PRIZE DRAW TERMS & CONDITIONS: “PROMO SEMIFINALS MAY 2023 REAL MADRID – MADRIDISTAS, MADRIDISTAS PREMIUM AND MEMBERS”
Participation in this competition implies the acceptance and compliance with the following terms and conditions:
1.- THE ORGANISING COMPANY AND PURPOSE
1.1. El Real Madrid Club de Fútbol, hereinafter: “the organiser” and/or “Real Madrid”) shall run a promotion entitled “PROMO SEMIFINALS MAY 2023 REAL MADRID – MADRIDISTAS, MADRIDISTAS PREMIUM AND MEMBERS” (hereinafter "the draw"). Real Madrid reserves the right to choose the matches each month in which this promotion will take place. Real Madrid is a sports organisation, registered in Madrid, Avda. de las Fuerzas Armadas num. 402, 28055 with Tax ID (C.I.F) G-28034718.
1.2. The purpose of the draw organised by Real Madrid is to award one (1) pack consisting of a pair of VIP tickets to attend the match between Real Madrid and Manchester City at the Santiago Bernabéu Stadium on 9 May 2023. If the winner resides outside the Madrid region, the prize will also include hotel accommodation in a double room and round-trip transportation from the winner's place of residence.
In the event that the club is unable to award the winner the aforementioned prize, Real Madrid reserves the right to award a prize of equal value. Likewise, Real Madrid reserves the right to award the prizes at a time that is most convenient to the club.
1.3. The prize draw is regulated by these specific rules, which can be accessed via the application “PROMO SEMIFINALS MAY 2023 REAL MADRID – MADRIDISTAS, MADRIDISTAS PREMIUM AND MEMBERS”. By entering the competition, any natural person automatically implies the unconditional acceptance of these rules
1.4. All of the information relating to the prize draw (terms and conditions, instructions about the way the competition works, its organisers, prizes and calendar) can be found in the advertising space design for the consultation of these terms and conditions.
2.- ENTRY REQUIREMENTS
2.1. Any individual over the age of fourteen (14) on the start date of the competition, regardless of whether they are a Madridista, Madridista Premium member or Real Madrid member who registers by completing the registration from specifically created for this prize draw and which can be accessed
through the advertisement.
In the event that the winner is a Madridista, Madridista Premium or Real Madrid Member under the age of 18, he/she must be accompanied by an adult at all times to be eligible for the prize.
2.2. To enter, participants must take the following steps:
1.- Enter the “PROMO SEMIFINALS MAY 2023 REAL MADRID – MADRIDISTAS, MADRIDISTAS PREMIUM AND MEMBERS” promotion
2.- Register or identify themselves using the Real Madrid log-in credentials
3.- Fill in the entry form specially created for the competition with the personal data requested on the form
4.- Read and accept the prize draw terms and conditions.
2.3. Real Madrid members, Madridista Premium members and Madridistas will receive correspondence about the prize draw and will be able to enter it after identifying themselves using their email or Real Madrid or Madridista Premium membership number. After validating their personal data in the entry application, Real Madrid members will be granted a triple entry into the draw, while Madridistas Premium members will be granted a double entry and Madridistas will be entitled to a single entry.
2.4. For the purposes of the competition, only the entry forms of entrants to have filled out all of the obligatory fields with accurate, full and up-to-date information will be considered as being valid. Inaccurate information or forms submitted after the set deadline will not be accepted.
2.5. Participants who do not fulfil the requirements stated in this legal basis will have no right to claim the prize.
2.6. The Directors and employees of Real Madrid C.F., or their direct family members, or the Directors or employees of intermediary companies cannot take part in the competition, be it directly or indirectly.
2.7. Entries must be made personally by the individual entering the competition, under no circumstances will entries made by third parties be accepted.
2.8. Entering the competition is free of charge.
2.9. Real Madrid may freely select content submitted by the entrants in order to share said content on their media channels (app, website, social media, etc.).
