2. Terms and Conditions

MSI will announce the winners, to be randomly drawn from the pool of eligible
participants, on the Event giveaway page by September 30th, 2026. MSI may reach out
to You to confirm Your registered address: incomplete or incorrect delivery address may
be grounds to disqualify the winner. The winner must respond to MSI’s email within seven
(7) calendar days; the winner who does not respond within this time may be deemed to
have forfeited the prize, and a new winner will be selected by MSI. MSI shall have sole
discretion in determining such matters.
3. Common Event Terms and Conditions
(1) You must be 18 years or older and are a legal resident in an eligible
Territory (see eligible Territory list below).
(2) Eligible Territory: Open to legal residents worldwide excluding Turkey, Italy,
Thailand, People's Republic of China, Crimea Region of Ukraine, Belarus, Russia,
Cuba, Iran, North Korea, Sudan, Syria, Venezuela, and restricted, sanctioned or
embargoed countries or regions. The potential prize winner of this Event shall
be required to show proof of residency.
(3) Each participant is limited to one (1) submission. Any attempt by a
participant to obtain more than the stated number of entries by using
multiple/different email addresses, identities, registrations, logins or any other
methods, including, but not limited to, commercial contest/event subscription
notification and/or entering services, will void that participant's entries and that
participant may be disqualified.
(4) NO PURCHASE IS NECESSARY TO ENTER THE LUCKY DRAW. For all
participants, this Event is free to enter for a chance to win the draw prize by
writing a request to MSI and mailing this request to MSI’s Taiwan office, MicroStar Int’l Co., Ltd., located at No.69 Lide Street, Zhonghe Dist., Postal Code
23584, New Taipei City, Taiwan. Participant’s written request must be legible to
be accepted, and must include participant’s full name, a valid mailing address
(NO P.O. BOX), phone number and any email address to allow MSI to verify the
participant, and the name of the Event. Only one entry will be permitted per
participant. MSI will also use the contact information provided in the entry to
contact the participant, as appropriate.
(5) This Event is only for eligible end user consumers and not businesses. MSI,
MSI affiliates, subsidiary, manufacturer, business partner, distributor, wholesaler,
reseller, retailer, or agency employees and their immediate families are not
eligible to participate in this Event.
(6) Automated or robotic entries submitted by individuals or organizations will
be disqualified. Entry must be made by the participant. Any attempt by a
participant to obtain more than the stated number of entries by using
multiple/different email addresses, identities, registrations, logins or any other
methods will void that participant's entry and may result in immediate
disqualification. Final eligibility for the award of any prize is subject to eligibility
verification as set forth below. All entries must be posted by the end of the
Event period in order to participate. MSI's database clock will be the official
time keeper for this Event.
4. Privacy Policy.
We may ask You for information during the Event enrolment and product
registration process that may, as applicable, include without limitation Your
email, name, product serial number, redemption code, purchase information,
and other voluntary information You provide. In addition, we may indirectly
gather information from you via cookies or website embedded analytics. The
information we collect will be used in the following manner: to run this Event, to
verify Your eligibility, to contact You if needed, to ensure prize(s) can be sent to
You, to store registered product data for as long as an ongoing relationship
exists between us (eg. When You use our services such as warranty, eDM
notices, etc.), and to use solely for internal market studies for developing better
products and services. Your information will not be shared with third parties,
except: i) to third party processors such as our internet service and website
providers in order for us to execute this Event; and ii) when reporting or
responding to actual or suspected breach of applicable laws to legal and
regulatory authorities such as courts or the police to the extent needed.
Because of the international nature of our business, we transfer information
within the MSI group, and to third parties as referenced above, in connection
with the purpose set forth in these terms and conditions. Therefore, we may
transfer information to countries that may have different laws and data
protection compliance requirements that those applicable in the country You
are located.
Further details of how Your information may be used and processed are detailed
in MSI’s privacy policy, available at https://www.msi.com/page/privacypolicy.The MSI Privacy Policy constitutes a part of this Terms and Conditions, and
is hereby incorporated by reference with full force and effect.
5. eDM Subscription.
You may be asked to join MSI’s eDM emailing list to receive MSI product news
or service updates. If you do not want to subscribe to this list, please do not
check the subscribe or similarly titled check box.
6. Participant License.
By making or agreeing to a submission, you acknowledge and agree to the
following:
(1) You hereby grant MSI a non-exclusive, royalty-free, worldwide, perpetual,
irrevocable, and fully sublicensable right to use, reproduce, modify, adapt,
publish, sell, assign, translate, create derivative works from, distribute and
display any submission you upload to MSI or pursuant to the Terms and
Conditions (“Submission”) in whole or in part, in any form, media, or
technology, whether now known or hereafter developed in connection with the
marketing, advertising and promotional activities referred to above.
(2) you own or otherwise control the rights to your Submission and any and all
elements thereof.
(3) you represent and warrant that the Submission does not infringe or violate
the rights of any third parties, including, but not limited to, intellectual property
rights, copyrights, trademarks, rights of publicity/privacy, patent, trade secret or
confidentiality obligations.
7. Participant Representation and Warranties.
You hereby represent and warrant that:
(1) all information provided by you to MSI is true, accurate and not
misleading;
(2) you have the full right to enter into this agreement with MSI and
make the license grants and representations and warranties relating to the
Submission;
(3) you are the full and legal owner of all rights (including, without
limitation, any and all intellectual property rights) in and to the Submission;
(4) you have obtained all required clearances and paid all monies
necessary in order for MSI to be able to exercise the rights granted by you
herein and you confirm and warrant that MSI will not be required to obtain any
other or separate rights, clearances or license, nor shall MSI be required to
make any additional payments to any parties in order to exercise the rights
granted by you herein;
(5) all individuals featured in the Submission have provided full
consent to their inclusion in the Submission and you have obtained all required
consents, permissions and image/appearance releases from any individuals,
groups, parties or locations, so that you are able to grant the rights granted
herein, including (but not limited to) our right to use, exhibit, distribute, exploit,
reproduce and/or edit (without limitation or restriction) the Submission;
(6) You have the full authority, capacity, power, and right to enroll in
this Event, and make the required license grant, representation, and warranties
under this Terms and Conditions; and
(7) You have complied with all applicable laws in enrolling in this Event.
8. Participant Indemnification.
You shall defend, indemnify, and hold harmless MSI, its affiliates, and
successors, assigns, directors, and agents, from and against any and all liabilities,
damages, judgments, costs, expenses, and fees (including reasonable attorney’s
fees) resulting from any claims, investigations, litigation, or other legal or
administrative action by third parties arising out of or relating to any actual or
alleged breach by You of any representations, warranties, undertakings in this
Terms and Conditions.
9. Participant Acknowledgement and Consent.
You hereby acknowledge and agree that:
(1) MSI reserves the sole and discretionary right:
a) to determine, on a final and conclusive basis, whether a participant has
fulfilled the Event requirements in good faith. For illustrative purpose without
limiting any other terms, MSI may disqualify participants: a) if Event enrolment
or product registration is incomplete, b) if Event eligibility requirements such as
timely enrollment, applicable product line or regional restrictions are not met;
c) if the provided documents are altered, forged, fraudulent, misdelivered, or
void; d) if automated codes, scripts, plugins or other means were used to enter
or complete Event enrolment; e) if participant does not have the legal capacity
to enroll in this Event, or f) if criminal or illegal acts are committed or allegedly
committed to enroll in this Event;
b) to replace the prize with items of similar value without prior notice;
c) to vary, delete or add to any of these terms and conditions if there is valid
reason understood as:
− amendment of the laws governing the rules and organization of the Event,
affecting the rights and obligations of MSI and participants
− extension or reduction of the duration of the Event
− change in the way the Event is carried out due to technical, technological
or commercial reasons
in case of any such change the revised terms and conditions will be published by
MSI at the Event landing page. For the avoidance of doubt, as applicable,
changes to the terms and conditions do not affect orders placed or offers
implemented under the terms and conditions applicable prior to the change.
(2) MSI is not liable and assumes no liability to any person for any loss,
dissatisfaction, or damage arising from the prize, and uses thereof. Winners
shall not make any claims against MSI;
(3) MSI disclaims all liability for any delays, misdelivery, loss, or failure in the
delivery of the winning notification or any prizes due to logistic, mechanical,
technical, electronic, communications, telephone, computer, hardware,
internet, or software errors, malfunctions, or failures of any kind. In such
eventuality, the winner unconditionally waives his/her right to the prize and any
associated compensation.
10. MSI Warranties Exclusion.
MSI PRIZE(S) IS/ARE PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED
WARRANTY OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY,
NONINFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE.
11. Limitation of Liability.
TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAWS, MSI SHALL NOT BE
LIABLE TO YOU ON ACCOUNT OF ANY CLAIM (REGARDLESS OF THEORY OF
LIABILITY WHETHER BASED UPON PRINCIPLES OF CONTRACT, WARRANTY,
NEGLIGENCE OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, OR
OTHERWISE) FOR ANY SPECIAL, CONSEQUENTIAL, RELIANCE, INDIRECT,
INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES, WHETHER FORESEEABLE OR
NOT, INCLUDING BUT NOT LIMITED TO LOST PROFITS, REVENUE, GOODWILL OR
COST OF REPLACEMENT.
12. Miscellaneous.
This Terms and Conditions is governed and construed by the laws of Taiwan,
regardless of conflict of law principles, and all disputes arising from the Event and
these terms shall be adjudicated by the Taipei District Court in Taipei, Taiwan. Any
provision invalidated by a competent court shall be stricken, and the remaining
Terms and Conditions will remain in full force and effect. Failure by MSI to
enforce any right under this Terms and Condition shall not be deemed to be a
waiver. MSI shall not be liable for any failure to perform due to circumstances
beyond its reasonable control. This Terms and Conditions shall not be assigned or
otherwise transferred by You to any other third party; all unauthorized
assignments are null and void. This Terms and Conditions constitute the entire
agreement between the parties with respect to the Event, and supersede any
prior agreements, communications, representations, or discussions, oral or
otherwise.

