Full Terms and Conditions for Sweepstakes („Rules“)
1. Agreement to Rules: By participating in the Sweepstakes, each entrant (hereinafter “You”) is deemed to have accepted the Rules. You must comply with the Rules in full to be eligible to win a Prize. You accept and agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. The Sweepstakes are subject to applicable federal, state, and local laws and regulations.
2.Promoter of Sweepstakes: The Sweepstakes are being run and administered by the promoter trivago N.V. (hereinafter “trivago”), with its business address Kesselstraße 5-7, 40221 Düsseldorf, Germany. You can contact trivago about the Sweepstakes by emailing to info@trivago.com.
For the fulfillment and delivery of the Prize, trivago will be assisted by Nobody’s Café Ltd (“Nobody’s Café”), 85 Great Portland Street, London, W1W 7LT, United Kingdom, which will deal with the Winner(s) and handle personal data on behalf of trivago in accordance with applicable data protection laws.
3. Promotion Period: The Sweepstakes will be open for the duration of the Promotion Period as set forth above. Entries received by the trivago outside of the Promotion Period will not be eligible to win a Prize.
4. Eligibility: You are only eligible if You satisfy the age requirements and reside within the Territory as set forth above. If the Prize includes tickets to a match, event, flights or other travel services and/or accommodation, by entering the Sweepstakes You confirm that you are and will be (a) available, and (b) eligible to travel to the United Kingdom (including, but not limited to, complying with the UK Covid-19 travel requirements and having a valid passport and visa, if applicable) on and around the dates the Prize will take place.
Directors and employees of trivago, its affiliates, subsidiaries, anyone professionally connected with the Sweepstakes and any member of their respective immediate family and/or people living in the same household are not eligible to participate in the Sweepstakes or win a Prize.
trivago reserves the right to refuse entry to, void the entry of, refuse to award a Prize to or withdraw a Prize awarded to, any entrant who breaches any of the Rules. No purchase is required to participate in the Sweepstakes. However, You will need an Internet connection; no refund may be claimed for expenses incurred in participating in the Sweepstakes, including in relation to the use of the Internet.
5. Entry to the Sweepstakes: To enter the Sweepstakes, You must carry out the Entry Requirements during the Promotion Period as set forth above. You may only participate in the Promotion once. Duplicate entries will be void and only the first entry submitted will be eligible to win a Prize. trivago reserves the right, at any time, to (a) verify the eligibility of any participant (including their age and place of residence) and (b) exclude anyone who trivago believes to have acted in breach of the Rules. Entries that are incomplete or do not adhere to the Rules may be disqualified at the sole discretion of trivago. If You use fraudulent methods or otherwise attempt to circumvent the Rules, your entry may be removed at the sole discretion of trivago. trivago shall not be responsible for any attempt to participate in the Sweepstakes which is unsuccessful or incomplete for any reason, including because of communication or network failures.
6. Winner Selection and Odds: At the end of the Promotion Period, trivago will select the winning entries as the “Winner(s)”. The number of the winning entries shall be the number of the Winner(s) as set forth above. The Winner(s) will be selected through a random drawing conducted from among all eligible entries. The odds of winning depend on the number of eligible entries received.
7. Winner Notification and Prize Acceptance: The Winner(s) will be announced and informed as set forth above within ten (10) days following the end of the Promotion Period (using the information submitted as part of their entry). The Winner(s) will have two (2) days to confirm their acceptance of the Prize and provide their address as well as further contact details (if applicable). If the Winner(s) fail to accept the Prize within the period set forth herein, such Winner(s) forfeit the Prize and alternate Winner(s) may be selected. Receipt by the Winner(s) of the Prize offered in these Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of the Rules by Winner(s) will result in the disqualification of such Winner(s) of the Sweepstakes, and all privileges as Winner(s) will be immediately terminated.
8. Prize: The Winner(s) will each receive a Prize as set forth above. The Prize does not include any other services not expressly stated above. All costs and expenses not expressly included in the Prize are the responsibility of the Winner(s), including for the avoidance of doubt any costs connected with the Winner(s) eligibility to travel. The Winner(s) shall be solely responsible for all taxes that are required to be borne by the individual Winner(s), and the reporting consequences thereof, and for any other fees or costs associated with the applicable Prize.
Unless otherwise agreed, the Prize will only be awarded to the Winner(s). Under no circumstances may the Prize be sold or transferred, for cash or otherwise. The Prize may not be substituted or exchanged and there is no cash alternative. If the Prize includes tickets to a match, event, flights or other travel services and/or accommodation, and the Winner(s) are not then available or eligible to travel on such dates for any reasons, that Winner(s) will not be eligible for the Prize and no alternative will be offered to that Winner(s).
Where the Prize is subsequently not available for any reason beyond trivago’s reasonable control, trivago may replace the Prize with a prize of similar value.