3.- SCHEDULE AND TERRITORIAL LIMITS OF THE COMPETITION
The draw is not restricted geographically and will run from 10:00 a.m. (GMT +1) Spanish mainland time on 20 April 2023 until 11:59 p.m. on 2 May 2023.
4. HOW THE COMPETITION WORKS
4.1. To participate in the competition, entrants should complete the steps set out in the promotional material created specifically for the competition with accurate, up-to-date and complete information.
4.2 A draw will be held among all those who have correctly filled in the form and completed the actions indicated therein, for one (1) pack consisting of a pair of VIP tickets to attend the match between Real Madrid and Manchester City at the Santiago Bernabéu Stadium on 9 May 2023. If the winner resides outside the Madrid region, the prize will also include hotel accommodation in a double room and round-trip transportation from the winner's place of residence.
4.3. The draw will be carried out randomly on 3 May 2023, with Real Madrid reserving the right to change the date of the draw at the club's convenience.
5. WINNERS
5.1. Upon completion of the competition period (see Section 3), and following a draw conducted on a random basis, the following winners and reserve winners will be chosen as the winners of the prize in the current competition:
〈 One (1) provisional winner.
〈 Fifteen (15) provisional runners-up.
5.2. Real Madrid C.F. will inform the winner of the result of the draw and how and when will be able to collect the prize, via email or telephone at the email address or phone number provided on the registration form. The winner will have twelve (12) hours to claim the prize.
Furthermore, Real Madrid reserves the right to publish the result of the draw in a post on its social media channels (Facebook, Twitter, Instagram, etc.)
5.3. The winner may reject the prize, but under no circumstances shall the prize be exchanged for money.
6. INTELLECTUAL PROPERTY
Entrants to the competition freely grant Real Madrid C.F. any sort of rights which they may be entitled to in relation to the content presented for the competition, and in particular the rights of reproduction, distribution, communication to the public, disclosure, and putting it at the disposition of the public, as well as the right of adaptation, including across telecommunication networks and the internet for everyone's consumption and even its entry into the public domain, with the organising committee being entitled to grant and transfer this information via any medium and licence these rights to third parties.
7.- CAVEATS AND LIMITATIONS
7.1. Under no circumstances do the pages or profiles of entrants represent Real Madrid C.F., and as such, Real Madrid C.F. is not responsible for the content published on them.
7.2 Real Madrid C.F. reserves the right to delay, cancel, change the rules, repeat or terminate the competition at any time in the event of exceptional circumstances, whilst informing of these circumstances in such a way so that they do not prove detrimental to the entrants in any way.
7.3 Non-compliance with any of the basis laid down herein shall give the organiser of the competition full discretion to disqualify the entrant at any time; likewise, the organiser reserves the exclusive right to reject the right for entrants to take part if they consider that the conditions established here have been infringed upon.
7.4 In the event that the organiser has reasonable suspicions that an entrant has committed fraud, manipulation, has been dishonest or does not meet the entry requirements, they shall refuse to award the prize which has been won or disqualify the entrant.
7.5 In the event of an error, a misunderstanding or conflict in relation to the way any element of the competition works, or with the behaviour of an entrant, the decision made by the organiser in this regard will be definitive and final.
7.6 The organiser reserves the right to take the necessary decisions to ensure that the competition runs smoothly, with these being expressly accepted by all entrants.
7.7 In no way shall the organiser by responsible for the non-compliance or any type of infraction relating to this competition and shall not be held liable in the event of losses suffered by entrants caused by the prizes or any other aspects of the competition.
7.8 Likewise, the organiser shall not be held liable for damages suffered by an entrant arising from their enjoyment of the prize.
7.9 The entrant exempts the organiser of all liability and shall indemnify them against any claims as a result of the damages which may arise from activities carried out with the awarded prize.
8.- OTHER CAVEATS
8.1. The organiser reserves the right to use the names, surnames and the images of the entrants, to reproduce them and use them in any advertising and promotional activities related to the competition or other Club activities without this usage involving any right to payment or any type of benefits.