MSI wird die Gewinner, die per Zufallsziehung aus dem Pool der berechtigten
Teilnehmer ermittelt werden, bis zum 30. September 2026 auf der
Gewinnspielseite der Veranstaltung bekanntgeben. MSI kann sich an Sie
wenden, um Ihre angegebene Lieferadresse zu bestätigen: Eine unvollständige
oder fehlerhafte Lieferadresse kann zum Ausschluss des Gewinners führen. Der
Gewinner muss innerhalb von sieben (7) Kalendertagen auf die E-Mail von MSI

(5) Diese Veranstaltung richtet sich ausschließlich an berechtigte

6. Nutzungslizenz des Teilnehmers
Durch das Einreichen eines Beitrags oder die Zustimmung dazu erkennen Sie
Folgendes an und stimmen dem zu:
(1) Sie gewähren MSI hiermit ein nicht-exklusives, lizenzgebührenfreies,
weltweites, unbefristetes, unwiderrufliches und vollständig unterlizenzierbares
Recht, jeden von Ihnen bei MSI eingereichten oder gemäß diesen
Teilnahmebedingungen übermittelten Beitrag („Einsendung"") ganz oder
teilweise in jeder Form, jedem Medium oder jeder Technologie – ob derzeit
bekannt oder zukünftig entwickelt – zu nutzen, zu vervielfältigen, zu
modifizieren, anzupassen, zu veröffentlichen, zu verkaufen, abzutreten, zu
übersetzen, abgeleitete Werke zu erstellen, zu verbreiten und anzuzeigen, und
zwar im Zusammenhang mit den oben genannten Marketing-, Werbe- und
Promotionsaktivitäten.
(2) Sie sind Inhaber der Rechte an Ihrer Einsendung und allen darin enthaltenen
Elementen oder verfügen anderweitig über die entsprechenden Rechte.
(3) Sie versichern und gewährleisten, dass die Einsendung keine Rechte Dritter
verletzt oder beeinträchtigt, einschließlich, aber nicht beschränkt auf geistige
Eigentumsrechte, Urheberrechte, Markenrechte, Persönlichkeits- und
Datenschutzrechte, Patentrechte, Geschäftsgeheimnisse oder
Vertraulichkeitspflichten.
7. Zusicherungen und Gewährleistungen des Teilnehmers
Sie versichern und gewährleisten hiermit, dass:
(1) alle von Ihnen an MSI übermittelten Informationen wahrheitsgemäß, korrekt
und nicht irreführend sind;
(2) Sie das uneingeschränkte Recht haben, diese Vereinbarung mit MSI
einzugehen sowie die Lizenzgewährungen, Zusicherungen und
Gewährleistungen in Bezug auf die Einsendung vorzunehmen;
(3) Sie der vollständige und rechtmäßige Inhaber aller Rechte (einschließlich,
ohne Einschränkung, sämtlicher geistiger Eigentumsrechte) an der Einsendung
sind;
(4) Sie alle erforderlichen Genehmigungen eingeholt und alle notwendigen
Zahlungen geleistet haben, damit MSI die von Ihnen gewährten Rechte ausüben
kann, und Sie bestätigen und gewährleisten, dass MSI keine weiteren oder
gesonderten Rechte, Genehmigungen oder Lizenzen einholen muss und keine
zusätzlichen Zahlungen an Dritte leisten muss, um die von Ihnen gewährten
Rechte auszuüben;
(5) alle in der Einsendung abgebildeten Personen ihre ausdrückliche
Zustimmung zur Aufnahme in die Einsendung erteilt haben und Sie alle
erforderlichen Einwilligungen, Genehmigungen und Bildrechte von betroffenen
Personen, Gruppen, Parteien oder für verwendete Orte eingeholt haben, sodass
Sie die hierin gewährten Rechte einräumen können – einschließlich, aber nicht
beschränkt auf das Recht zur uneingeschränkten Nutzung, Vorführung,
Verbreitung, Verwertung, Vervielfältigung und/oder Bearbeitung der
Einsendung;
(6) Sie die volle Befugnis, Handlungsfähigkeit, Vollmacht und das Recht haben,
an dieser Veranstaltung teilzunehmen sowie die erforderliche Lizenzgewährung,
Zusicherungen und Gewährleistungen gemäß diesen Teilnahmebedingungen
vorzunehmen; und
(7) Sie bei der Teilnahme an dieser Veranstaltung alle anwendbaren Gesetze
eingehalten haben.
8. Haftungsfreistellung durch den Teilnehmer
Sie verpflichten sich, MSI, seine verbundenen Unternehmen, Rechtsnachfolger,
Abtretungsempfänger, Direktoren und Beauftragten von allen Verbindlichkeiten,
Schäden, Urteilen, Kosten, Ausgaben und Gebühren (einschließlich
angemessener Anwaltskosten) freizustellen und schadlos zu halten, die aus
Ansprüchen, Untersuchungen, Rechtsstreitigkeiten oder sonstigen rechtlichen
oder behördlichen Maßnahmen Dritter entstehen, die auf einer tatsächlichen
oder behaupteten Verletzung Ihrer Zusicherungen, Gewährleistungen oder
Verpflichtungen aus diesen Teilnahmebedingungen beruhen.
9. Anerkennung und Einwilligung des Teilnehmers
Sie erkennen hiermit an und stimmen zu, dass:
(1) MSI das alleinige und freie Ermessen vorbehält:
a) endgültig und verbindlich zu entscheiden, ob ein Teilnehmer die
Veranstaltungsanforderungen in gutem Glauben erfüllt hat. Zur
Veranschaulichung, ohne andere Bedingungen einzuschränken, kann MSI
Teilnehmer disqualifizieren: a) wenn die Veranstaltungsanmeldung oder
Produktregistrierung unvollständig ist; b) wenn Teilnahmevoraussetzungen wie
fristgerechte Anmeldung, zutreffende Produktlinie oder regionale
Beschränkungen nicht erfüllt sind; c) wenn eingereichte Dokumente verändert,
gefälscht, betrügerisch, falsch zugestellt oder ungültig sind; d) wenn
automatisierte Codes, Skripte, Plugins oder andere Mittel zur Anmeldung oder
zum Abschluss der Veranstaltungsregistrierung verwendet wurden; e) wenn der
Teilnehmer nicht die Rechtsfähigkeit besitzt, an dieser Veranstaltung
teilzunehmen; oder f) wenn zur Teilnahme an dieser Veranstaltung strafbare
oder illegale Handlungen begangen wurden oder begangen worden sein sollen;
b) den Preis ohne vorherige Ankündigung durch einen Artikel von ähnlichem
Wert zu ersetzen;
c) diese Teilnahmebedingungen aus triftigem Grund zu ändern, zu ergänzen
oder zu streichen, wobei als triftiger Grund gilt:
– Änderung der für die Veranstaltung geltenden Gesetze, die die Rechte und
Pflichten von MSI und den Teilnehmern berühren
– Verlängerung oder Verkürzung des Veranstaltungszeitraums
– Änderung der Durchführungsweise der Veranstaltung aus technischen,
technologischen oder wirtschaftlichen Gründen
Im Falle einer solchen Änderung werden die aktualisierten
Teilnahmebedingungen von MSI auf der Veranstaltungs-Landingpage
veröffentlicht. Zur Klarstellung: Änderungen der Teilnahmebedingungen
berühren nicht die unter den zuvor geltenden Bedingungen aufgegebenen
Bestellungen oder umgesetzten Angebote."
(2) MSI haftet nicht und übernimmt keinerlei Haftung gegenüber Personen für
Verluste, Unzufriedenheit oder Schäden, die im Zusammenhang mit dem Preis
oder dessen Verwendung entstehen. Gewinner sind nicht berechtigt, Ansprüche
gegen MSI geltend zu machen.
(3) MSI übernimmt keine Haftung für Verzögerungen, Fehlzustellungen, Verluste
oder Ausfälle bei der Zustellung der Gewinnbenachrichtigung oder von Preisen,
die auf logistische, mechanische, technische, elektronische, kommunikations-,
telefon-, computer-, hardware-, internet- oder softwarebezogene Fehler,
Störungen oder Ausfälle jeglicher Art zurückzuführen sind. In einem solchen Fall
verzichtet der Gewinner bedingungslos auf seinen Anspruch auf den Preis sowie
auf jegliche damit verbundene Entschädigung.

11. Haftungsbeschränkung

INDIREKTE, ZUFÄLLIGE, STRAFENDE ODER EXEMPLARISCHE SCHÄDEN – OB
VORHERSEHBAR ODER NICHT –, EINSCHLIESSLICH, ABER NICHT BESCHRÄNKT
AUF ENTGANGENE GEWINNE, UMSÄTZE, GESCHÄFTSWERT ODER
WIEDERBESCHAFFUNGSKOSTEN, UNABHÄNGIG VON DER
ANSPRUCHSGRUNDLAGE (OB AUF VERTRAG, GEWÄHRLEISTUNG,
FAHRLÄSSIGKEIT ODER SONSTIGER UNERLAUBTER HANDLUNG, VERLETZUNG
GESETZLICHER PFLICHTEN ODER ANDERWEITIG BERUHEND).
12. Sonstige Bestimmungen
Diese Teilnahmebedingungen unterliegen dem Recht Taiwans und sind
entsprechend auszulegen, unabhängig von Kollisionsnormen. Alle aus der
Veranstaltung und diesen Bedingungen entstehenden Streitigkeiten werden vor
dem Bezirksgericht Taipeh in Taipeh, Taiwan, ausgetragen. Sollte ein zuständiges
Gericht eine Bestimmung für ungültig erklären, wird diese gestrichen; die übrigen
Teilnahmebedingungen bleiben davon unberührt und behalten ihre volle
Gültigkeit. Das Versäumnis von MSI, ein Recht aus diesen Teilnahmebedingungen
durchzusetzen, gilt nicht als Verzicht auf dieses Recht. MSI haftet nicht für die
Nichterfüllung von Verpflichtungen, die auf Umstände zurückzuführen ist, die
außerhalb seines zumutbaren Einflussbereichs liegen. Diese
Teilnahmebedingungen dürfen von Ihnen nicht an Dritte abgetreten oder
anderweitig übertragen werden; alle nicht autorisierten Abtretungen sind nichtig
und unwirksam. Diese Teilnahmebedingungen stellen die vollständige
Vereinbarung zwischen den Parteien in Bezug auf die Veranstaltung dar und
ersetzen alle vorherigen Vereinbarungen, Mitteilungen, Zusicherungen oder
Absprachen, ob mündlich oder schriftlich.