All Prizes are subject to the terms and conditions of any supplier(s) of relevant services included in the Prize (for example transport providers, providers of hotel or other accommodation, event organizers and event rules and policies, in particular (where applicable) the provisions of Chelsea FC as set forth in Section 10 of these Rules and provisions of Nobody’s Café).
Winner’s Guest: Each Winner may select one guest who will accompany him/her during the concerned GoC Experience, subject to the Rules as set out herein. The guest of the Winner must be of legal age (i.e. eighteen (18) years or older) as of the date of departure for the GoC Experience. If the Winner’s guest is under the legal age or considered as a minor in his/her state of residence (collectively the “minor”), the Winner must be such minor’s parent or legal guardian, or such guest, who is a minor, must have the written permission provided by his/her parent or legal guardian in form and substance acceptable to trivago in its sole discretion to be allowed to join the concerned GoC Experience with the Winner.
The Winner and the guest must travel to the concerned GoC Experience together, on the same itinerary and on same dates specified by trivago. Upon the confirmation of the accompanying guest by the Winner, the Winner must not substitute the chosen guest by another person. The guest will be subject to the same Rules as accepted by the Champion. The guest’s eligibility and participation in the concerned GoC Experience is subject to the Winner’s adherence to the Rules of the Sweepstakes. Neither the Winner nor the guest will be eligible to participate in the concerned GoC Experience if either the Winner or the guest breaches any of the concerned Rules or is unable to attend the GoC Experience.
9. Rights Granted by You: To the extent permitted by and in accordance with applicable laws, trivago may use the Winner’s information and any material created in the context of the relevant Sweepstakes and throughout the GoC Experience, either by the Winner(s) and the guest(s) or by trivago or anyone acting for or on behalf of trivago, in promotional materials for other Sweepstakes, promotions in social media or advertising, PR/publicity and for other advertising purposes of trivago in the context of trivago’s services without further compensation, notice, review or consent. Information may include, but without limitation to, all or part of the Winner’s and the guest’s name, pictures and videos taken before, during or after the GoC Experience, social media posts. Trivago will separately obtain the consent of the Winner(s) and the guest(s) prior to the processing of their personal data for the purposes set out in the consent form before using their personal data for promotional and marketing purposes and the Winner(s) and the guest(s) may withdraw their consent at any time by sending an email to competitions@trivago.com.
10. Specific Rules for Prizes including visits at locations of Chelsea Football Club (“Chelsea FC”):
10.1. All Chelsea FC fixtures are subject to change. Use of any tickets or access to any venue owned or controlled by Chelsea FC, including the Stamford Bridge stadium, as part of the Prize is subject to Chelsea FC's ticketing rules and regulations from time to time including Ground Regulations and Conditions of Issue, copies of which can be accessed at www.chelseafc.com/tickets-membership/general-ticket-info/policies.
10.2. The Winner's attendance at any venue(s) not owned or controlled by Chelsea FC are subject to that venue’s rules and regulations, which may include the right to refuse admission or eject any person at the venue’s discretion. The Winner may be required to adhere to a dress code prescribed by the venue.
10.3. Chelsea FC assumes no responsibility for and accepts no liability regarding any aspects of the Prize that are not under the control of, or are not fulfilled by, Chelsea FC (including any non-fulfilment of such aspects of the Prize). This includes, for example, delivery of the Prize to the Winner(s), for which Chelsea cannot be responsible.
11. Further Sweepstakes’ Terms & Conditions: trivago reserves the right to amend the Rules, any Prize and cancel the Sweepstakes at any time as a result of circumstances beyond trivago’s reasonable control, including but not limited to viruses, bug, non-authorized human intervention, fraud or other cause beyond trivago’s reasonable control which corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, trivago may select the Winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by trivago. trivago reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Rules. trivago has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to the use of bots, macros, scripts, or other technical means for entering. Any attempt to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, trivago reserves the right to seek damages to the fullest extent permitted by law.
12. Limitation of Liability: trivago’s liability is excluded. The exclusion of liability shall not apply in the following cases, i.e. trivago shall bear unlimited liability towards You for actions by a legal representative of trivago or persons used to perform an obligation of trivago in case of willful action or gross negligence, for personal injury to life, body or health, to the extent of any guarantee given by trivago in writing, under the terms of the applicable Product Liability Act and to the extent mandatory by law. Notwithstanding trivago’s unlimited liability pursuant to the aforementioned sentence, in cases of minor negligence trivago shall only be liable for breaches of material duties under the Rules, i.e. duties that must be fulfilled for the performance of the Sweepstakes to be possible and which You can generally rely upon as being complied with. trivago´s liability shall in this case be limited to the contract-typical damage foreseeable at the day of agreeing to the Rules. The above limitations of liability shall also apply in favor of legal representatives of trivago and persons trivago used to perform its obligations.
