Rules of the contest
conducted under the name “Dream Vacation with Vasco Translator”
§ 1
GENERAL PROVISIONS
These Rules (hereinafter referred to as the “Rules”) define the conditions under which the Contest entitled “Dream Vacation with Vasco Translator” (hereinafter referred to as the “Contest”) is held. The Contest is not a game of chance or betting within the meaning of the Gambling Act of November 19, 2009 (Journal of Laws of 2018, item 165 as amended).
The organizer of the Contest is Vasco Electronics Góralski Group S.K.A. (limited joint-stock partnership) with its registered office in Kraków (31-401), Aleja 29 Listopada 20, Poland, entered in the register of entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, 11th Economic Department of the National Court Register under the KRS number: 0000421705, NIP: PL6772369151, REGON: 122581850 (hereinafter referred to as the “Organizer”).
The Contest is carried out on the following social network sites:

(hereinafter collectively referred to as the: “Rules of the Contest”).
The Contest is held in the countries: Poland, Hungary, Bulgaria, Romania, France, Slovakia, Czech Republic.
The Contest is open to any natural person of full legal age, having full legal capacity, residing in one of the countries listed in paragraph 4 of this section (“Participant”).
The duration of the Contest covers the period from 1.06.2023 00.00 hours to 30.06.2023 23.59 hour.
Facebook is not responsible for the organization and conduct of this Contest.
Employees and representatives of the Organizer and members of their immediate families may not participate in the Contest. Members of the immediate family are defined as ascendants, descendants, siblings, spouses, parents of spouses, cousins and persons in an adoption relationship, and children.
Participation in the Contest is voluntary. The Participant should read the Rules before entering the Contest. The Participant, by entering the Contest, undertakes to abide by the rules contained in the Rules, as well as confirms that they meet all the conditions that entitle them to participate in the Contest
All Winners of the Contest will be publicly announced on the Organizer's Facebook pages.
§ 2
CONDITIONS OF PARTICIPATION IN THE CONTEST
The Organizer additionally stipulates that once a week during the Contest, it will select one answer that will be turned into an image by Artificial Intelligence, to which Participants agree.
In order to participate in the Contest, the Participant should answer the contest question in a comment under the Facebook post during the Contest. The Contest question is: In what holiday situations is an electronic speech translator useful? (hereinafter referred to as “Contest Task”). The Participant provides its comment only in the form of a text comment under the Contest Task.
The Organizer provides for 7 (in words: seven) Winners who can only win one of the 1st or 2nd Degree Prizes. The Prizes in the Contest are: 1 (in words: one) 1st Degree Prize being a one-week trip for two people to Santorini in 2023, which will be purchased in a tourist office selected by the Organizer together with 1 (in words: one) Vasco Translator V4 device, and 6 (in words: six) 2nd Degree Prizes in the form of Vasco Translator V4 devices, i.e., respectively 1 (in words: one) Vasco Translator V4 device per one country mentioned in §1(4).
The Participant, by providing their comment referred to in paragraph 1 of this section, simultaneously accepts these Rules.
Participants can participate in the Contest only in person, using their own personal account on Facebook. In particular, the Participant should have a verified Facebook account (hereinafter: “Profile”), containing real data about the Profile user (in particular, name, surname and date of birth). It is unacceptable to create accounts and make contest submissions in the name of third parties or through their accounts. In cases of detecting activities that are inconsistent with the Rules, attempts to influence the selection of the Winner in an unauthorized manner, in particular by setting up fictitious private profiles on Facebook or using additional software to manipulate the result of the Contest, the Participant may be excluded from the Contest.
Participants may ask any questions they may have about the Contest and its conduct by sending an e-mail to a.stachnik@vasco-electronics.com.
The Organizer is authorized to exclude a Participant from the Contest, in particular in the following cases:
violation of any third party rights, including in particular personal rights and copyrights, rules of social coexistence, good morals, provisions of these Rules and Facebook Rules, as well as the inclusion in the Contest Task of advertising content concerning entities other than the Organizer;
when the results were obtained through fraud against the Organizer or other Contest Participants;
when the answers contain vulgarisms, offensive, political, propaganda, religious content or content that is against the law and violates any rights of third parties, including in particular personal rights and copyrights.
§ 3
COMPETITION COMMITTEE
In order to ensure the proper organization and conduct of the Contest, and in particular to evaluate the correctness of the Contest submissions and to select the Contest Winners, the Organizer will appoint a contest committee (hereinafter: “Committee”).