envío registrada: una dirección de entrega incompleta o incorrecta podrá ser
motivo de descalificación del ganador. El ganador deberá responder al correo
electrónico de MSI en un plazo de siete (7) días naturales; si no responde dentro

3. Términos y Condiciones Generales del Evento

6. Licencia del Participante.

7. Declaraciones y Garantías del Participante.
Por la presente, declaras y garantizas que:

engañosa;
(2) tienes pleno derecho para celebrar este acuerdo con MSI y para otorgar las
licencias, declaraciones y garantías relacionadas con la Participación;
(3) eres el propietario legal y pleno de todos los derechos (incluyendo, sin
limitación, todos los derechos de propiedad intelectual) sobre la Participación;
(4) has obtenido todas las autorizaciones necesarias y realizado todos los pagos

8. Indemnización del Participante.
Defenderás, indemnizarás y mantendrás indemne a MSI, sus filiales, sucesores,
cesionarios, directores y agentes frente a cualquier responsabilidad, daño,
sentencia, costo, gasto y honorario (incluidos los honorarios razonables de
abogados) derivados de cualquier reclamación, investigación, litigio u otra
acción legal o administrativa por parte de terceros que surja de o esté
relacionada con cualquier incumplimiento real o presunto por tu parte de las
declaraciones, garantías o compromisos establecidos en estos Términos y
Condiciones.
9. Reconocimiento y Consentimiento del Participante.
Por la presente, reconoces y aceptas que:
(1) MSI se reserva el derecho exclusivo y discrecional de:
a) determinar, de forma definitiva y concluyente, si un participante ha cumplido
los requisitos del Evento de buena fe. A modo ilustrativo y sin limitar ningún
otro término, MSI podrá descalificar a los participantes: a) si la inscripción al
Evento o el registro del producto están incompletos; b) si no se cumplen los
requisitos de elegibilidad del Evento, como la inscripción en el plazo establecido,
la línea de productos aplicable o las restricciones regionales; c) si los
documentos proporcionados han sido alterados, falsificados, son fraudulentos,
han sido entregados incorrectamente o son nulos; d) si se utilizaron códigos
automatizados, scripts, plugins u otros medios para realizar o completar la
inscripción al Evento; e) si el participante no tiene capacidad legal para
inscribirse en este Evento; o f) si se cometieron o presuntamente se cometieron
actos delictivos o ilegales para inscribirse en este Evento;
b) sustituir el premio por artículos de valor similar sin previo aviso;
c) modificar, eliminar o añadir cualquiera de estos términos y condiciones
cuando exista una razón válida, entendida como:
− modificación de las leyes que rigen las normas y la organización del Evento,
que afecten los derechos y obligaciones de MSI y los participantes
− ampliación o reducción de la duración del Evento
− cambio en la forma en que se lleva a cabo el Evento por razones técnicas,
tecnológicas o comerciales
En caso de cualquier modificación de este tipo, los términos y condiciones
revisados serán publicados por MSI en la página de inicio del Evento. Para mayor
claridad, los cambios en los términos y condiciones no afectarán los pedidos
realizados ni las ofertas implementadas bajo los términos y condiciones vigentes
antes del cambio.
(2) MSI no es responsable ni asume ninguna responsabilidad ante ninguna
persona por cualquier pérdida, insatisfacción o daño derivado del premio y su
uso. Los ganadores no podrán realizar ninguna reclamación contra MSI.
(3) MSI declina toda responsabilidad por cualquier retraso, entrega incorrecta,
pérdida o fallo en la entrega de la notificación de premio o de cualquier premio

11. Limitación de Responsabilidad.
EN LA MÁXIMA MEDIDA PERMITIDA POR LAS LEYES APLICABLES, MSI NO SERÁ
RESPONSABLE ANTE TI POR NINGUNA RECLAMACIÓN (INDEPENDIENTEMENTE
DE LA TEORÍA DE RESPONSABILIDAD, YA SEA BASADA EN PRINCIPIOS DE
CONTRATO, GARANTÍA, NEGLIGENCIA U OTRO AGRAVIO, INCUMPLIMIENTO DE
CUALQUIER OBLIGACIÓN LEGAL O DE OTRO TIPO) POR DAÑOS ESPECIALES,
CONSECUENTES, POR CONFIANZA, INDIRECTOS, INCIDENTALES, PUNITIVOS O
EJEMPLARES, SEAN PREVISIBLES O NO, INCLUYENDO, ENTRE OTROS, PÉRDIDA
DE BENEFICIOS, INGRESOS, FONDO DE COMERCIO O COSTOS DE REEMPLAZO.
12. Disposiciones Generales.
Estos Términos y Condiciones se rigen e interpretan conforme a las leyes de
Taiwán, independientemente de los principios de conflicto de leyes, y todas las
disputas derivadas del Evento y de estos términos serán resueltas por el Tribunal
de Distrito de Taipéi, en Taipéi, Taiwán. Cualquier disposición declarada inválida

MSI annoncera les gagnants tirés au sort parmi les participants éligibles sur la
page du concours au plus tard le 30 septembre 2026. MSI pourra vous contacter
afin de confirmer votre adresse de livraison enregistrée. Une adresse
incomplète ou incorrecte pourra entraîner la disqualification du gagnant. Le
gagnant devra répondre à l'e-mail de MSI dans un délai de sept (7) jours
calendaires. Si un gagnant ne répond pas dans ce délai, il sera considéré comme

