TERMS AND CONDITIONS FOR THE CONTEST "DESIGN OUR MUGS"
Please read these Terms and Conditions carefully prior to participating in Design Our Mugs Contest (the "Contest"). By participating in the Contest each participant fully and unconditionally agrees to and accepts these Terms and Conditions.
1. Participation Period:
The Contest is open for participation from 08.00, February 6th, 2012 until 23.59 CET on February 29th 2012.
2. Winner is announced:
The winner is announced 20 March 2012 and will be posted on www.sas.dk, www.sas.se, www.sas.no, www.flysas.com. SAS will notify the winners directly via email or telephone shortly after the Contest ends.
3. The Prize:
The prize is set to 100 000 EuroBonus Extra Points. The prize is not transferable and cannot be sold or otherwise assigned, changed or ex-changed for money. The EuroBonus Extra Points must be used within 3 years. For use of EuroBonus points, please see www.sas.dk, www.sas.se, www.sas.no, or www.flysas.com.
4. Contest organizer:
The Contest is organized by Scandinavian Airlines System Denmark-Norway-Sweden, a consortium formed and existing under the laws of Denmark, Norway and Sweden, having its principle place of business at Kabinvägen 5, SE-19587, Stockholm, Arlanda, Sweden ("SAS").
5. Eligibility for Participation:
A person participating in the Contest (referred to as "Participant") must at the time of entry into the Contest be a (i) resident of a European country and (ii) be over 18 years of age. A Participant can only enter the contest once. SAS Group employees are not permitted to enter the Contest.
6. Access to Contest:
The Participants may enter the Contest via the www.flysas.com, www.sas.dk, www.sas.no and www.sas.se websites, where the Participants need to create a profile, and have to upload their design. A purchase or transaction is not required to participate or win. The Participants must however be EuroBonus members, which the Participants can sign up to in connection with signing up to the competition. The Participant must fill out all required fields of the entry form to access the Contest.
7. The Design:
The Participants enter the Contest by providing a design that fits the provided template for the new paper mug to be used on SAS flights.
8. How to win:
There are two stages to the Contest. First a jury consisting of persons appointed by SAS considers all the uploaded designs, and chooses a short-list of the ten (10) best designs ("Finalistsâ€) based on what designs it deems are the best. The decision of the jury is final. The ten Finalists are then presented on the SAS design website, where all visitors can vote on their favorites.
The design with the highest number of votes by the end of the competition, wins the contest.
Please note, all Participants are subject to a final screening process by SAS once the Contest has closed. If the Participant receiving the most votes has breached any of the terms and conditions, the Participant receiving the second most votes will be deemed the winner.
9. Personal Data:
By participating in the Contest the Participant hereby consent to the entries (i.e. designs, name of Participant and email made by Participant being uploaded to the SAS websites, and that the personal details provided by the Participant will be processed by SAS in order to administer the Contest. The person uploading the design and completing the entry form is responsible for ensuring that he or she has the right to do so and that any individuals referred to in the material consents to these terms and conditions and to the material being uploaded to the SAS websites.
10. Content policy for design uploads/ SAS right to reject entries to the Contest:
All Entries into the Contest are subject to SAS's approval prior to being uploaded to the website. All entries that are deemed inappropriate and/or offensive will not be uploaded. Our content policy prohibits images containing nudity or sexually explicit material, or content that is otherwise deemed offensive to any minority group. SAS reserve all rights to decide what is considered inappropriate and/or offensive. Participants agree not to create or submit a profile or any picture or video in connection with their entry into the Contest that is: slanderous, defamatory, derogatory, or slanderous; is pornographic, or otherwise sexually explicit; includes offensive language; portrays violence; portrays or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, portrays or promotes illegal activities; portrays dangerous stunts; promotes bigotry, racism, hatred or harm against any group or individual. If SAS discovers that any material submitted by Participants include any such elements or is otherwise inappropriate and/or offensive, then the entry will be rejected. In addition, in the event that a profile, picture or design is determined by SAS, in its sole discretion, to infringe on the intellectual property of any third party SAS may likewise reject the entry.
11. Cost and taxes:
Participants are responsible for any costs or expenses incurred by them as a result of participating in or winning the Contest. All taxes on the prizes are the sole responsibility of the winner, who shall be responsible for completing any applicable forms required by a taxing authority. The Participant hereby agrees and accepts that by winning the Contest the Participant may incur taxes and other levies including but not limited to any prize tax or income tax etc. The Participant hereby unconditionally accepts to bear any such tax or other levy.
12. Other marketing purposes:
The Participants agree that their contest entries and designs may be used by SAS for general media and marketing purposes.
13. Intellectual Property Rights:
The submission of a design to SAS is entirely voluntary, non-confidential, gratuitous and non-committal. Participant grants to SAS and its designees a perpetual, irrevocable, non-exclusive, fully-paid up, royalty-free, sub-licensable and transferable license to use any design and other materials submitted by Participant in their original and/or in any modified form without restrictions or encumbrances of any kind and without any payment or other consideration of any kind. The license shall include, without limitation, the irrevocable right to reproduce, prepare derivative works, combine with other works, alter, translate, distribute copies, commercialize, exploit, market, sell, display, perform, and license the design or any part thereof in the name of SAS, or its designees worldwide in perpetuity in any and all media. Any modified version of the design and any materials produced by SAS or its designees in connection with or based upon the design shall be deemed materials owned by SAS and shall not be subject to your approval or payment by SAS of any compensation to Participant.
Participant confirms and warrants that the design represents his/her own original work, that he/she has all necessary rights to disclose the design to SAS and granting SAS the rights set out in these terms and conditions, and that neither such disclosure or grant of right, nor SAS review and/or use of the design, will infringe upon any other individual‘s or entity‘s rights. If the design is the subject to any pending or registered intellectual property right, Participant will disclose that fact to SAS at the time of your Submission of the Idea.
14. Liability:
SAS and the Participants are liable for any claims subject to the Contest under the usual Swedish tort law, subject to the qualifications below.
SAS is not responsible for any lost, late, misdirected, stolen, illegible or incomplete entries. If, for any reason, the Contest is not capable of running as planned, caused by e.g. infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of SAS which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, SAS reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and/or select winners from all eligible entries received prior to the cancellation. SAS reserves the right to correct any typo-graphical, printing, computer programming or operating errors at any time.
SAS reserves the right at its sole discretion to disqualify any Participant it finds to be tampering with the entry process or the operation of the Contest; to be acting in violation of these Terms and Conditions; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person or contestant.
SAS is not responsible for any incorrect or inaccurate information, caused by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest. SAS assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. SAS is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. SAS is not responsible for any injury or damage to any Participant or to any computer related to or resulting from participating or downloading materials in connection with this contest.
15. Governing law:
These Terms and Conditions shall be governed by and construed in accordance with the laws of Sweden and the courts of Sweden shall have exclusive jurisdiction in relation to any disputes arising out of or in connection with the Contest.