The Committee will be composed of 5 (in words: five) persons designated by the Organizer.
Meetings of the Committee awarding the Prizes will be held from 01.07.2023–09.07.2023.
In evaluating the Contest Tasks, the Committee will use the following criteria:
the originality of performing the task,
ingenuity and creativity.
The Committee's tasks include:
evaluation of the correctness of the completed submissions of the Contest Task;
settlement of the Contest Task in accordance with the provisions of these Rules;
signing the list of persons – Contest Winners who received the right to the prize;
conducting complaint proceedings.
Verification of the right to the prize will be conducted as follows:
Within 5 (in words: five) working days after the end of the Committee meeting, the Organizer will send a private message to the Contest Winners.
The Organizer is not responsible for the impossibility or hindrance of collecting the Prize for reasons attributable to the Winner.
The Participant forfeits the right to the Prize when:
it fails to comply by the due date with any of the conditions to which it is obligated under the Rules; or
it has violated the provisions of the Rules;
it refuses to provide its data necessary for the issuance of the Prize.
The Winner is not entitled to any cash equivalent or any other form of compensation for the Prize. The Winner forfeits the right to receive the Prize in case of violation of any provision of the Rules and in case of disclosure of the fact of violation of the Rules after the presentation of the Prize. The Winner is obliged to return the Prize and any rights and obligations associated therewith. The Winner may not transfer the right to the Prize to other persons. The Winner may waive the right to the prize.
The Committee shall draw up a report with the results of the Contest. The Participant of the Contest may review the report at its request at the Organizer's office.
Prizes will be sent to the addresses indicated by the Contest Winners, only to the countries referred to in §1(4) of these Rules. The Organizer has the right to document the transfer of the Prize by retaining the proof of payment for the trip purchased at the travel agency.
§ 4
PRIZES
All correct Contest submissions shall compete for Prizes.
Prize winners shall be selected from among all submitted Contest submissions that meet the Rules.
The Prizes in the Contest are:
1 (in words: one) 1st Degree Prize being a one-week trip for two to Santorini in 2023 in a tourist office selected by the Organizer, together with 1 (in words: one) Vasco Translator V4 device worth PLN 1,849.00 (one thousand eight hundred and forty-nine zlotys) gross. The value of the 1st Degree Prize is a total of PLN 14,849.00 (in words: fourteen thousand eight hundred and forty-nine). In connection with winning the 1st Degree Prize:
The exact date of the trip shall be determined by the Organizer in consultation with the Contest Winner who won the 1st Degree Prize, taking into account the current guidelines of relevant international organizations and recommendations of individual countries regarding travel safety.
The Contest Winner is obliged to send the following data: name and surname, mailing address, e-mail address, as well as the address of the tax office competent for the Winner, date of birth, telephone number, nationality, passport data (number, date of issue, expiration date) and data of the accompanying person, as well as other data necessary to receive the 1st Degree Prize, which will be required by the Organizer.
6 (in words: six) 2nd Degree Prizes in the form of Vasco Translator V4 devices. In connection with winning the 2nd Degree Prize:
The value of a single 2nd Degree Prize is PLN 1,849.00 (one thousand eight hundred and forty-nine zlotys) gross, and the total value of all of them is PLN 11,094 (eleven thousand ninety-four zlotys) gross.
The Winner is required to send the following information: first and last name, mailing address, email address, as well as the address of the tax office competent for the Winner, date of birth, telephone number, citizenship, passport data (number, date of issue, expiration date), as well as other data necessary to receive the 1st Degree Prize, which will be required by the Organizer.
The entity responsible for the issuance of prizes and the payment of due taxes, in accordance with applicable laws, is the Organizer. The payable tax will be paid by the Organizer to the relevant tax office.
One Participant can win in the Contest once, and can only win a single prize during the entire duration of the Contest.
Contest Winners are not entitled to exchange the prize for cash or for a prize of any other kind. The Winner does not have the right to stipulate specific features of the prizes, such as color, size, shape or type of prize. All content contained in the advertising and promotional materials for this Contest is for illustrative purposes only.
The Contest Winner may not relinquish part of the Prize; relinquishing part of the Prize means relinquishing the entire Prize.
The Prize will be sent to the specified address, by courier and/or e-mail. The Prize will be issued after the Organizer verifies the Winner's age of majority.
