Yankee Candle Company (Europe) Limited (the "Promoter"), whose registered office is located at Cabot Park, Poplar Way East, Avonmouth, Bristol, BS11 0YH, is solely responsible for all aspects of this contest (the "Contest").
This Yankee Candle® Contest is open only to physical end users, buyers and consumers of Yankee Candle products (the "Entrants"), residents of Great Britain and France aged 18 and over as at the time of the Contest and who are available to travel to the United States of America from 24th January 2020 to 11th December 2020. Directors and employees of the Promoter, its parent, subsidiaries, affiliates involved in the Contest, any Brand Ambassadors, and each of their immediate family members and/or people living in the same household are not eligible to enter the Contest. Failure to comply with any part of this clause will disqualify the respective entry from the Contest.
There is no entry fee and no purchase necessary to enter the Contest.
Entries will be accepted from Monday 2nd September 2019 at 9.00 am GMT; 10.00 am CET all entries must be received by Wednesday 11th December 2019 at Midnight GMT, 1.00am CET Thursday the 12th of December 2019. After this date, no further entries to the Contest will be permitted.
Internet access is required. Internet access and usage charges imposed by on-line and/or mobile service providers will apply at the Entrants' own cost. Each Entrant shall enter the Contest via the landing page only, entering their name and email address. The landing page will be available via yankeecandle.co.uk or www.yankeecandlefrance.com. To enter, visit the Contest website, entering your names and email address in the form, submit the form and you will receive confirmation of the submission by email.
Obscene or inappropriate entries will not be accepted and the Promoter reserves the right to reject any such entries.
Only one entry per person per Contest will be accepted. The Promoter reserves the right at its sole discretion to disqualify any individual found to be attempting to circumvent this clause by tampering with the operation of the Contest (including not limited to) setting up multiple accounts, using multiple identities or to be acting in any manner deemed by the Promoter to be in violation of these terms and conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
One winning prize (the "Prize") shall be awarded to the Winner who will be drawn at random and 50 runners up prizes (the "Runners Up Prizes") are available. Runners up prize value of £49.98 RRP for the UK and €80 RRP for France awarded to the Entrants who have then been drawn at random (the "Runners Up") .
The Prize, the total approximate retail value of which is GPB£4000 are EUR4.400 ( based on exchange rate on 22nd of August 2019 ), is a 5-day trip to Boston for two, including a trip to South Deerfield with a tour of the Yankee Candle® factory.
The Prize includes two direct return economy flights from London Heathrow, England or Paris Charles de Gaulle, France to Boston Logan International Airport and all related taxes, five nights in a hotel for two based on one double or twin room (maximum spend £1000, EURO €1.096 ), USD $750 spending money ($250 of which must be spent in the South Deerfield Yankee Candle store), tour of the Yankee Candle® factory and return trip via car or taxi from the hotel to the Yankee Candle® factory in South Deerfield.
The Prize must be booked via Yankee Candle Company (Europe) Limited (the "Promoter"), before Friday 24th January 2020 and is valid for travel from twelve months from the entries closing date being 11 December 2019. The outgoing flight must depart London Heathrow, England or Paris Charles de Gaulle, France on or before the 10th of December 2020.
Yankee Candle Company (Europe) Limited (the "Promoter") shall purchase the airline ticket on behalf of the Winner.
No additional costs or charges related to travel are included.
The five-night hotel stay for two is on a room only basis based on availability and blackout dates will apply. All other meals & incidentals (excluding Wi-Fi & lobby coffee) are to be paid for by the Winner.
No transportation is included to and from the airports. The Winner is responsible for all expenses and arrangements (transportation to and from the departing and destination airport) not specifically included in the Prize.
Airport transfers in the USA, the UK and France are not included.
Prize tickets do not include chauffeur-drive, valet parking or rail tickets.
Both the Winner and its chosen guest must be over the age of 18 at the time of travel.
Once travel and accommodation have been booked, the Prize cannot be amended.
