JEU CALENDRIER DE L’AVENT – SANDAYA - Règlement de participation
La société organisatrice « SANDAYA », SA au capital social de 42 050 000,00 € dont le siège social est situé 472 RUE DU RAJOL, CS 83005, 34137 MAUGUIO, immatriculée au registre du commerce et des sociétés de Paris sous le numéro B 524 027 455 organise du 1 au 25 décembre 2024, un jeu gratuit et sans obligation d’achat sur la plateforme Qualifio.
Article 1 : Participation
La participation à ce jeu concours est ouverte à toute personne physique, majeure selon la loi Française à la date du lancement du jeu.
Ce jeu est valable dans tous les pays, à l’exception du personnel salarié de la société organisatrice, de tous les prestataires ayant collaboré à l’organisation du jeu, ainsi que de leurs familles (même nom, même adresse).
Article 2 : Principes et modalités de participation

La participation au concours implique l'acceptation expresse et sans réserve du présent règlement en toutes ses stipulations. Tout litige concernant son interprétation sera tranché souverainement et sans appel par la société organisatrice.
Les participants s'interdisent de mettre en œuvre ou de chercher à mettre en œuvre tout procédé de participation qui ne serait pas strictement conforme au respect des principes du concours et de ce présent règlement.
La Société organisatrice se réserve le droit d'écarter tout participant ne respectant pas totalement le présent règlement. La Société organisatrice se réserve également le droit de poursuivre quiconque tenterait de frauder ou de nuire au bon déroulement du concours.
Nombre de participations autorisées : Le candidat peut tenter sa chance une fois par jour entre le 1er et le 25 décembre 2024.