The Contest Organizer will send an e-mail to the Winners. Winners within 5 (in words: five) working days after receiving the above e-mail undertake to confirm receipt of the e-mail and provide the information referred to in this section
The Organizer is not responsible for the inability to notify the Winner of the prize in case of incorrect information provided by the Winner or for other reasons, such as permanent technical problems related to the chosen form of communication
Failure to provide information referred to in paragraph 9 of this section or in the situation referred to in paragraph 10 of this section will result in exclusion from the group of Winners and selection by the Committee of a new Winner in place of the Winner from whom the Organizer has not received information. In the case of the 1st Degree Prize Winner, the prize will be transferred to the Winner who will be selected by the Committee by a majority vote from among the originally selected 2nd Degree Prize Winners. As a consequence of a change in the number of 2nd Degree Prize Winners, the Committee shall select an additional person to receive the 2nd Degree Prize in place of the person who received the 1st Degree Prize. The Winner will be selected in accordance with the principle of awarding prizes referred to in §2(3) of the Rules. In the above situations, §1(10) shall apply accordingly.
The 1st Degree Prize Winner is required to create a photo or video of the trip referred to in paragraph 3(a) of this section. The Winner will be required to transfer the copyright to the aforementioned video or photo. Details regarding the taking of a photo or video along with the transfer of copyrights will be specified in a separate agreement between the parties.
§ 5
PERSONAL DATA PROTECTION
The controller of the personal data is Vasco Electronics Góralski Group Spółka Komandytowo-Akcyjna with its registered seat at Al. 29 Listopada 20, 31-401 Kraków, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for Kraków Śródmieście in Kraków, 11th Economic Department of the National Court Register under the number KRS 0000421705, with the share capital in the amount of PLN 50, 000.00, paid in the amount of PLN 50,000.00, NIP 6772369151, REGON 122581850 (hereinafter referred to as the “Controller”).
Personal Data shall be collected by the Organizer for purposes related to the organization of the Contest, including but not limited to the determination of the Winners, their data and the issuance of prizes (legal basis: 6(1)(a) and (b) GDPR), as well as for the purpose of fulfilling tax obligations in terms of deducting and paying the applicable tax on the prize in the Contest (legal basis: Article 6(1)(c) GDPR) and for purposes related to the realization of the Organizer's legally justified interests, such as the handling of potential Participants' complaints and evidence purposes for the purpose of defending claims related to the Contest (legal basis: Article 6(1)(f) GDPR). With a view to ensuring proper organization in the day-to-day affairs of the Controller's activities, the recipients of your personal data may be:
providers of legal and consulting services supporting the Organizer in the pursuit of due claims (in particular, law firms);
service providers supplying the Controller with technical and organizational solutions;
supporting business processes (in particular, IT service providers, courier and postal companies, hosting companies);
provider of the 1st Degree Prize, i.e., the travel agency that will organize the trip that constitutes the prize in the Contest.
Your personal data will not be transferred by the Controller outside the European Union.
In the case of the Facebook platform, data transfer outside the European Economic Area shall take place in accordance with Facebook's Privacy Policy and Rules (https://www.facebook.com/privacy/explanation).
Your personal data will be processed for as long as the purpose of the processing is valid, i.e., the duration of the Contest, and, with regard to Contest Winners, also the period required by relevant tax regulations. In the case of claims, your personal data will be processed until the statute of limitations for such claims under the Civil Code. After these deadlines, your data will be deleted or anonymized.
You, as a Contest Participant, have the right to access the content of your data, to correct it, to request its deletion or restriction of its processing, to transfer it to another controller, and to object to its processing.
Please also be informed that you have the right to lodge a complaint with the authority overseeing compliance with data protection regulations, i.e., the President of the Office for Personal Data Protection.
Your provision of personal data is voluntary yet necessary to participate in the Contest
In the case of a Contest Task containing an image, your personal data and the personal data of the persons captured in the Contest Task may be used and processed for marketing purposes during and after the Contest, in particular made public on social media platforms. By submitting the Contest Task, the Contest Participant confirms that they have provided the third parties whose image is captured in the Contest Task with information about the processing of their data and that they have consented to the use of their image in the Contest Task.
Further processing of the Contest Winners' personal data for marketing purposes may require them to sign additional relevant documents.
The Controller, in its relations with Participants, shall act in accordance with accepted standards of data protection, with particular regard to the rights and interests of Participants
Your data will not be processed by automated means, including profiling.