6. Licence accordée par le participant
En soumettant une participation ou en acceptant de le faire, vous reconnaissez
et acceptez ce qui suit :
(1) Vous accordez par la présente à MSI un droit non exclusif, libre de
redevances, mondial, perpétuel, irrévocable et entièrement sous-licenciable
d'utiliser, reproduire, modifier, adapter, publier, vendre, céder, traduire, créer
des œuvres dérivées, distribuer et afficher toute participation que vous
soumettez à MSI ou conformément aux présentes conditions générales («
Participation »), en tout ou en partie, sous quelque forme, support ou
technologie que ce soit, connus actuellement ou développés ultérieurement,
dans le cadre des activités de marketing, de publicité et de promotion
mentionnées ci-dessus.
(2) Vous êtes propriétaire ou détenez autrement les droits sur votre
Participation et sur l'ensemble de ses éléments.
(3) Vous déclarez et garantissez que la Participation ne porte pas atteinte aux
droits de tiers et ne les viole pas, y compris, sans s'y limiter, les droits de
propriété intellectuelle, les droits d'auteur, les marques commerciales, les droits
à la vie privée et à l'image, les brevets, les secrets commerciaux ou les
obligations de confidentialité.
7. Déclarations et garanties du participant
Vous déclarez et garantissez par la présente que :
(1) Les informations que Vous avez fournies sont exactes et véridiques ;
(2) Vous disposez du plein droit de conclure cet accord avec MSI et d'accorder
les licences, déclarations et garanties relatives à la Participation ;
(3) Vous êtes le propriétaire légitime et exclusif de tous les droits (y compris,
sans s'y limiter, l'ensemble des droits de propriété intellectuelle) relatifs à la
Participation ;
(4) Vous avez obtenu toutes les autorisations requises et versé tous les
montants nécessaires pour permettre à MSI d'exercer les droits que vous lui
accordez aux présentes, et vous confirmez et garantissez que MSI ne sera pas
tenue d'obtenir d'autres droits, autorisations ou licences distincts, ni d'effectuer
des paiements supplémentaires à quelque partie que ce soit pour exercer
lesdits droits ;
(5) toutes les personnes figurant dans la Participation ont donné leur
consentement explicite à leur inclusion dans celle-ci, et Vous avez obtenu tous
les consentements, autorisations et droits à l'image/apparence requis auprès de
toute personne, groupe, partie ou lieu concerné, Vous permettant ainsi
d'accorder les droits stipulés aux présentes, y compris (sans s'y limiter) notre
droit d'utiliser, d'exposer, de distribuer, d'exploiter, de reproduire et/ou de
modifier (sans limitation ni restriction) la Participation ;
(6) Vous disposez de la pleine autorité, capacité, pouvoir et droit de Vous
inscrire à cet événement et d'accorder la licence requise, ainsi que de formuler
les déclarations et garanties prévues par les présentes conditions générales ; et
(7) Vous avez respecté toutes les lois applicables lors de Votre inscription à cet
événement.
8. Indemnisation par le participant
Vous vous engagez à défendre, indemniser et dégager de toute responsabilité
MSI, ses filiales, successeurs, ayants droit, administrateurs et agents, contre
toute responsabilité, dommage, jugement, coût, dépense et frais (y compris les
honoraires d'avocat raisonnables) résultant de toute réclamation, enquête, litige
ou autre action légale ou administrative de tiers, découlant de ou liée à toute
violation réelle ou alléguée par Vous de l'une des déclarations, garanties ou
engagements prévus par les présentes conditions générales.
9. Reconnaissance et consentement du participant
Vous reconnaissez et acceptez par la présente que :
(1) MSI se réserve le droit exclusif et discrétionnaire :
a) de déterminer, de manière définitive et concluante, si un participant a rempli
les conditions de l'Événement de bonne foi. À titre d'exemple non limitatif, MSI
peut disqualifier des participants : a) si l'inscription à l'Événement ou
l'enregistrement du produit est incomplet ; b) si les conditions d'éligibilité à
l'Événement, telles que l'inscription dans les délais impartis, la gamme de
produits applicable ou les restrictions régionales, ne sont pas respectées ; c) si
les documents fournis sont altérés, falsifiés, frauduleux, mal acheminés ou
invalides ; d) si des codes automatisés, scripts, plugins ou autres moyens ont été
utilisés pour s'inscrire à l'Événement ou compléter le processus d'inscription ; e)
si le participant n'a pas la capacité juridique de s'inscrire à cet Événement ; ou f)
si des actes criminels ou illégaux ont été commis ou sont allégués avoir été
commis pour s'inscrire à cet événement ;
b) de remplacer le prix par des articles de valeur similaire sans préavis ;
c) de modifier, supprimer ou ajouter des dispositions aux présentes conditions
générales pour des raisons valables, entendues comme :
- la modification des lois régissant les règles et l'organisation de l'Événement,
affectant les droits et obligations de MSI et des participants ;
- la prolongation ou la réduction de la durée de l'Événement ;
- la modification des modalités de déroulement de l'Événement pour des raisons
techniques, technologiques ou commerciales.
En cas de modification, les conditions générales révisées seront publiées par
MSI sur la page de destination de l'Événement. Pour éviter tout doute, le cas
échéant, les modifications apportées aux conditions générales n'affectent pas
les commandes passées ou les offres mises en œuvre dans le cadre des
conditions générales applicables avant la modification."
(2) MSI n'est pas responsable et décline toute responsabilité envers toute
personne pour toute perte, insatisfaction ou dommage découlant du prix et de
son utilisation. Les gagnants ne pourront formuler aucune réclamation à
l'encontre de MSI.
(3) MSI décline toute responsabilité pour tout retard, erreur de livraison, perte
ou défaillance dans la transmission de la notification de gain ou de tout prix, due
à des erreurs, dysfonctionnements ou défaillances de nature logistique,
mécanique, technique, électronique, de communication, téléphonique,
informatique, matérielle, liée à Internet ou aux logiciels. Dans une telle

11. Limitation de responsabilité
DANS TOUTE LA MESURE PERMISE PAR LES LOIS APPLICABLES, MSI NE SAURAIT
ÊTRE TENUE RESPONSABLE ENVERS VOUS AU TITRE DE TOUTE RÉCLAMATION
(QUELLE QUE SOIT LA THÉORIE DE RESPONSABILITÉ INVOQUÉE, QU'ELLE SOIT
FONDÉE SUR DES PRINCIPES CONTRACTUELS, DE GARANTIE, DE NÉGLIGENCE

12. Dispositions diverses
Les présentes conditions générales sont régies et interprétées conformément
aux lois de Taïwan, indépendamment des principes de conflit de lois, et tout
litige découlant de l'événement et des présentes conditions sera tranché par le
Tribunal de district de Taipei, à Taipei, Taïwan. Toute disposition invalidée par
un tribunal compétent sera supprimée, et les conditions générales restantes
demeureront pleinement en vigueur. Le fait pour MSI de ne pas exercer un
droit prévu par les présentes conditions générales ne saurait être interprété
comme une renonciation à ce droit. MSI ne saurait être tenue responsable de

Výherci, kteří budou náhodně vylosováni z okruhu způsobilých účastníků, budou

Společnost MSI vás může kontaktovat za účelem ověření vaší registrované
adresy: neúplná nebo nesprávná doručovací adresa může být důvodem k
diskvalifikaci výherce. Výherce musí odpovědět na e-mail společnosti MSI do
sedmi (7) kalendářních dnů; výherce, který v této lhůtě neodpoví, může být
považován za osobu, která se ceny vzdala, a společnost MSI vybere nového

