TERMS AND CONDITIONS
“TELL ME ABOUT MYSELF”
1. Organize
With the purpose of promoting the city of Madrid as a tourist destination, MADRID DESTINO CULTURA TURISMO Y NEGOCIO (hereinafter, MADRID DESTINO, VAT Registration number A-84073105, having its registered office address at Calle Conde Duque, 9-11, 2ª planta, 28015 Madrid) has organized a competition entitled “TELL ME ABOUT MYSELF”, which is open to individuals fulfilling the requirements set forth in these Terms and Conditions.
2. Purpose. Prizes
This document contains the Terms and Conditions governing the competition entitled “TELL ME ABOUT MYSELF.” A winner will be selected at random, who will receive the following prize:
1 Grand Prize consisting in a trip to Madrid for two people, including 2 nights at a ** star hotel. The winner will be selected from all eligible entries.
The Grand Prize also includes, for both the winner and the person accompanying the winner: (i) direct flight from/to the closest city or town to the home address of the winner to/from the city of Madrid at the times determined by Madrid Destino, as notified to the winner in the communication containing the flight booking details for the requested dates within the eligibility period; and (ii) accommodation at a **star hotel in the city of Madrid, including breakfast.
Any extras not expressly considered in these Terms and Conditions as an integral part of the prize will be borne by the winner and/or the persons accompanying the winner.
The Grand Prize trip will take place between 1st July and 31st October 2018.
Acceptance of the Grand Prize will be subject to the acceptance of the prize and the verification of the identity of the winner, who must send a scanned copy of his/her ID card or passport (or other official proof of identity) within no more than 15 calendar days in his/her reply to the email informing him/her that he/she has won the prize; and the confirmation of the flight for the requested dates.
3. Eligibility
The competition entitled "TELL ME ABOUT MYSELF" is open to individuals of 18 years of age or older, who are legally competent and live in GGermany, Spain, France, Italy, Portugal or United Kingdom.
The winner will be selected from all eligible entrants having submitted an entry form; having answered all three survey questions about the city of Madrid, its people and its soul; and having shared their responses on Facebook.
Employees or senior staff of Madrid Destino, or of contractors or subcontractors charged with managing the promotion, and immediate family members, spouses or partners of any of the above are not eligible to participate.
Entrants who fail to fulfil all or part of these requirements will be automatically removed from the competition, including if they have won a prize. Should it be determined that a winner was ineligible to participate, the winner will return the value of the prize that was unduly received and pay any damages caused.
Fraudulent entries will not be considered valid.
4. How to enter
Only entries submitted through the following site during the entry period will be accepted: https://promo.esmadrid.com.
To participate, entrants must:
Provide the following information on the entry form: a) valid email address; b) country; c) traveller type; d) sex; and e) age range;
Answer all three survey questions about the city of Madrid, its people and its soul by choosing one of the available options;
Share their responses on Facebook.
Entrants can submit their responses up to 5 times.
5. Entry period
Entries can be submitted from 11 April until 29 April, 2018, both inclusive.
MADRID DESTINO reserves the right to change the entry period dates at any time. Date changes will be announced as soon as possible. Under no circumstances will a change of entry dates entitle entrants to claim any rights or the payment of any sums.
6. Winner
The day after the closing of the promotion, that is, on 30 April, a Grand Prize winner will be selected from all valid entries using the random integer generation platform ‘Random.org’ or 'Random Integer Generator', which is owned by Randomness and Integrity Services Limited (registered office address Unit 20, 2 Waterloo Road, Dublin 4, Ireland, registered in Ireland under number 489434 (http://www.random.org)).
A winner and an alternate winner will be chosen automatically, at random, using the aforementioned application. After the draw, a Certificate of Validity will be issued as guarantee of the winner selection method used and the names of the winner and alternate winner. Prior request to MADRID DESTINO, entrants wishing to access the competition results will be provided with a copy of the Certificate of Validity.
7. Winner notification and prize collection
The winner will be contacted by email. A winning notification will be sent to the email address provided by the winner on the entry form. The name of the winner will be announced on the official Facebook, Twitter and Instagram accounts of the city of Madrid.
To collect the prize, the winner must provide proof of identity by sending a scanned copy of his/her ID card, passport or equivalent document.
The winner confirmation email will include information on how to collect the prize.
If a winner waives a prize, fails to provide proof of identity or cannot be contacted within 15 days, the prize will be given to the alternate winner. If the alternate winner cannot be contacted, the prize will be cancelled.