Article 4 : Sélection des gagnants et remise du lot
Les jeux de type instants gagnants désigneront un gagnant aléatoirement dans la journée.
Pour les jeux nécessitant un tirage au sort, celui-ci sera effectué le lendemain ou 2 jours plus tard si week-end, parmi les joueurs ayant participé à la case concernée et ayant renseigné une adresse email valide.
Le gagnant sera informé par la société organisatrice « SANDAYA » par email.
Le gagnant prendra ensuite contact par mail avec la société organisatrice pour transmettre ses coordonnées personnelles pour l’envoi des lots ou pour réserver le séjour gagné le cas échéant.
L’envoi des lots aux gagnants par voie postale aura lieu dans les 30 (trente) jours après la fin du jeu.
Les gagnants des week-ends et de la semaine devront effectuer leur séjour avant le 31 octobre 2025.
Entraîneront l’annulation du gain : le retour à la société organisatrice Sandaya du mail d’information du gagnant par courrier pour cause d’adresse et/ou d’email et/ou de changement d’adresse erronée, la renonciation à son lot par le gagnant pour quelque raison que ce soit, ou tout autre cas fortuit.
Sans préjudice de toute action judiciaire, Sandaya n’est pas tenue de faire parvenir le lot au gagnant s’il a manifestement, et par n’importe quel moyen, réussi à fausser le résultat du jeu ou ne s’est pas conformé au présent règlement. Dans cette hypothèse, le lot restera la propriété de Sandaya qui sera libre de la réattribuer ou non à toute personne de son choix.
Le lot est strictement personnel et n’est ni transmissible, ni échangeable contre une valeur monétaire, ou un autre lot.
En cas de force majeure ou d’événement particulier, la société Sandaya se réserve la possibilité de remplacer le lot gagné par un lot de nature et de valeur équivalente, sans engager sa responsabilité de ce fait.
La société Sandaya décline toute responsabilité se rapportant au lot offert, notamment en cas de retard ou relativement à une éventuelle insatisfaction du gagnant concernant son gain.
Article 5 : Publicité
En jouant, les participants autorisent la société Sandaya à communiquer leur nom d’utilisateur, sans que cela ne leur confère un droit à une rémunération, ou à un avantage quelconque.
Article 6 : Limitation de responsabilité des sociétés organisatrices
La société Sandaya se réserve le droit d'annuler, de modifier, d’écourter ou de proroger le jeu si les événements le rendent nécessaire, et leur responsabilité ne saurait être engagée de ce fait. Les informations relatives à la suppression ou à la modification éventuelles de ce jeu seront affichées comme le présent règlement sur la page du jeu.
La participation au Jeu implique la connaissance et l’acceptation des caractéristiques et des limites de l’Internet, notamment en ce qui concerne les performances techniques, les temps de réponse pour consulter, interroger ou transférer des informations, les risques d’interruption, et plus généralement, les risques inhérents à toute connexion et transmission sur Internet, l’absence de protection de certaines données contre des détournements éventuels et les risques de contamination par des éventuels virus circulant sur le réseau.
En conséquence, la Société Organisatrice ne saurait en aucune circonstance être tenue responsable, sans que cette liste soit limitative :
- du contenu des services consultés sur le Site et, de manière générale, de toutes informations et/ou données diffusées sur les services consultés sur le Site ;
- de la transmission et/ou de la réception de toute donnée et/ou information sur Internet ;
- de tout dysfonctionnement du réseau Internet empêchant le bon déroulement / fonctionnement du Jeu Concours ;
- de la défaillance de tout matériel de réception ou des lignes de communication ;
- de la perte de tout courrier papier ou électronique et, plus généralement, de perte de toute donnée ;
- des problèmes d’acheminement ;
- d’erreurs humaines ou d’origine électrique ;
- du fonctionnement de tout logiciel ;
