriptions réalisées par l’utilisation d’informations incorrectes, falsifiées ou via des
formulaires contrefaits ou falsifiés seront de plein droit déchues de tout droit d’obtenir un
quelconque prix gagnant.
2.4
Tout participant s’engage à respecter le Règlement. Tout non-respect du Règlement par le
Participant, et notamment toute fraude, abus, tricherie de son fait, pourra entraîner son
exclusion du Jeu par décision de ARRIVÉE FASTNET CHERBOURG.
En outre, en présence d’abus ou tricherie d’un ou plusieurs participants, ARRIVÉE FASTNET
CHERBOURG se réserve le droit de modifier ou mettre fin au Jeu concours sans préavis,
notamment lorsque l’intégrité du Jeu concours est remise en cause dans son objet.
Article 3 : Détermination des gagnants – remise des lots
3.1. Lots
Les gagnants seront déterminés par tirage au sort entre les participants via Facebook et
Instagram. Chaque gagnant remporte l’un des lots indiqués ci-dessous :
Lot 1 : Une balade en mer à bord du bateau L’Adèle pour 2 personnes.
Lot 2 : Un Pass Annuel à la Cité de la Mer accompagné d’un lot de produits de la boutique
d’une valeur de 100€.
Lot 3 : Un chèque cadeau FCC (Fédération des Commerçants du Cotentin) d'une valeur de 50€.
Le participant ne pourra prétendre à aucune indemnité ni contrepartie, quelle qu’elle soit, en
cas d’annulation ou de perte autre que toute contrepartie proposée par l’organisateur. Le lot
offert ne pourra donner lieu à aucune contestation d’aucune sorte, ni à la remise de la contre-
valeur en argent, ni à l’échange ou remplacement pour quelque cause que ce soit par ARRIVÉE
FASTNET CHERBOURG. lI ne poura en aucun cas être revendu. Si les circonstances
l’exigent, ARRIVÉE FASTNET CHERBOURG se réserve le droit de remplacer le lot par d’autres
dotations de valeur équivalente.
Les déplacements aller et retour entre le domicile du gagnant et le lieu où se déroule le lot
restent à la charge de ce dernier.
3.2. Détermination des Gagnants
Les gagnants seront déterminés par un tirage au sort en ligne qui sera effectué le lundi 10 mai
2021 à 12h00 dans la base des données des personnes inscrites au tirage au sort.
3.3. Information des gagnants / remise des prix
ARRIVÉE FASTNET CHERBOURG informera les gagnants sur les réseaux sociaux Facebook ou
Instagram, le jour du tirage au sort. A cette occasion le gagnant se verra avisé des modalités
de mise en possession de leur dotation.
Article 4 : Modification / arrêt du Jeu concours
4.1
ARRIVÉE FASTNET CHERBOURG se réserve le droit d’écourter, de proroger, de modifier ou
d’annuler le Jeu concours dans l’éventualité d’un cas de force majeure qui rendrait impossible
la poursuite du Jeu concours conformément aux dispositions du Règlement et notamment en
cas de dysfonctionnement du réseau lnternet (dû à un virus ou non), de la Plateforme
Facebook ou Instagram ou de tout autre problème lié aux réseaux, moyens, et services de
(télé)communication, aux ordinateurs (en ligne ou non), aux serveurs, aux fournisseurs
d’accès et/ou d’hébergement à lnternet, aux équipements informatiques ou aux logiciels, aux
données ou bases de données.
4.2
Dans I’hypothèse où une telle annulation, modification, prorogation ou réduction de la durée
du jeu Concours devait intervenir, ARRIVÉE FASTNET CHERBOURG s’engage à le notifier aux
participants par publication au sein de la Plateforme via les applications dédiées et, le cas
échéant, à leur communiquer les nouvelles règles applicables ou la nouvelle date de clôture
du Jeu Concours.
En présence de modification du présent Règlement au regard des mentions précédentes, la
poursuite du jeu Concours par les participants inscrits vaudra acceptation des modifications
réalisées, chaque participant ayant la possibilité de se désinscrire du Jeu Concours en
contactant ARRIVÉE FASTNET CHERBOURG.
4.3.
En cas de modification des conditions du Jeu Concours, d’annulation, d’interruption ou de
réduction de la durée du Jeu Concours, la responsabilité de ARRIVÉE FASTNET CHERBOURG ne
pourra être engagée et les participants ne pourront prétendre à aucun dédommagement, ce
qu’ils acceptent.
4.4.