3. Obecné podmínky a pravidla akce
(1) Účastník musí být starší 18 let a být oprávněným rezidentem způsobilého

tchajwanskou pobočku společnosti MSI: Micro-Star Int'l Co., Ltd., No.69 Lide
Street, Zhonghe Dist., PSČ 23584, New Taipei City, Taiwan. Písemná žádost
účastníka musí být čitelná, aby mohla být přijata, a musí obsahovat celé jméno
účastníka, platnou poštovní adresu (BEZ P.O. BOX), telefonní číslo a e-mailovou
adresu umožňující ověření totožnosti účastníka společností MSI, a dále název
akce. Na každého účastníka připadá pouze jedna přihláška. Společnost MSI
využije kontaktní údaje uvedené v přihlášce také ke komunikaci s účastníkem, jeli to relevantní.
(5) Tato akce je určena výhradně pro způsobilé koncové uživatele —
spotřebitele, nikoli pro podnikatelské subjekty. Zaměstnanci společnosti MSI,
jejích přidružených společností, dceřiných společností, výrobců, obchodních
partnerů, distributorů, velkoobchodníků, prodejců, maloobchodníků nebo
agentur a jejich nejbližší rodinní příslušníci nejsou způsobilí k účasti v této akci.
(6) Přihlášky podané automatizovaně nebo roboticky jednotlivci či organizacemi
budou diskvalifikovány. Přihlášku musí podat sám účastník. Jakýkoli pokus
účastníka o získání většího počtu přihlášek, než je stanoveno, prostřednictvím
více různých e-mailových adres, identit, registrací, přihlašovacích údajů nebo
jakýchkoli jiných metod, bude mít za následek zneplatnění přihlášky a může vést
k okamžité diskvalifikaci. Konečná způsobilost pro udělení jakékoli ceny podléhá
ověření způsobilosti, jak je uvedeno níže. Všechny přihlášky musí být odeslány
před koncem doby trvání akce. Oficiálním časoměřičem této akce je databázový
čas společnosti MSI.
4. Zásady ochrany osobních údajů
Během procesu přihlášení do akce a registrace produktu vás můžeme požádat o

podezřelé porušení platných právních předpisů příslušným právním a regulačním
orgánům, jako jsou soudy nebo policie, a to v nezbytném rozsahu.
Vzhledem k mezinárodní povaze naší činnosti předáváme informace v rámci
skupiny MSI a třetím stranám, jak je uvedeno výše, v souvislosti s účely
stanovenými v těchto podmínkách. Z tohoto důvodu mohou být informace
předávány do zemí, které mohou mít odlišné právní předpisy a požadavky na
ochranu osobních údajů, než jaké platí v zemi vašeho pobytu.

5. Odběr e-mailového zpravodaje (eDM)
Můžete být požádáni o přihlášení k odběru e-mailového zpravodaje společnosti
MSI, abyste dostávali novinky o produktech MSI nebo aktualizace služeb. Pokud
si nepřejete přihlásit se k odběru, nezaškrtávejte příslušné políčko pro přihlášení
k odběru nebo podobně označené políčko.
6. Licence účastníka
Odesláním příspěvku nebo souhlasem s jeho odesláním berete na vědomí a
souhlasíte s následujícím:
(1) Tímto udělujete společnosti MSI nevýhradní, bezplatné, celosvětové, trvalé,
neodvolatelné a plně sublicencovatelné právo používat, reprodukovat,
upravovat, přizpůsobovat, publikovat, prodávat, postoupit, překládat, vytvářet
odvozená díla, distribuovat a zobrazovat jakýkoli příspěvek, který nahrajete
společnosti MSI nebo v souladu s těmito podmínkami („Příspěvek""), a to vcelku
nebo zčásti, v jakékoli formě, médiu nebo technologii, ať již nyní známé nebo v
budoucnu vyvinuté, v souvislosti s výše uvedenými marketingovými, reklamními
a propagačními aktivitami.
(2) Vlastníte nebo jinak kontrolujete práva ke svému Příspěvku a všem jeho
prvkům.
(3) Prohlašujete a zaručujete, že Příspěvek neporušuje ani nezasahuje do práv
třetích stran, včetně, ale nikoli výhradně, práv duševního vlastnictví, autorských
práv, ochranných známek, práv na ochranu osobnosti a soukromí, patentů,
obchodního tajemství nebo závazků mlčenlivosti.
7. Prohlášení a záruky účastníka
Tímto prohlašujete a zaručujete, že:
(1) veškeré informace, které jste poskytli společnosti MSI, jsou pravdivé, přesné
a nezavádějící;
(2) máte plné právo uzavřít tuto smlouvu se společností MSI a poskytnout
licence, prohlášení a záruky týkající se Příspěvku;
(3) jste plným a oprávněným vlastníkem veškerých práv (včetně, bez omezení,
veškerých práv duševního vlastnictví) k Příspěvku;
(4) získali jste veškerá potřebná povolení a uhradili veškeré finanční prostředky
nezbytné k tomu, aby společnost MSI mohla vykonávat práva, která jste jí tímto
udělili, a potvrzujete a zaručujete, že společnost MSI nebude povinna získávat
žádná jiná ani samostatná práva, povolení nebo licence, ani nebude povinna
provádět jakékoli dodatečné platby jakýmkoli stranám za účelem výkonu práv,
která jste jí tímto udělili;
(5) všechny osoby uvedené v Příspěvku poskytly plný souhlas se svým zařazením
do Příspěvku a vy jste získali veškeré požadované souhlasy, oprávnění a povolení
k použití podobizny nebo vzhledu od všech dotčených osob, skupin, stran nebo
míst, abyste mohli udělit práva udělená v tomto dokumentu, včetně (mimo jiné)
našeho práva používat, vystavovat, distribuovat, využívat, reprodukovat a/nebo
