By playing the competition “Vampire Victim” (‘Competition’) on the website www.vampirevictim.com (‘Website’), you acknowledge and agree that you accept the following terms and conditions relating to the Competition:
1.PROMOTER: The promoter of the Competition is NBC Universal Global Networks Management Limited of Oxford House, 76 Oxford Street, London W1D 1BS (‘Promoter’ and for the purposes of these terms and conditions ‘Promoter’ shall be deemed to include the Promoter’s affiliates, successors, assignees and licensees).
2.ELIGIBILITY:(a) AGE Entrants must be aged 18 or over; (b) ABILITY TO TRAVEL Entrants must be available to travel to Sofia, Bulgaria at any time between 10 May 2011 and 30 July 2011; (c) EMPLOYEES Employees or agents of the Promoter and their immediate families are not eligible to enter; (d) RESIDENCE Entrants must be legally resident in France, Switzerland, Andorra, Monaco, Luxembourg or Belgium.
3.COMPETITION DATES: The Competition starts on 28 March 2011 and closes at midnight on 25 April 2011 (‘Close’). Entries submitted after this time will not be accepted. The Promoter accepts no liability for Entries which are submitted during this time but which are not received by the Promoter due to network congestion, technical problems with the Website or otherwise.
4.ENTRY: Details of how to enter the Competition can be found on the ‘Vampire Victim Competition’ page (‘Competition Page’) on the Website. Entrants must upload the following onto the Website in accordance with the instructions on the Website (“Entry”): (a) a photograph (‘Photograph’) of themselves in role as a vampire character of their choosing and (b) an answer in English in not more than 400 words to the question “Why do you think you would make a good vampire?”
5.ACCEPTANCE OF ENTRIES:(a) PHOTOGRAPH FORMAT All Photographs must be digital (not scanned hard copies) and the maximum file size for a single digital image is 4MB. The size of the image must be a minimum of 400x300 pixels and a maximum of 6000x6000 pixels and a minimum screen resolution of 150 dpi. Any Photographs which do not comply with these specifications will not be accepted. (b) VERIFICATION PHOTOGRAPH For the Promoter’s verification purposes, entrants may be asked to submit a photograph of themselves showing their normal, everyday appearance (“Verification Photograph”) in addition to their Entry. (c) ENTRY CONTENT The Promoter shall use its sole discretion in accepting Entries and any Entries which the Promoter does not accept may be deleted at any time without notice. Without limitation and by way of example, the Promoter will not accept Entries and/or Photographs which include personal information about the entrant or any other person and/or which the Promoter, in its sole discretion, considers (i) may cause offence or may be otherwise unsuitable or inappropriate for the Competition; and/or (ii) may infringe third party rights including, without limitation, copyright, trade mark rights, other intellectual property rights and privacy rights.
6.JUDGING PROCESS: On or around 26 April 2011, a panel of judges in London (“Judges”) (which will include at least one judge who is independent of the Promoter) will assess all Entries and will select as the winner (“Winner”) that Entry which, in the opinion of the Panel, demonstrates the most creativity and imagination, fun and uniqueness. The Judges’ selection of the Winner will be final.