Chacun des Participants accepte enfin que ARRIVÉE FASTNET CHERBOURG puisse mettre fin
au Jeu Concours, ou lui apporter des modifications à tout moment dans l’hypothèse où elle
constaterait un nombre important d’abus et tricheries que cela soit lors de l’inscription au Jeu
Concours ou son déroulement même.
L’annulation ou la modification du Jeu Concours sera communiquée aux participants par
publication sur la Plateforme ou par tout moyen que ARRIVÉE FASTNET CHERBOURG jugerait
opportun.
Article 5 : Exonération et limitation de responsabilité
ARRIVÉE FASTNET CHERBOURG ne saurait être responsable des dommages, directs ou
indirects, quelles qu’en soit les causes, origines, natures ou conséquences, quand bien même
elle aurait été avisée de la possibilité de tels dommages, provoqués à raison :
(i) d’un dysfonctionnement du réseau Internet ou de l’équipement informatique, y inclus la
Plateforme et l’application (matériels et/ou logiciels et/ou bases de données et/ou données)
d’un Participant ou de toute personne ou société liée à l’organisation du Jeu Concours ou, plus
généralement, de tout autre problème lié aux réseaux, moyens et services de
(télé)communications, aux ordinateurs (en ligne ou non), aux serveurs, aux fournisseurs
d’accès et/ou d’hébergement à lnternet, aux équipements informatiques ou aux logiciels,
bases de données et données de quiconque;
(ii) de la véracité des informations données par le Participant, et qu’elle ne pouvait
valablement considérer comme ne respectant pas les dispositions du présent règlement et
des Condition d’Utilisations au regard des informations et moyens en sa possession;
(iii) de tout défaut de fabrication, panne ou autre dysfonctionnement, à la conformité du lot
aux normes auxquelles il est éventuellement soumis ou à la sécurité d’utilisation du lot offert
(dans les conditions normales d’utilisation) qui ne seraient pas ses propres produits.
ARRIVÉE FASTNET CHERBOURG décline toute responsabilité pour les dommages occasionnés
par des événements indépendants de sa volonté, issus de l’utilisation du lot.
Article 6 : Frais de participation
Le Jeu Concours est gratuit et sans obligation d’achat.
Le Règlement est mis gratuitement à la disposition des participants sur la Plateforme dédiée
au Jeu.
Pour les participants accédant au Jeu Concours via un modem et au moyen d’une ligne
téléphonique facturée selon le temps passé – c’est-à-dire hors abonnements câble, ADSL ou
liaison spécialisée et forfait incluant ou offrant les coûts de communication – les coûts de
connexion au site engagés pour la participation au Jeu Concours ne seront pas remboursés
aux participants.
Article 7 : Différend
En cas de contestation ou de réclamation concernant le Jeu Concours pour quelque raison que
ce soit, les demandes devront être adressées par écrit à I’attention de ARRIVÉE FASTNET
CHERBOURG par courrier à l’adresse mentionnée à l’article 10, pendant la durée du Jeu
Concours et maximum dans un délai de soixante (60)jours après la désignation du gagnant.
En cas de contestation ou de réclamation concernant le prix attribué, les demandes devront
être adressées par écrit à I’attention de ARRIVÉE FASTNET CHERBOURG à l’adresse
mentionnée en préambule dans un délai de sept (7)jours après la réception de la confirmation
du prix.
Chaque participant s’engage en cas de difficulté qui pourrait survenir au sujet de l’application
ou de l’interprétation du Règlement, à faire un recours amiable auprès de ARRIVÉE FASTNET
CHERBOURG préalablement à toute action en justice contre cette dernière.
Article 8 : Données à caractère personnel
Les données collectées sont strictement nécessaires à la bonne réalisation du leu. Toute
utilisation poursuivant d’autres finalités que celles exprimées au sein du présent Règlement
devront faire l’objet d’une autorisation expresse du participant. Par sa participation au Jeu, le
participant accepte le Règlement et la collecte desdites données.
ARRIVÉE FASTNET CHERBOURG pourra publier et reproduire sur la Plateforme l’image et le
nom du gagnant, que des photographies de son image soient diffusées, pour autant que ce
dernier y consente sur demande de ARRIVÉE FASTNET CHERBOURG à l’occasion du lot à des
fins publicitaires, promotionnelles ou purement informatives, sans contrepartie financière.
En conséquence les données collectées sont transmises uniquement à ARRIVÉE FASTNET
CHERBOURG ainsi qu’à AGENCE OPALE COMMUNICATION en sa qualité de sous-traitant de
l’organisation du Jeu Concours établie à Cherbourg-en-Cotentin.