8.2 The organiser may use the names, surnames and images of the entrants on its web site and in other media as it sees fit.
9.- LIABILITY WAIVER
Real Madrid is exempt from any liability for damages of any nature that the winner of the prize draw may suffer as a result of any action or inaction not attributable to Real Madrid while using the prize and subject to the restrictions established in the regulations applicable. Those who take part in the prize draw exonerate Real Madrid from any type of liability, penalty, claim, lawsuit or civil, commercial, criminal, administrative or any other type of proceedings, including compensation of any kind and any other type of expenses in which Real Madrid could be involved as a result of and on the occasion of this prize draw.
As a result, Real Madrid is exempt from any type of liability from the moment the prize is transferred to the winner. The winner will not be entitled to take any type of legal action against Real Madrid for any cause whatsoever deriving from the prize received.
10.- PERSONAL DATA
Real Madrid will process participants’ data for:
¥ The management of the draw/competition and their participation in it, including personal communication, by any means, with the winners.
¥ Informing of the result of the draw and the winners of the same through the Club's media.
¥ To exercise the intellectual property rights transfered to the Club in accordance with clause six of these Legal Bases, regarding the audiovisual content containing the image or voice of the participants and/or third parties.
¥ Control and security, legal advice and compliance with regulations.
¥ Statistical and profiling uses
¥ Having obtained your consent for each case, to transfer your data to sponsors or collaborators.
In accordance with the stipulations of data protection regulations and the Organic Law 1/1982 on the right to honour, personal and family privacy and personal image, in the event that the participant sends content which contain his/her image and/or voice, the very act of sending said content in order to participate in the draw/competition, implies the participant’s express consent to Real Madrid using such images and/or voice in accordance with the provisions of these Legal Bases and their Annex I on additional information related to the processing of personal data.
The participant confirms that the personal data provided for participation in the draw/ competition will be true and up to date, and declares that, if third parties should appear in the content used for the participation in this draw/competition, their consent has been obtained to include their personal data (name, image, voice, etc.) in said content in accordance with the purposes provided for in these Legal Bases. Real Madrid reserve the right to take any appropriate action or make any claim in the event that the participant fails to comply with the above.

REAL MADRID C.F. operates with complete transparency as regards the processing of your personal data in order for you to clearly understand:

Who is responsible for the use of your data?
The data controller is REAL MADRID C.F. (also REAL MADRID or "el Club"), with registered address at Avenida de Concha Espina, nº 1, Madrid, Spain, 28036, NIF number G-28034718 and telephone +34 91 398 43 00.
The Club will process your data in complete compliance with the current regulations on data protection, and they will not be subject to exclusively automated or profiled decision-making that could significantly affect them or be used for any subsequent purposes besides those reflected in this document.
What exactly do we process your data for and on what basis?
a. In order to manage the draw/competition and your participation in it, including personal communication, by any means, in the event you are chosen as the winner, given it is necessary to fulfil the contractual obligations arising from your participation in the draw (Legal Basis of the Draw/Competition).
b. In order to inform the general public and the rest of the participants in particular, of the result of the draw and the winners of the same through the Club's media (website, magazines, social networks and other possible media available to the Club at any time). We are entitled to do this insofar as it is necessary to comply with the contractual obligations (Legal Basis of the draw/competition), as well as on the basis of the Club’s legitimate interest in ensuring transparency in these processes.
c. For statistical and profiling purposes, on the basis on legitimate interest we have in identifying the interests of our fans and how to improve our commercial lines.
d. In the event that the participation requires audiovisual content in any format which contains the image or voice of the participants and/or third parties, in accordance with the stiupulations of clauses six and nine of these Legal Bases, for its reproduction, distribution, public communication, discloosure and transformation and making it available to the public, including over telecommunication and internet networks, for everyone and even including its passing to the public domain, and as such, its release, transfer and licensing to third party by any means.
e. In addition and only if it is the case, we will also process your data for control and security purposes, legal advice and compliance with regulations, as it is necessary to satisfy the public interest, as well as our legitimate interest in defending our interests and rights, in avoiding conduct contrary to the codes and internal regulations of the Club and to comply with legal obligations that are applicable to us (audit, compliance with criminal law, protection of personal data,...).
f. Only where you have provided your consent for each case, to share your data with our sponsors or collaborators.