- des conséquences de tout virus, bug informatique, anomalie, défaillance technique ;
- de tout dommage causé à l’ordinateur d’un participant ;
- de toute défaillance technique, matérielle et logicielle de quelque nature, ayant empêché ou limité la possibilité de participer au Jeu Concours ou ayant endommagé le système d’un participant.
Il est précisé que la Société Organisatrice ne peut être tenue responsable de tout dommage direct ou indirect issu d’une interruption, d’un dysfonctionnement quel qu’il soit, d’une suspension ou de la fin du Jeu Concours, et ce pour quelque raison que ce soit, ou encore de tout dommage direct ou indirect qui résulterait, d’une façon quelconque, d’une connexion au Site. Il appartient à tout Participant de prendre toutes les mesures appropriées de façon à protéger ses propres données et/ou logiciels stockés sur son équipement informatique contre toute atteinte. La connexion de toute personne au Site et la participation des Participants aux Jeux Concours se font sous leur entière responsabilité.
La responsabilité de la Société Organisatrice ne saurait être encourue, d’une façon générale, en cas de force majeure ou cas fortuit indépendant de sa volonté.
Article 7 : Vérification de l’identité des participants
Pour assurer le respect du présent règlement, la Société Organisatrice se réserve le droit de procéder à toutes vérifications de l’identité des participants et leur lieu de résidence. Toute indication d’identité ou d’adresse falsifiée, frauduleuse, fausse, mensongère, incorrecte, inexacte, entraine l’élimination de la participation.
Article 8 : Informations nominatives – Loi informatique et liberté
Pour participer à ce concours, les participants doivent fournir certaines informations les concernant. Ces informations seront sauvegardées et feront l’objet d’un traitement automatisé en conformité avec la loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés. Les participants disposent d’un droit d’accès, de modification, de rectification et de suppression des données les concernant.
Il est entendu qu’en application de la loi n° 78-17 du 6 janvier 1978 relative à l'informatique, aux fichiers et aux libertés, le candidat au jeu dispose d'un droit d'opposition, d'accès, de rectification et de retrait des données personnelles le concernant.
Article 9 : Litiges et tribunal compétent
Les participants sont soumis à la réglementation française applicable aux jeux et concours.
Toute contestation ou réclamation relative à ce jeu devra être formulée par écrit et adressée à Sandaya, 472 RUE DU RAJOL, CS 83005, 34137 MAUGUIO.
La Société Organisatrice tranchera toute question relative à l’application du présent règlement, dans le respect de la législation Française. Ces décisions seront sans appel. La loi applicable au présent règlement est la loi Française et la langue applicable est la langue française. Tout différend né à l'occasion de ce jeu-concours fera l'objet d'une tentative de règlement amiable. A défaut d'accord, le litige sera soumis aux juridictions compétentes désignées selon le Code de Procédure Civile. Aucune contestation ne sera plus recevable un mois après la clôture du jeu.
Article 10 : Dépôt légal et consultation
Le présent règlement du jeu est disponible gratuitement auprès de la société Organisatrice et à compter de la date de sa mise en place.
La participation au jeu implique l’acceptation pure et simple du présent règlement en toutes ses dispositions, ainsi que des lois et règlements applicables aux jeux- concours en vigueur en France.
Le règlement peut être modifié à tout moment sous la forme d'un avenant par les organisateurs, dans le respect des conditions énoncées, et publié par annonce en ligne sur le site. L’avenant entrera en vigueur à compter de sa mise en ligne et tout participant sera réputé l'avoir accepté du simple fait de sa participation au Jeu, à compter de la date d'entrée en vigueur de la modification. Tout Participant refusant la ou les modifications intervenues devra cesser de participer au Jeu.

