1. The Competition will be executed on www.shure-remix-competition.eu and on SoundCloud
2. The closing date for entries is 14th December 2012, 2:00pm Central European Time (CET)
3. The competition is open Worldwide (SAVE THAT children under 18 years of age must be able to provide the consent of a parent or guardian if requested as detailed below)
4. Entry limited to one per person
5. The participant must send his submission in accordance with the instructions on the submission page on the website www.shure-remix-competition.eu. Submissions will not be accepted by e-mail, post or other means not specified on the aformentioned website.
6. Entrants shall not be entitled to make any use of any nature of their remix embodying the Recording other than to take part in the competition as set forth herein without the express prior written consent of Polydor Records (“Polydor”).
7. The best 3 entries will be selected for prizes and this will not be in any way linked to the number of listens.
8. Subject to clause 17 below, Entrants will be entitled to share a link to their remix on www.shure-remix-competition.eu but must not share their remix by any other format, means or method.
9. Shure/Snow Patrol reserves the right to reject any entry
10. All rights in the Recording are reserved by Snow Patrol and Polydor and nothing contained herein or in the competition shall grant any rights in the Recording to an entrant or any other third party, save as provided herein.
11. Shure/Snow Patrol reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of terms and conditions. Shure/Snow Patrol reserves the right to amend these General Rules. Any amendments will be published on the website.
12. All entries received by 14th December 2012, 2:00pm Central European Time (CET)will be judged by Shure/Snow Patrol.
13. By entering and submitting a remix, all eligible entrants agree to abide by each and all of these General Rules, the Terms and Conditions that govern Shure/Snow Patrol. No remix submitted as part of this competition, regardless of age, should contain sounds or words that could be offensive to the reasonable person on grounds that it discriminates against or is discriminatory to any person or group (whether on grounds of sex, race, religion or other).
14. The entrants represent and warrant that the remix submitted is the entrant’s original work. In addition the entrant represents and warrants that the remix shall not contain any so called samples and/ or other copyright material owned by a third party save for the Recording.
15. The entrants agree that Shure will forward their contact information in any case of copyright infringement to the infringed party
16. The winners of the prizes agree that Shure will forward their contact information to Snow Patrol and Polydor.
17. In addition all entrants agree and acknowledge that they shall only be entitled to use and/ or exploit the Materials (ie their remix) on www.shure-remix-competition.eu as a stream and not a download and warrant that they will not upload their remixes of the Recording to any websites other than the aforementioned. For avoidance of doubt: the participants in the remix competition are granted the right to share their upload on www.shure-remix-competition.eu and embed their upload on other platforms but they are not permitted to upload the source file to any other source or public online platform other than www.shure-remix-competition.eu.
18. The winners will be announced on the Site in January 2013 and the winner will be notified by e-mail within 30 days thereof. All reasonable endeavours will be made to contact the winners during this time. If a winner cannot be contacted before this time on the mobile number or email address supplied by the entrant with their entry, Shure/Snow Patrol reserves the right to select the entrant whose entry the judging panel consider to be next best.
19. The judges’ decision is final and binding on the entrants. No correspondence will be entered into.
20. Uses of personal data received by Shure in the course of the competition are subject to the privacy policy found on the Website. The winner’s(‘) names may be published on the Websites.
21. By entering the competition all entrants are deemed to have accepted and be bound by these General Rules.
22. Shure/Snow Patrol reserves the right at any time to cancel, modify or supersede the competition (including altering prizes) if, the competition is not capable of being conducted as specified.
23. These terms and conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.
24. If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforced.