Tout Participant dispose par ailleurs des droits d’accès, de rectification, de verrouillage et
d’effacement des données le concernant en contactant directement ARRIVÉE FASTNET
CHERBOURG par courrier à l’adresse mentionnée au sein du préambule.
ll est précisé à ce titre que toute demande de suppression de ces données par quelque moyen
que ce soit pendant la durée du Jeu Concours pourra entraîner l’annulation de l’inscription au
Jeu Concours.
Article 9 : Convention de preuve électronique
ARRIVÉE FASTNET CHERBOURG peut se prévaloir, notamment aux fins de preuve de tout acte,
fait ou omission, des programmes, données, fichiers, enregistrements, opérations et autres
éléments de nature ou sous format ou support informatique ou électronique, établis, reçus
ou conservés directement ou indirectement par elle ou les participants, sauf abus ou erreur
manifeste. Les participants s’engagent à ne pas contester la recevabilité, la validité ou la force
probante des éléments sous format ou support informatique ou électronique précités. Ainsi,
les éléments considérés constituent des preuves et, s’ils sont produits comme moyens de
preuve par ARRIVÉE FASTNET CHERBOURG dans toute procédure contentieuse ou autre, ils
seront recevables et opposables entre les parties de la même manière, dans les mêmes
conditions et avec la même force probante que tout document qui serait établi, reçu ou
conservé par écrit.
Article 10 : Facebook et Instagram
Facebook et Instagram se dégagent de toute responsabilité en cas de contentieux. Cesréseaux
sociaux n’ont aucune implication dans l’organisation et la promotion de ce jeu-concours.
Article 11 : Dépôt du règlement
Le présent règlement est disponible gratuitement au sein des applications dédiées.

The ARRIVÉE FASTNET CHERBOURG association, whose head office is located at 8 rue des
Vindits - 50130 Cherbourg-en-Cotentin, SIRET number 887 669 802 00019, is organizing an
online game with the assistance of AGENCE OPALE COMMUNICATION (here- after the “Game”
or “Competition Game” for the period from May 1, 2021 to May 9, 2021 00 H 00. The games
organized on the Facebook page and the Instagram account Rolex Fastnet Race Cherbourg are
free and without obligation to purchase.
By taking part in the game via the Rolex Fastnet Race Cherbourg Facebook page or Instagram
account, participants will be able to access the draw allowing them to win the following prizes:
a sea trip aboard the boat L'Adèle for 2 people, a Annual Pass to the Cité de la Mer
accompanied by a set of products from the shop worth € 100, an FCC (Federation of Cotentin
Merchants) gift voucher worth € 50.
It is specified that the Contest Game is developed and managed by ARRIVÉE FASTNET
CHERBOURG to the exclusion of any sponsorship or intervention by Facebook or Instagram
companies, providing only the hosting of the Contest Game within their Platforms.
This document is the rules of the Contest Game, hereinafter referred to as the "Rules". It can
be supplemented and / or modified at any time during the duration of the Game, by any
additional clause which will come into force solely because of its online publication by ARRIVÉE
FASTNET CHERBOURG.
Anyone is deemed to have read, understood and accepted, without reservation, the
Regulations in their entirety, and in particular the article relating to personal data when they
access and register for the Game.
All of the aforementioned documents are made available and accessible to any user and
participant during the duration of the Game. They are requested to make a backup copy and
/ or print all of the aforementioned texts in order to be able to s 'refer to it, if necessary.
Article 1: Access conditions
1.1
Participation in the Contest is open to anyone meeting the cumulative conditions below:
(i) natural person and adult,
(ii) having internet access and a valid personal e-mail address,
(iii) having a Facebook or Instagram account and accessing the Contest Game via the Facebook
or Instagram Rolex Fastnet Race Cherbourg Game Platform for the period indicated in the
relevant game publications.
ARRIVAL FASTNET CHERBOURG will, within the limits of the means at its disposal, verify
compliance with these criteria. In the event that one of these criteria is not met, registration
for the Contest Game cannot be validated.
1.2
Participation in the Contest is limited to one entry for the draw as detailed in article 2 below.
Article 2: Participation
2.1
The Contest Game is open to anyone who meets all of the conditions mentioned in Article 1.1
above.
To enter the draw and attempt to win the prize called for in article 3.1, any participant must
have carried out the actions mentioned below:

- Go to one of the dedicated publications
- Follow the detailed participation instructions in the dedicated publications:
• Follow the Facebook page / Instagram account.