At any time, you may withdraw your previously submitted consent by submitting an appropriate statement in a documentary form that allows the Organizer to review its contents. Withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal. However, withdrawal of the consent referred to in this paragraph shall at the same time mean withdrawal from the Contest and, in the case of Winners, waiver of the right to the prize.
§ 6
COPYRIGHTS
Participants may only submit content of their own authorship to the Contest. The organizer is authorized to verify the content at any time, taking into account the criterion of authorship. If violations of this provision are found, the Organizer is entitled to exclude the violating Participant, at any stage of the Contest.
The right to exclude a Participant also includes the right to revoke Awards. In this case, the Participant has the right to file a complaint in accordance with the Rules.
The Participant shall be solely responsible for the infringement of copyright or personal rights of third parties in connection with the Contest Task. The Participant undertakes to reimburse the Organizer for all costs incurred by the Organizer in connection with the violation of the rights or interests of third parties as a result of the exploitation of the defective content, in connection with the violation referred to in the preceding sentence.
The Participant may be excluded from the Contest at any time if the Committee determines that its Contest Task does not meet the requirements of the Rules or if third parties make claims to the Organizer related to the Contest Task.
The Participant agrees that the Organizer may make any changes, alterations or other modifications to the Contest Task, according to the needs of the Organizer.
The Contest Task submitted by the Participants may be placed on the Internet or in the promotional campaigns of the Organizer or in the media with entities cooperating with the Organizer without mentioning the name of the author, to which the Contest Participants agree.
Sharing a comment in connection with the Contest Task is tantamount to granting the Organizer a non-exclusive and royalty-free license, with the right to sublicense, to use the answers to the Contest Task without time and territorial restrictions, for purposes related to the organization of the Contest and for marketing and promotional purposes through:
recording, using all known techniques on all known media, which includes, in particular, fixation using analog, digital and optical techniques,
multiplication by all known digital, analog and optical techniques,
publication on large-format media (outdoor and indoor),
multiple public display,
exploitation on the Internet, on websites, via telephone or satellite links, wired or wireless, digital or analog techniques,
making it available to the public in such a way that anyone can access it at a time and place of their choosing,
use in marketing activities, including for advertising and marketing activities of the Organizer's products,
use in creating derivative works, and then use of such created works in the manner indicated in points a) to g),
In case the Contest Task contains an image, the Participant, by publishing the Contest Task, declares that they agree to repeatedly use the image contained in this Contest Task in all fields of exploitation specified in the paragraph above. This consent is not limited in time and territory.
If the Contest Task contains the image of third parties, the Participant declares that it has permission to use the image of these people.
§ 7
RULES OF COMPLAINT PROCEDURE
All complaints regarding the way the Contest was conducted may be submitted by the Participants in writing to the Organizer's address and by e-mail during the Contest and no later than 4 (in words: four) days after the publication of the list of Contest Winners. Complaints submitted to the address of the Organizer's registered office, as well as to the Organizer's e-mail address are subject to consideration. The deadline for filing a complaint is determined by the date of receipt at the Organizer's address or the date of receipt of e-mail correspondence to the Organizer's e-mail inbox. Complaints submitted after this deadline will not be considered. Complaints are handled by the Committee.
The complaint must include: name, surname, exact address of the Contest Participant, the reason for the complaint with its justification and the Participant's e-mail address.
The complaint will be considered within 7 (in words: seven) working days counted from the day of its receipt. The Participant will be notified by e-mail about the processing of the complaint.
Complaints will be reviewed on the basis of these Rules.
On the subject of complaints, the decision of the Organizer is final and binding.
§ 8
FINAL PROVISIONS
The Rules of the Contest are available at the headquarters of the Organizer at the following address Kraków (31-401), Aleja 29 Listopada 20 and on the social networks listed in §1(3).
The Organizer reserves the right to change the Rules, as long as it does not result in the deterioration of the conditions of the Participant and the rules of participation in the Contest. In the event of changes to the Rules, information about the change and the new Rules will be posted on the social networks listed in §1(3) in such a way that every Participant can access it.
In matters not regulated by these Rules, the provisions of universally applicable law shall apply, including primarily the provisions of the Polish Civil Code.
The date of receipt at the Organizer's address or the date of receipt of e-mail correspondence to the Organizer's e-mail inbox will be decisive for meeting the deadline for sending messages, information, correspondence or other submission provided for in the Rules unless otherwise stipulated in the text of these Rules
All disputes shall be settled by a common court of competent jurisdiction for the Organizer.
The Rules come into effect on June 1, 2023.