How have we obtained your data?
The personal data is provided by the participant themselves upon entering the draw or by their legal representative, parent or legal guardian.
In very exceptional circumstances, we may receive other information from you through other sources, such as our complaints channel, witnesses or competent authorities. But in no case will we keep information that we do not absolutely require.
What categories of information about you do we handle?
The types of data we hold with regards to you are identification, contact, and demographic or personal characteristics (such as gender, age, nationality and language). For cases of entries mad via social networks, we also receive data related to your interests contained on said social network, if you have given your consent as such. Very rarely, we may also process other information that is relevant to a possible incident, investigation or complaint.
How long will we keep your data?
In the context of the draw/competition, we will keep your data until the conclusion of the draw/competition and subsequently, duly blocked, for the legal period provided for at any given time for any potential defence or lodging of complaints, in which case they will be kept until the corresponding inspection, procedure or complaint is definitively closed.
In relation to the statistical or profiled use of your data, in general terms this will be carried out provided you don’t request the deletion of your data or object to their processing, for reasons related to your personal situation, provided this does not go against the best interests of the club.
Regarding the sending of commercial communication, in general terms we keep your data for as long as you do not object to said use of this data or unsubscribe from this kind of communication, and subsquently, duely blocked, for the legally envisaged period for any defence or lodging of potential complaints.
Who do we share your data with?
For the purposes listed above, we may share your personal data with the following entities and/or individuals:
〈 Public Notary appointed to attest to the result of the draw/competition and its winner.
〈 Publication in the Club's official media of the result of the draw.
〈 Public Administrations, other Public Bodies and entities authorized by law, when required or necessary.
〈 Exceptionally with Courts and Tribunals or other bodies for the resolution of conflicts, such as Arbitration and Mediation Courts, State Security Forces and Corps and Notaries and Registrars.
〈 With our collaborators and sponsors in accordance with Clause Six of the Terms and Conditions of this Competition/Prize Draw.
〈 With our collaborators and sponsors, for other purposes, where you have provided your consent.
Furthermore, our following providers have access to some of your personal data in order to provide us with the contracted services, but we ensure they manage them with the same care that we do, that they apply the highest protection guarantees and that they can only use them for what is strictly necessary in relation to the purposes detailed above:

Is your data shared outside Europe?
In relation to the indicated purposes, in most cases your data will not be shared outside Europe nor will they be accessed from outside said territory, except in the case of our provider Microsoft Ireland Operations Limited, who may transfer your data to servers in the United States. These Transfers are governed by the Standard Contractual Clauses approved by the European Commission, which, following the appropriate assessments, have been deemed to provide an appropriate level of protection of your rights in the destination country.
In very exceptional circumstances we may need to transfer your personal data to:
〈 Courts, Tribunals, Arbitration Courts and Mediators outside the EEA, the transfer being covered as necessary for the formulation, exercise or defence of claims, as the case may be.
What are your rights in relation to the processing of your data and how can you exercise them?
You have the right to obtain information about the processing of your data, to access it, to have it rectified or, where appropriate, erased. Under certain circumstances, you also have the right to limit the processing of your data, in which case we will only keep them for the exercise or defence of claims, as well as to object to their processing and to their portability, either to you or directly to another company designated by you.
Revocation of consent: In relation to the processing of your data that we carry out on the basis of the consent that you have given us for this purpose, you have the right to withdraw this consent at any time, although the revocation will not produce any retroactive effects, and as such will not affect the processing that has been carried out up to that point.