• Love the post.
• Comment by mentioning 2 friends with whom you would like to share these prizes.
• Double your chances by sharing this post.
- Read, understand and accept without reservation the Rules of the Game available on the
aforementioned Facebook page or Instagram account.
Registration for the raffle is only effective at the end of these steps.
It is understood that each participant undertakes to reveal correct information concerning
him. ARRIVAL FASTNET CHERBOURG declines all responsibility in the event that a participant
uses false names and / or first names associated with a valid e-mail address, or even
impersonates a third party.
2.2.
Participation in the Contest Game is carried out exclusively electronically on ARRIVÉE FASTNET
CHERBOURG's Facebook or Instagram game platform exclusively, the drawing of lots being
carried out among the participants registered for the latter.
Any participation in the Contest Game on plain paper or in any other form is excluded.
2.3
Participation in the Contest will only be valid if the information required by ARRIVÉE FASTNET
CHERBOURG is complete and correct.
All entries made through the use of incorrect, falsified information or via counterfeit or
falsified forms will automatically forfeit any right to obtain any winning prize.
2.4
All participants agree to abide by the Rules. Any non-compliance with the Rules by the
Participant, and in particular any fraud, abuse or cheating on his own account, may result in
his exclusion from the Game by decision of ARRIVÉE FASTNET CHERBOURG.
In addition, in the presence of abuse or cheating of one or more participants, ARRIVÉE
FASTNET CHERBOURG reserves the right to modify or terminate the Contest without notice,
in particular when the integrity of the Contest is called into question in its purpose. .
Article 3: Determination of the winners - delivery of prizes
3.1. Lots
The winners will be determined by a draw between the participants via Facebook and
Instagram. Each winner wins one of the prizes listed below:
Lot 1: A sea trip aboard the L’Adèle boat for 2 people.
Lot 2: An Annual Pass to the Cité de la Mer accompanied by a lot of products from the shop
valued at € 100.
Lot 3: An FCC (Fédération des Commerçants du Cotentin) gift voucher worth € 50.
The participant will not be able to claim any compensation or consideration whatsoever in the
event of cancellation or loss other than any compensation offered by the organizer. The prize
offered may not give rise to any dispute of any kind, nor to the delivery of the cash equivalent,
nor to the exchange or replacement for any reason whatsoever by ARRIVÉE FASTNET
CHERBOURG. It cannot be resold under any circumstances. If the circumstances so require,
ARRIVÉE FASTNET CHERBOURG reserves the right to replace the prize with other prizes of
equivalent value.
The outward and return journeys between the winner's home and the place where the prize
takes place remain the responsibility of the latter.
3.2. Determination of Winners
The winners will be determined by an online draw that will be held on Monday May 10, 2021
at 12:00 p.m. in the database of people entered in the draw.
3.3. Information of the winners / award ceremony
ARRIVAL FASTNET CHERBOURG will inform the winners on the social networks Facebook or
Instagram, on the day of the draw. On this occasion, the winner will be notified of the terms
and conditions of possession of their prize.
Article 4: Modification / termination of the Competition
4.1
ARRIVAL FASTNET CHERBOURG reserves the right to shorten, extend, modify or cancel the
Contest in the event of a case of force majeure which would make it impossible to continue
the Contest in accordance with the provisions of the Rules and in particular in case of
malfunction of the Internet network (due to a virus or not), the Facebook or Instagram
Platform or any other problem related to networks, means, and (tele) communication
services, to computers (online or not), to servers, providers of access and / or hosting to the
Internet, computer equipment or software, data or databases.
4.2
In the event that such a cancellation, modification, extension or reduction of the duration of
the Competition game should take place, ARRIVAL FASTNET CHERBOURG undertakes to notify
the participants by publication within the Platform via the dedicated applications and, if
applicable , to communicate to them the new applicable rules or the new closing date of the
Contest Game.
In the event of modification of these Rules with regard to the preceding mentions, the
continuation of the Contest game by the registered participants will be worth acceptance of
the modifications made, each participant having the possibility to unsubscribe from the
Contest Game by contacting ARRIVÉE FASTNET CHERBOURG.
4.3.
In the event of modification of the conditions of the Contest Game, cancellation, interruption
or reduction of the duration of the Contest Game, ARRIVÉE FASTNET CHERBOURG cannot be
held liable and participants cannot claim any compensation, which they accept.
4.4.
Finally, each of the Participants accepts that ARRIVAL FASTNET CHERBOURG may end the
Contest, or make changes to it at any time in the event that it notices a significant number of
abuses and cheating whatsoever when registering for the Contest. or its very course.