upravovat (bez omezení nebo restrikce) Příspěvek;
(6) máte plnou pravomoc, způsobilost, oprávnění a právo přihlásit se do této
akce a poskytnout požadovanou licenci, prohlášení a záruky podle těchto
podmínek; a
(7) při přihlášení do této akce jste dodrželi veškeré platné právní předpisy.
8. Odškodnění účastníka
Zavazujete se bránit, odškodnit a zbavit odpovědnosti společnost MSI, její
přidružené společnosti, nástupce, postupníky, ředitele a zástupce za veškeré
závazky, škody, rozsudky, náklady, výdaje a poplatky (včetně přiměřených
poplatků za právní zastoupení) vyplývající z jakýchkoli nároků, šetření, soudních
sporů nebo jiných právních či správních řízení třetích stran vzniklých v důsledku
nebo v souvislosti s jakýmkoli skutečným nebo údajným porušením vašich
prohlášení, záruk nebo závazků podle těchto podmínek.
9. Potvrzení a souhlas účastníka
Tímto berete na vědomí a souhlasíte s tím, že:
(1) Společnost MSI si vyhrazuje výhradní a diskreční právo:
a) s konečnou a závaznou platností určit, zda účastník splnil požadavky akce v
dobré víře. Pro ilustraci, aniž by tím byla omezena jakákoli jiná ustanovení, může
společnost MSI diskvalifikovat účastníky: a) pokud je přihláška do akce nebo
registrace produktu neúplná; b) pokud nejsou splněny podmínky způsobilosti,
jako je včasné přihlášení, příslušná produktová řada nebo regionální omezení; c)
pokud jsou poskytnuté dokumenty pozměněny, zfalšovány, podvodné,
nesprávně doručeny nebo neplatné; d) pokud byly k přihlášení nebo dokončení
registrace do akce použity automatizované kódy, skripty, pluginy nebo jiné
prostředky; e) pokud účastník nemá právní způsobilost k přihlášení do této akce;
nebo f) pokud byly spáchány nebo jsou údajně spáchány trestné nebo
protiprávní činy za účelem přihlášení do této akce;
b) nahradit cenu předměty podobné hodnoty bez předchozího upozornění;
c) měnit, odstraňovat nebo doplňovat jakákoli tato ustanovení a podmínky,
pokud k tomu existuje oprávněný důvod, chápaný jako:
− změna právních předpisů upravujících pravidla a organizaci akce, která
ovlivňuje práva a povinnosti společnosti MSI a účastníků;
− prodloužení nebo zkrácení doby trvání akce;
− změna způsobu provádění akce z technických, technologických nebo
obchodních důvodů.
V případě jakékoli takové změny zveřejní společnost MSI revidované podmínky
na vstupní stránce akce. Pro vyloučení pochybností platí, že změny podmínek
nemají vliv na objednávky zadané nebo nabídky realizované podle podmínek
platných před danou změnou.
(2) Společnost MSI nenese odpovědnost za žádné ztráty, nespokojenost ani
škody vzniklé v souvislosti s cenou a jejím užíváním. Výherci nesmějí vznášet vůči
společnosti MSI žádné nároky.
(3) Společnost MSI odmítá veškerou odpovědnost za jakékoli zpoždění,
nesprávné doručení, ztrátu nebo selhání při doručení oznámení o výhře nebo
jakýchkoli cen způsobené logistickými, mechanickými, technickými,
elektronickými, komunikačními, telefonními, počítačovými, hardwarovými,
internetovými nebo softwarovými chybami, poruchami nebo selháními
jakéhokoli druhu. V takovém případě se výherce bezpodmínečně vzdává svého
nároku na cenu a jakékoli související náhrady.
10. Vyloučení záruk společnosti MSI
CENA (CENY) SPOLEČNOSTI MSI JE (JSOU) POSKYTOVÁNA (POSKYTOVÁNY) „TAK,
JAK JE (JSOU)"" BEZ JAKÉKOLI VÝSLOVNÉ NEBO PŘEDPOKLÁDANÉ ZÁRUKY
JAKÉHOKOLI DRUHU, VČETNĚ ZÁRUK PRODEJNOSTI, NEPORUŠENÍ PRÁV
TŘETÍCH STRAN NEBO VHODNOSTI PRO KONKRÉTNÍ ÚČEL.
11. Omezení odpovědnosti
V MAXIMÁLNÍM ROZSAHU POVOLENÉM PLATNÝMI PRÁVNÍMI PŘEDPISY NENESE
SPOLEČNOST MSI VŮČI VÁM ODPOVĚDNOST NA ZÁKLADĚ JAKÉHOKOLI NÁROKU
(BEZ OHLEDU NA TEORII ODPOVĚDNOSTI, AŤ UŽ VYCHÁZEJÍCÍ ZE ZÁSAD
SMLOUVY, ZÁRUKY, NEDBALOSTI NEBO JINÉHO DELIKTU, PORUŠENÍ ZÁKONNÉ
POVINNOSTI NEBO JINAK) ZA JAKÉKOLI ZVLÁŠTNÍ, NÁSLEDNÉ, NEPŘÍMÉ,
NÁHODNÉ, REPRESIVNÍ NEBO EXEMPLÁRNÍ ŠKODY, AŤ UŽ PŘEDVÍDATELNÉ ČI
NIKOLI, VČETNĚ, ALE NIKOLI VÝHRADNĚ, UŠLÉHO ZISKU, PŘÍJMŮ, DOBRÉ
POVĚSTI NEBO NÁKLADŮ NA NÁHRADU.
12. Různá ustanovení
Tyto podmínky se řídí a vykládají v souladu s právními předpisy Tchaj-wanu, bez
ohledu na zásady kolizního práva, a veškeré spory vzniklé z akce a těchto
podmínek budou rozhodovány Okresním soudem v Tchaj-peji na Tchaj-wanu.
Jakékoli ustanovení prohlášené příslušným soudem za neplatné bude vypuštěno a
zbývající podmínky zůstanou v plné platnosti a účinnosti. Nevymáhání jakéhokoli
práva ze strany společnosti MSI podle těchto podmínek nebude považováno za
vzdání se tohoto práva. Společnost MSI nenese odpovědnost za jakékoli neplnění
způsobené okolnostmi mimo její přiměřenou kontrolu. Tyto podmínky nesmíte
postoupit ani jinak převést na jakoukoli třetí stranu; veškerá neoprávněná
postoupení jsou neplatná a bez právního účinku. Tyto podmínky představují
úplnou dohodu mezi stranami ohledně akce a nahrazují veškeré předchozí
smlouvy, komunikaci, prohlášení nebo jednání, ústní či jiná.