ADVENT CALENDAR – SANDAYA - Entry regulations
Organising company "SANDAYA", a public limited company with share capital of €42,050,000, with its head office at 472 RUE DU RAJOL, CS 83005, 34137 MAUGUIO, France, registered with the Paris trade and companies register under no. B 524 027 455, is holding a competition, which is free of charge and which requires no purchase, via Qualifio from the 1st to the 25th of December 2024.
Article 1: Entry
Entry to this competition is open to all individuals who are members of social network Facebook and who are adults under French law on the date on which the competition starts.
This game is open to all except the salaried staff of the organizing company, all providers who have collaborated in the organization of the game, and their families (same name, same address).
Article 2: Principles and modes of entry
To participate in the competition, the candidate must:

Entry to the competition requires specific and unreserved agreement to these regulations with regard to all its stipulations. Any disputes with regard to its interpretation will be concluded by the organising company without appeal. Entrants undertake not to implement or attempt to implement any process of entry unless it complies strictly with the competition principles and with these regulations. The organising company reserves the right to reject any entrants who do not fully comply with these regulations. The organising company also reserves the right to bring legal proceedings against anyone who attempts to deceive or impair the proper operation of the competition.

Three gift cards, each with a value of €100, to be used on the Vertbaudet website (excluding marketplace items) or in stores. The gift card will be credited to the free Vertbaudet loyalty account, valid for 1 year from the date of issue, and can be used in multiple transactions.
SPARTOO GIFT CARD
A gift card worth €300, valid on the Spartoo France website for delivery within France. Issued as a voucher to be entered in the "voucher" section before payment. Valid until 31/12/2025 across the entire website, including fashion, luxury, home & décor, and promotional items (excluding partner products).
"KIMA ROLLS" PRIZE
Prize includes a towel measuring 180 cm x 110 cm and an adult poncho measuring 110 cm x 80 cm (choice of design).
"FLOATEE ANTI-DROWNING T-SHIRT” PRIZE
Prize includes a children’s anti-drowning T-shirt from the Floatee brand.
Composition: 76% Polyamide & 24% Elastane. UV-protective fabric (UPF50+) and OEKO-TEX certified (made in Lyon). This T-shirt is designed to be worn out of the water for everyday activities (by the pool, lake, river, etc.). Article 4: Selecting winners and awarding prizes
Instant win games will randomly select a winner during the day.
For games requiring a prize draw, the draw will take place the following day, or two days later if it falls on a weekend, among the players who participated in the relevant game and provided a valid email address.
The winner will be notified by email by the organising company, SANDAYA.
The winner will then contact the organising company by email to provide their personal details for the prizes delivery or to book the awarded stay, if applicable.
Prizes will be sent to the winners by post within thirty (30) days after the end of the competition.
Winners of weekend or week-long stays must complete their stay by 31 October 2025.
The following will lead to cancellation of prizes:
Return to the organising company Sandaya of the email containing information about the winner by post due to erroneous address and/or email address and/or change of address, winners foregoing prizes for any reason, and in the event of any other unforeseen circumstances.
Without prejudice to any legal proceedings, Sandaya is not obliged to provide winners with prizes if they have clearly, and by any means, managed to interfere with the result of the competition or if they have failed to comply with these regulations. In this event, the prize shall remain the property of Sandaya, which will have the right not to re-allocate or to allocate to anyone it chooses.
Prizes are strictly personal and non-transferrable, nor exchangeable for a monetary value, nor for another prize.
In the event of force majeure or of a particular occurrence, Sandaya reserves the option to replace prizes won by prizes of an equivalent type and value, without incurring its own liability in doing so.
Sandaya disclaims any liability relating to prizes awarded, including in the event of delays or if winners are dissatisfied with prizes.
Article 5: Publicity
By taking part, entrants authorise Sandaya to communicate their usernames without conferring on them the right to payment or any type of benefit.
Article 6: Limitation of liability of organising companies
Sandaya reserves the right to cancel, modify, shorten or extend the competition if events make this necessary, and will not be held liable if this occurs. Information pertaining to the cancellation or modification of this competition, should this apply, will be available, as will these regulations, at:
Entry to the competition means entrants are aware of and agree to the nature and limits of the internet, especially in terms of technical performance, response times for looking at, asking questions about and transferring information, risks with regard to outage and, more widely, risks pertaining to all internet connections and transmissions, the lack of protection of some data against any misuse and the risks of contamination by any viruses that may be circulating on the network.
As a result, the organising company will in no event be held liable for, among other things:
- the content of services viewed on the website and, more widely, for any information and/or data circulated on the services viewed on the website;
- sending and/or receiving any data and/or information on the internet;
- any malfunction of the internet that prevents the competition from running and functioning normally;
- the breakdown of any equipment for receiving or of lines of communication;
- the loss of any emails or post and, more widely, for loss of any data;
- delivery problems;
- human error or electronically-derived errors;
- the operation of any software;
- the consequences of any viruses, computer bugs, anomalies or technical breakdowns;
- any damage caused to entrants' computers;
- any technical, equipment and software breakdown of any kind that prevents or restricts the possibility of entering the competition or which may damage entrants' systems.

It is stipulated that the organising company cannot be held liable for any direct or indirect damage due to an outage, any kind of malfunction, suspension or to the end of the competition, for any reason at all, nor for any direct or indirect damage that may result, in any way, from logging on to the website. It is the responsibility of entrants to take any appropriate steps in order to protect their own data and/or software stored on their computer systems from any violations. People logging onto the website and participating in the competition are fully liable for doing so.
The organising company will not be held liable, in general terms, in the event of force majeure or unforeseen circumstances that are beyond its control.
Article 7: Checking the identities of entrants
To ensure these regulations are observed, the organising company reserves the right to conduct any checks with regard to the identities of entrants, their place of residence and their use of social network Facebook. Any indication of a false, fraudulent, dishonest, incorrect or imprecise identity will lead to elimination from entry.
Article 8: Personal data – data protection law
To enter this competition, entrants must provide certain information about themselves. This information will be saved and will be subject to automatic processing in line with French law no. 78-17 of 6th January 1978 pertaining to data protection. Entrants have the right to access, modify, rectify and remove data concerning them.

Entrants are bound by French regulations applying to games and competitions.

The organising company will decide about any questions pertaining to the application of these regulations, in line with French legislation. These decisions cannot be appealed. The law applicable to these regulations is the French law and the language applicable is French. Any disagreement during the course of this competition will be subject to an attempt at amicable settlement. If such an agreement is not forthcoming, the dispute will be put to the competent jurisdiction appointed in line with France's Code of Civil Procedure. No challenges will be permitted one month after the end of the competition.
Article 10: Legal deposit and access
These competition regulations are available free of charge from the organising company and from the date on which they were drawn up.
Entry to the competition implies full acceptance of all of the provisions of these regulations, as well as of the laws and regulations governing competitions that are currently applicable in France.
Regulations may be modified at any time by way of an amendment by organisers, in accordance with the conditions stated, and published through an online announcement on the website. The amendment will come into effect when it is put online, and all entrants will be deemed to have agreed to it by virtue of their entering the competition, from the date on which the modification comes into effect.