The cancellation or modification of the Contest Game will be communicated to participants
by publication on the Platform or by any means that ARRIVÉE FASTNET CHERBOURG deems
appropriate.
Article 5: Exemption and limitation of liability
ARRIVAL FASTNET CHERBOURG can not be held responsible for damage, direct or indirect,
whatever the causes, origins, nature or consequences, even if it has been informed of the
possibility of such damage, caused for good reason:
(i) a malfunction of the Internet network or IT equipment, including the Platform and the
application (hardware and / or software and / or databases and / or data) of a Participant or
any person or company related to the organization of the Contest Game or, more generally,
any other problem related to networks, means and services of (tele) communications,
computers (online or not), servers, access providers and / or hosting for anyone's internet,
computer equipment or software, databases and data;
(ii) the veracity of the information given by the Participant, and which it could not validly
consider as not complying with the provisions of these regulations and the Conditions of Use
with regard to the information and resources in its possession;
(iii) any manufacturing defect, breakdown or other malfunction, the conformity of the lot with
the standards to which it is possibly subject or the safety of use of the offered lot (under
normal conditions of use) which would not be its own products.
ARRIVAL FASTNET CHERBOURG declines all responsibility for damage caused by events
beyond its control, resulting from the use of the prize.
Article 6: Participation fees
The Contest Game is free and with no purchase obligation.
The Rules are made available to participants free of charge on the Platform dedicated to the
Game.
For participants accessing the Contest via a modem and by means of a telephone line billed
according to the time spent - i.e. excluding cable, ADSL or leased line subscriptions and
package including or offering communication costs - the Site connection costs incurred for
participation in the Contest Game will not be reimbursed to participants.
Article 7: Dispute
In the event of a dispute or claim concerning the Contest for any reason whatsoever, the
requests must be sent in writing to the attention of ARRIVÉE FASTNET CHERBOURG by mail to
the address mentioned in article 10, for the duration of the Game Contest and maximum
within sixty (60) days of the winner being designated.
In the event of a dispute or complaint concerning the awarded prize, requests must be sent in
writing to the attention of ARRIVÉE FASTNET CHERBOURG at the address mentioned in the
preamble within seven (7) days after receipt of the confirmation of the price.
Each participant agrees, in the event of any difficulty that may arise regarding the application
or interpretation of the Rules, to make an amicable appeal to ARRIVÉE FASTNET CHERBOURG
prior to any legal action against the latter.
Article 8: Personal data
The data collected is strictly necessary for the proper realization of the leu. Any use for
purposes other than those expressed in these Rules must be expressly authorized by the
participant. By participating in the Game, the participant accepts the Rules and the collection
of said data.
ARRIVAL FASTNET CHERBOURG may publish and reproduce on the Platform the image and
name of the winner, that photographs of his image are displayed, provided that the latter
consents to it upon request by ARRIVÉE FASTNET CHERBOURG on the occasion of the prize for
the purposes of advertising, promotional or purely informative, without financial
compensation.
Consequently, the data collected is transmitted only to ARRIVÉE FASTNET CHERBOURG as well
as to AGENCE OPALE COMMUNICATION in its capacity as a subcontractor of the organization
of the Competition Game established in Cherbourg-en-Cotentin.
Any Participant also has the rights to access, rectify, block and delete data concerning him by
contacting ARRIVÉE FASTNET CHERBOURG directly by mail at the address mentioned in the
preamble.
It is therefore specified that any request to delete this data by any means whatsoever during
the duration of the Contest Game may result in the cancellation of the registration for the
Contest Game.
Article 9: Electronic proof agreement
ARRIVAL FASTNET CHERBOURG may rely, in particular for the purposes of proof of any act,
fact or omission, of programs, data, files, recordings, operations and other elements of a
nature or in computer or electronic format or medium, established, received or stored directly
or indirectly by it or the participants, except abuse or manifest error. Participants undertake
not to dispute the admissibility, validity or probative value of the elements in the
aforementioned format or computer or electronic medium. Thus, the elements considered
constitute evidence and, if they are produced as evidence by ARRIVÉE FASTNET CHERBOURG
in any contentious or other proceedings, they will be admissible and enforceable between the
parties in the same manner, under the same conditions and with the same probative force as
any document drawn up, received or kept in writing.
Article 10: Facebook and Instagram
Facebook and Instagram are not responsible for any litigation. These social networks have no
involvement in the organization and promotion of this competition.

These regulations are available free of charge in the dedicated applications.