MSI maakt de winnaars bekend, willekeurig geselecteerd uit de pool van in
aanmerking komende deelnemers, op de evenement-weggeefpagina vóór 30
september 2026. MSI kan contact met u opnemen om uw geregistreerde adres
te bevestigen: een onvolledig of onjuist bezorgadres kan reden zijn om de
winnaar te diskwalificeren. De winnaar dient binnen zeven (7) kalenderdagen te
reageren op de e-mail van MSI; een winnaar die niet binnen deze termijn
reageert, kan worden geacht afstand te hebben gedaan van de prijs, waarna MSI

3. Algemene Evenementvoorwaarden
(1) U dient 18 jaar of ouder te zijn en legaal woonachtig te zijn in een in
aanmerking komend gebied (zie de lijst met in aanmerking komende gebieden
hieronder).
(2) In aanmerking komende gebieden: Open voor legale inwoners wereldwijd,
met uitzondering van Turkije, Italië, Thailand, de Volksrepubliek China, de
Krimregio van Oekraïne, Belarus, Rusland, Cuba, Iran, Noord-Korea, Soedan,
Syrië, Venezuela, en landen of regio's die onderworpen zijn aan beperkingen,
sancties of embargo's. De potentiële prijswinnaar van dit evenement dient een
bewijs van woonplaats te overleggen.
(3) Elke deelnemer is beperkt tot één (1) inzending. Elke poging van een
deelnemer om meer inzendingen te verkrijgen dan het opgegeven aantal —
door gebruik te maken van meerdere of verschillende e-mailadressen,
identiteiten, registraties, inloggegevens of andere methoden, inclusief maar niet
beperkt tot commerciële wedstrijd- of evenementabonnementsmeldingen