7.PRIZE: There is one prize, which consists of (a) a non-speaking role in the television movie “Vampyre Nation” (“Movie”) currently scheduled to be filmed for Syfy Universal in Sofia, Bulgaria between 16 May 2011 and 30 July 2011 (These dates are subject to change at the sole discretion of the Promoter and/or Producer of the Movie. *It is anticipated that the Winner will only be required for one day’s filming) (b) return economy class flights for the Winner and a guest between an airport of the Promoter’s choosing situated in the Winner’s country of residence to Sofia, (c) return transfers for the Winner and their guest to and from Sofia Airport, (d) four nights’ accommodation for two people in a double/twin room at the Arena & Serdica Hotel including breakfast, (e) one day’s tour of Sofia and the Vampyre Nation film set and (f) spending money equivalent to GBP200 per person. The Winner must be (i) available and able to travel to Sofia between 10 May 2011 and 30 July 2011, (ii) fit and healthy enough to participate in filming (the Promoter reserves the right to request a certificate of fitness from a qualified medical professional) and (iii) be able to speak and understand English. If the Winner does not satisfy these requirements then the Promoter may in its sole discretion deem the prize forfeited. The prize does not include anything not specifically set out in these terms and conditions, including without limitation travel insurance. It is the Winner’s responsibility to arrange and pay for travel insurance and to ensure that those travelling hold valid passports and any other necessary travel documents, including without limitation visas. In the event that passport control or in-country authorities refuse entry, or place conditions on entry, to Bulgaria, the Promoter accepts no responsibility in that respect. It is the winner’s responsibility to check any travel advisories issued by the Government and to determine whether they wish to accept the risk of travelling to Sofia. The Promoter accepts no responsibility for any loss or damage suffered arising out of any failure to follow any travel advisories issued by the Government or if the winner is unable to redeem the prize as a result of a Government travel advisory. The prize is non-transferable. No cash alternative is available for the prize. In the unlikely event that a prize should become unavailable, the Promoter reserves the right to substitute a prize of equal value.
8.PRIZE CONFIRMATION AND ACCEPTANCE:(a) CONFIRMATION The Winner will receive an email using the email address provided by the Winner at the time of entering the Competition on or around 29 April 2011 confirming that they have won the prize. (b) ACCEPTANCE The Winner must accept their prize and provide (i) satisfactory evidence to the Promoter of identity, age and address, ability to travel to Sofia, fitness, proficiency in English and any other eligibility requirements; and (ii) a signed clearance agreement with the Producer of the Movie in a form acceptable to the Producer of the Movie, by no later than three days after the date of the Promoter’s notification email. If (a) no claim is received by the Promoter, (b) the Promoter does not receive all evidence requested to the Promoter’s satisfaction or (c) the Promoter is unable to contact the Winner during this time, the Promoter reserves the right to deem the prize forfeited and the Promoter may, in its absolute discretion, select another winner. Any tax payable as a result of winning the prize will be the sole responsibility of the prize winner.
9.WINNER’S NAME: The name and country of residence of the Winner can be obtained by sending a stamped self-addressed envelope to Central Marketing Team, NBC Universal Global Networks Management Limited, Oxford House, 76 Oxford Street, London W1D 1BS, stating for which competition you would like the Winner’s details.
10.COPYRIGHT AND PROMOTIONAL RIGHTS: By entering the Competition, each entrant (i) confirms that they are the owner of the Entry and Photograph submitted by them; (ii) confirms the Entry and Photograph submitted by them do not infringe the copyright of any other person; (iii) grants to the Promoter, without the requirement for any further permission or payment, a perpetual, non-exclusive, irrevocable and royalty-free worldwide licence to feature the Entry and Photograph submitted by them and their name, town and country of residence and likeness in any and all media for marketing and promotional purposes.
11.PERSONAL DATA: All personal information collected about entrants to the Competition by way of their entering the Competition will only be used in accordance with the Promoter’s current privacy policy contained on the Website and for the following purposes: to administer the Competition as set out in these Terms and Conditions, to select the Winner and to arrange fulfilment of the prize.
12.PROMOTER’S LIABILITY: As far as is permitted by law, the Promoter excludes responsibility and all liabilities arising from any postponement, cancellation, delay or changes to the Competition and/or prize beyond the Promoter’s control and for any act or default of any third party supplier. The Promoter accepts no responsibility for any late or misdirected entries including without limitation emails not received due to technical disruptions or network congestion. The receipt by the prize winner of any prize is conditional upon the winner complying with any and all applicable laws, rules and regulations including, without limitation, these terms and conditions. The Promoter is not responsible for the production of Vampyre Nation and provides no guarantees as to the inclusion of content showing the Winner being included in Vampyre Nation.
13.CANCELLATION AND AMENDMENT: The Promoter reserves the right to cancel or amend the Competition or these Terms and Conditions at any time without prior notice.
14.JURISDICTION: Notwithstanding any rules on the conflict of laws, the Competition and these Terms and Conditions are governed by English law.