Whilst we will do all we can to book your trip on your preferred dates, this is not always possible, and we ask that you provide Yankee Candle Company (Europe) Limited (the "Promoter") multiple options via email as soon as possible and within 30 days from the notification of the Prize. More popular holiday periods for the destination get booked up quickly and there are no guarantees we will be able to offer your first choice of dates.
The Winner and its chosen guest must ensure that they have the correct travel documentation and obtain the relevant Visas. Such travel documentation is at the sole expense of the Winner. Failure to be granted a Visa and / or have the necessary travel documentation will result in the Winner forfeiting their prize. If the prize is forfeited Yankee Candle Company (Europe) Limited (the "Promoter") will select another Winner.
The content of the Prize may be subject to change and/or substituted with a prize of equal or greater value.
We require Winner and Runners Up name, contact number, postal address & email to facilitate the Prize and the Runners Up Prizes.
Due to the nature of the Prize, please be aware that it can take several weeks to confirm dates. Yankee Candle Company (Europe) Limited (the "Promoter") will confirm dates no later than the 24th January 2020.
The Runners Up Prizes will be a Returning Classic large jar Yankee Candle® and a Scent of the Year Large Jar Yankee Candle ®, the approximate retail value of which is £49.98 RRP for the UK and €80 RRP for France. These will be given to 50 Runners Up.
The Winner and 50 Runners Up will be selected on the 12th of December 2019 at random via a random computer name generator.
The Winner will be notified by email on Friday 13th December 2019 and will be contacted by the Promoter to organize the Prize. The Winner will be asked to provide the Promoter, within 30 days from the notification of the Prize, multiple options for the dates of the Prize by fulfilling a form, being said that the Prize must occur before 10th December 2020. The Promoter will confirm these dates within two weeks from the receipt of the form. If the Winner cannot be contacted or does not claim the Prize within 7 days of notification, we reserve the right to withdraw the Prize from the Winner and pick a replacement winner using a random computer name generator.
The Runners Up will be notified by email on Friday 13th December 2019 and Runners Up Prizes will be dispatched out via courier no later than 7 days from receiving the Runners Up addresses.
The Promoter will not be liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid.
To the extent permitted by applicable law and, except for French residents, the Promoter’s liability under or in connection with the Contest or these terms and conditions shall be limited to the value of the prize in question.
To the extent permitted by applicable law and except for French residents, the Promoter shall not be liable under or in connection with these terms and conditions, the Contest or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by an Entrant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the Entrant and the Promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the Promoter reserves the right to substitute that Prize for a prize of equal or higher value.
The Runners Up Prizes cannot be used in conjunction with any other offer or promotion.
In the event of unforeseen circumstances beyond the Promoter’s reasonable control, the Promoter reserves the right to change the dates of the Prize and substitute with other dates, cancel, terminate, modify or suspend the Contest or these terms and conditions, either in whole or in part, with a reasonable notice to the Entrants.
For residents of Great Britain, these terms and conditions are governed by law of England and Wales. This choice of law does not deprive you of the protection afforded to you under your own laws and such provisions that cannot be derogated from by agreement by virtue of the law of your jurisdiction.
For French residents, these terms and conditions are governed by French law.
These terms and conditions are subject to the non-exclusive jurisdiction of i) the court where the defendant is domiciled or (ii) the court where the obligation has been performed.
The Promoter, and any of its affiliates acting as a controller under relevant data protection rules and regulations, will retain your personal data solely for the further course and completion of this Contest, for participation management and contact with Winner and the Runners Up. This includes full name, email address and home address. Your personal data will be treated in confidence and will not be disclosed to any third party that are not affiliated to Newell Brands, the parent company of the Promoter, unless required for the proper conduct of this Contest. Your data will may transferred outside of the EEA solely for the purpose of administering this promotion. You have a right to access, modify or remove your personal data by completing the following form. For any complaints, questions and/or the exercise of its rights, Entrants can contact (i) their local customer service team; or (ii) our Data Privacy Committee here.