13. Data Privacy:
13.1 if you enter the Sweepstakes, you may be asked to provide the following types of personal data:
• Your name, email address, phone number, country of residence, zip code and age range.
• Only if you are selected as Winner: your nationality, passport number, passport issue and expiry date, date of birth, place of birth, postal address.
• In accordance with Section 9 of the Rules, pictures and videos taken before, during or after the GoC Experience, social media posts (collectively "Personal Data").
Your Personal Data will either be collected by trivago, acting as data controller, or by Nobody's Café, acting on behalf of trivago as data processor.
13.2 trivago will process your Personal Data to verify your eligibility to enter the Sweepstakes and allow you to participate, to administer and operate the Sweepstakes (as described in the Rules), to notify your success if you are selected as Winner, to deliver the Prize and to measure the response to the Sweepstakes. If you decline to provide the Personal Data, trivago may not be able to register or enter you into this Sweepstake or award you any Prize if you have been selected as Winner(s).
13.3 Where needed to deliver the Prize, Personal Data of Winner(s) may be shared to the following recipients: Nobody's Café, transport companies, hotels, Chelsea FC or any other relevant third party.
13.4 In addition to the terms herein, any Personal Data submitted in connection with the Sweepstakes will be processed by trivago in accordance with trivago's Privacy Notice (as may be amended from time to time), which you can find here .
14. Governing Law and Jurisdiction, Disputes: The Sweepstakes and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of England and Wales without respect to the conflict of law doctrines. You agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Sweepstakes.
APPLICABLE TO US RESIDENTS ONLY: All issues and questions concerning the construction, validity, interpretation and enforceability of the Rules or the rights and obligations of You or trivago in connection with the Sweepstakes shall be governed by and construed with the internal laws of the state of Delaware without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. For the purposes of any disputes hereunder, by entering this Sweepstakes, each entrant agrees that any and all disputes, claims, and causes of action arising out of or in any way related to this Sweepstakes shall be resolved individually, without resort to any form of class action and consents to the exclusive jurisdiction and venue of the appropriate state or federal court situated in the District of Delaware, Delaware.
ARBITRATION PROVISION FOR US RESIDENTS ONLY: By participating in the Sweepstakes, You agree that any and all disputes You may have with, or claims You may have against trivago relating to, arising out of or connected in any way with (a) the Sweepstakes, (b) the awarding or redemption of any Prize, and/or (c) the determination of the scope or applicability of this agreement to arbitrate (a “Claim”), will be resolved exclusively by final and binding arbitration in accordance with the Rules of the American Arbitration Association (“AAA Rules”). The arbitration will be heard and determined by a single arbitrator. The arbitrator's decision in any such arbitration will be final and binding upon the parties and may be enforced in any court of competent jurisdiction. The parties agree that the arbitration will be kept confidential and that the existence of the proceeding and any element of it will not be disclosed beyond the arbitration proceedings, except as may be required by applicable law. If You demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, trivago will pay as much of the administrative costs and arbitrator’s fees required for the arbitration as the arbitrator deems necessary to prevent the cost of the arbitration from being prohibitive. In the final award, the arbitrator may apportion the costs of arbitration and the compensation of the arbitrator among the parties in such amounts as the arbitrator deems appropriate. This arbitration agreement does not preclude You from seeking action by federal, state, or local government agencies. You and trivago also have the right to bring qualifying claims in small claims court. In addition, You and trivago retain the right to apply to any court of competent jurisdiction for provisional relief, including pre-arbitral attachments or preliminary injunctions, and any such request shall not be deemed incompatible with these Rules, nor a waiver of the right to have disputes submitted to arbitration as provided in these Rules.
Neither You nor trivago may act as a class representative or private attorney general, nor participate as a member of a class of claimants, with respect to any Claim. Claims may not be arbitrated on a class or representative basis. The arbitrator can decide only your and/or trivago’s individual Claims. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial.
THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN AAA RULES, AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. OTHER RIGHTS THAT YOU OR trivago WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. If any provision of this section is found to be invalid or unenforceable, then that specific provision shall be of no force and effect and shall be severed, but the remainder of this section will continue in full force and effect. This section of these Official Rules will survive the termination of your relationship with trivago.
15. Miscellaneous: All decisions made by trivago in respect of the Sweepstakes shall be final and no correspondence will be entered into.
16. COUNTRY SPECIFIC NOTICES: If any provision of these Rules for the Sweepstakes shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable under the law, rules or regulations of a particular country, such invalidity or unenforceability shall not affect the other provisions of these terms and conditions, and all provisions not affected by such invalidity or unenforceability shall remain in full force and effect. The Sweepstakes shall only apply to the extent permitted.