If the winner cannot be contacted as a result of technical problems or the provision of inaccurate personal information, the prize will be cancelled.
8. Taxes
Under Spain’s Personal Income Tax regulations for residents and non-residents, prizes are deemed to be a capital gain for tax purposes. None of the exemptions provided for in the regulations apply to this kind of capital gains.
Prizes are subject to Personal Income Tax if their value exceeds €300. In the case of this competition, please note that the Grand Prize exceeds €300 (the Grand Prize value will not exceed €800).
Therefore, the winner must provide Madrid Destino with a photocopy of his/her ID card, passport or equivalent ID for tax purposes, so that the relevant payment can be made.
9. Protection of personal data
MADRID DESTINO, whose registered office address is stated above, hereby informs entrants that, in order to participate in the competition, they must provide all personal data requested. Their personal data will be saved into a filing system kept by Madrid Destino for the following purposes:
Managing each entrant’s participation in the competition (including contacting the winner and complying with the tax obligations to which MADRID DESTINO is subject);
Gathering statistical information on opinions about the city of Madrid, its people and its soul, by country of origin, type of traveller, sex and age range, for the purposes of creating and adapting the contents of the official social media accounts of the city of Madrid, mostly on Facebook; and
Sending newsletters containing Madrid’s calendar of events, as well as activities and events promoted by MADRID DESTINO to entrants having expressed their interest in receiving our newsletters in the entry form.
The Grand Prize winner hereby authorizes MADRID DESTINO to post his/her full name on www.esmadrid.com and the official Facebook, Twitter and Instagram accounts of the city of Madrid.
The personal data of entrants will be destroyed once the competition has ended, with the exception of:
The contact details of the winner and the person accompanying the winner for prize collection and tax obligation purposes;
The email addresses of the entrants who, through the entry form, express their interest in receiving newsletters containing Madrid’s calendar of events, as well as activities and events promoted by MADRID DESTINO.
Interested parties may exercise their rights to access, rectify, cancel and oppose the processing of their personal information at any time, pursuant to the provisions of data protection regulations, by emailing a written request to MADRID DESTINO to ComiteLOPD@madrid-destino.com, using the subject line “TELL ME ABOUT MYSELF” and attaching a letter signed by the owner of the information, or their representative, indicating their address for notifications, and a copy of their ID Card or other proof of identity.
ADVALUE COMMUNICATION, S.L. will access the personal data of the entrants in its capacity as Data Processor for MADRID DESTINO, for the sole and exclusive purpose of ensuring that the promotion’s information is appropriately handled and hosted. ADVALUE COMMUNICATION, S.L. will follow the instructions supplied by MADRID DESTINO at all times and may not apply or use the personal data of the entrants for any other purposes, assign said data to any third parties or send any kind of marketing materials.
10. Waivers and liabilities
MADRID DESTINO reserves the right to cancel the competition at any time, with or without a cause. MADRID DESTINO reserves the right to make amends or add further annexes to the rules and prizes, provided that it is so justified or is not disadvantageous for entrants, who will be duly notified of any such amendments or new annexes.
MADRID DESTINO will not be held liable if a winner cannot be contacted or the prize cannot be given because of incomplete or inaccurate information provided by the entrants.
MADRID DESTINO reserves the right to disqualify any entrant who acts in an abusive and fraudulent manner, as well as entrants or winners providing misleading or false information, concealing data or breaching any of these Terms and Conditions.
MADRID DESTINO will not be held liable if the prize is given to an underage entrant, if that entrant concealed information or provided false personal information to enter and win the prize. In such case, the prize will be given to the alternate winner, if any. Otherwise, it will be cancelled.
MADRID DESTINO will not be held liable for any eventualities that may affect the competition, including technical problems, breakdowns or Internet connection problems.
11. Agreement
By participating in this competition, entrants expressly agree to abide by these Terms and Conditions, any decisions adopted by MADRID DESTINO in relation to issues arising from the application of these Terms and Conditions, and the method of and place for delivering the prizes, including submissions sent by MADRID DESTINO to the email address provided by the entrant upon entering the competition.
These Terms and Conditions are governed by the laws of Spain.

12. Applicable law and jurisdiction
This competition will be governed by the applicable laws of Spain, and any controversies that may arise will be submitted to the courts and tribunals of the city of Madrid.