kan leiden tot diskwalificatie.
(4) AANKOOP IS NIET VEREIST OM DEEL TE NEMEN AAN DE LOTING. Voor alle
deelnemers is deelname aan dit evenement gratis. U kunt kans maken op de
prijsuitloting door een schriftelijk verzoek aan MSI te sturen naar het kantoor
van MSI in Taiwan: Micro-Star Int'l Co., Ltd., No. 69 Lide Street, Zhonghe Dist.,
Postcode 23584, New Taipei City, Taiwan. Het schriftelijke verzoek van de
deelnemer moet leesbaar zijn om geaccepteerd te worden, en moet de
volledige naam van de deelnemer, een geldig postadres (GEEN POSTBUS),
telefoonnummer en een e-mailadres bevatten zodat MSI de deelnemer kan
verifiëren, evenals de naam van het evenement. Per deelnemer is slechts één
inzending toegestaan. MSI gebruikt de in de inzending verstrekte
contactgegevens ook om, indien van toepassing, contact op te nemen met de
deelnemer.
(5) Dit evenement is uitsluitend bestemd voor in aanmerking komende
eindgebruikers en niet voor bedrijven. Medewerkers van MSI, MSI-gelieerde
ondernemingen, dochterondernemingen, fabrikanten, zakenpartners,
distributeurs, groothandelaren, wederverkopers, detailhandelaren of
agentschappen, en hun directe familieleden, komen niet in aanmerking voor
deelname aan dit evenement.
(6) Geautomatiseerde of robotinzendingen ingediend door personen of
organisaties worden gediskwalificeerd. Inzendingen moeten door de deelnemer
zelf worden gedaan. Elke poging van een deelnemer om meer inzendingen te
verkrijgen dan het opgegeven aantal — door gebruik te maken van meerdere of
verschillende e-mailadressen, identiteiten, registraties, inloggegevens of andere
methoden — maakt de inzending van die deelnemer ongeldig en kan leiden tot
onmiddellijke diskwalificatie. De definitieve geschiktheid voor de toekenning

Tijdens het inschrijvingsproces voor het evenement en de productregistratie
kunnen wij u om informatie vragen, waaronder maar niet beperkt tot uw emailadres, naam, serienummer van het product, inwisselcode,
aankoopinformatie en andere vrijwillig verstrekte gegevens. Daarnaast kunnen
wij indirect informatie van u verzamelen via cookies of in de website
geïntegreerde analysediensten. De verzamelde informatie wordt op de volgende
manieren gebruikt: voor de uitvoering van dit evenement, voor de verificatie
van uw geschiktheid, voor contact met u indien nodig, om ervoor te zorgen dat
de prijs(en) aan u kunnen worden verzonden, voor de opslag van geregistreerde
productgegevens zolang er een lopende relatie tussen ons bestaat (bijv.
wanneer u gebruikmaakt van onze diensten zoals garantie, emailnieuwsbrieven, enz.), en uitsluitend voor intern marktonderzoek ten
behoeve van de ontwikkeling van betere producten en diensten. Uw gegevens
worden niet gedeeld met derden, behalve: i) met externe verwerkers zoals onze
internetservice- en websiteproviders voor de uitvoering van dit evenement; en
ii) bij het rapporteren aan of reageren op verzoeken van juridische en
regelgevende autoriteiten, zoals rechtbanken of de politie, in geval van een
daadwerkelijke of vermoede schending van toepasselijke wetgeving, voor zover
vereist.
Vanwege het internationale karakter van onze bedrijfsactiviteiten dragen wij
informatie over binnen de MSI-groep en aan bovengenoemde derden, in
verband met de doeleinden zoals uiteengezet in deze algemene voorwaarden.
Wij kunnen derhalve informatie overdragen naar landen die mogelijk andere
wet- en regelgeving inzake gegevensbescherming hanteren dan die welke van
toepassing zijn in uw land.
Nadere details over hoe uw gegevens kunnen worden gebruikt en verwerkt, zijn
beschreven in het privacybeleid van MSI, beschikbaar op
https://www.msi.com/page/privacy-policy. Het MSI-privacybeleid maakt deel uit
van deze algemene voorwaarden en is hierin opgenomen door middel van
verwijzing, met volledige kracht en werking.
5. Abonnement op e-mailnieuwsbrief
U kunt worden gevraagd om u aan te melden voor de e-mailnieuwsbrief van
MSI om productnieuws of service-updates te ontvangen. Als u zich niet op deze
lijst wilt abonneren, vink dan het selectievakje voor abonneren of een
vergelijkbaar vakje niet aan.
6. Licentie van de deelnemer
Door een inzending te doen of hiermee in te stemmen, erkent en aanvaardt u
het volgende:
(1) U verleent MSI hierbij een niet-exclusief, royaltyvrij, wereldwijd,
eeuwigdurend, onherroepelijk en volledig sublicentieerbaar recht om elke
inzending die u uploadt naar MSI of op grond van deze algemene voorwaarden
(""Inzending""), geheel of gedeeltelijk, in welke vorm, medium of technologie
dan ook — hetzij nu bekend of in de toekomst ontwikkeld — te gebruiken, te
reproduceren, te wijzigen, aan te passen, te publiceren, te verkopen, over te
dragen, te vertalen, afgeleide werken van te maken, te distribueren en weer te
geven, in verband met de hierboven genoemde marketing-, reclame- en
promotieactiviteiten.
(2) U bent eigenaar van of beschikt anderszins over de rechten op uw Inzending
en alle elementen daarvan.
(3) U verklaart en garandeert dat de Inzending geen inbreuk maakt op of in
strijd is met de rechten van derden, inclusief maar niet beperkt tot intellectuele
eigendomsrechten, auteursrechten, handelsmerken, publiciteits- en
privacyrechten, octrooien, bedrijfsgeheimen of
vertrouwelijkheidsverplichtingen.
7. Verklaringen en garanties van de deelnemer
U verklaart en garandeert hierbij dat:
(1) alle door u aan MSI verstrekte informatie juist, nauwkeurig en niet
misleidend is;
(2) u het volledige recht heeft om deze overeenkomst met MSI aan te gaan en
de licentieverleningen, verklaringen en garanties met betrekking tot de
Inzending te doen;
(3) u de volledige en rechtmatige eigenaar bent van alle rechten (inclusief maar
niet beperkt tot alle intellectuele eigendomsrechten) in en op de Inzending;
(4) u alle vereiste toestemmingen heeft verkregen en alle benodigde betalingen
heeft gedaan zodat MSI de door u verleende rechten kan uitoefenen, en u
bevestigt en garandeert dat MSI geen andere of afzonderlijke rechten,
toestemmingen of licenties hoeft te verkrijgen, noch aanvullende betalingen
aan derden hoeft te doen om de door u verleende rechten uit te oefenen;
(5) alle personen die in de Inzending voorkomen, volledige toestemming hebben
gegeven voor hun opname daarin, en dat u alle vereiste toestemmingen,
machtigingen en vrijgaven voor afbeeldingen/verschijning heeft verkregen van
alle betrokken personen, groepen, partijen of locaties, zodat u de hierin
verleende rechten kunt verlenen, inclusief maar niet beperkt tot ons recht om
de Inzending te gebruiken, te vertonen, te distribueren, te exploiteren, te
reproduceren en/of te bewerken (zonder beperking of restrictie);
(6) u de volledige bevoegdheid, handelingsbekwaamheid, macht en het recht
heeft om deel te nemen aan dit evenement en de vereiste licentieverlening,
verklaringen en garanties op grond van deze algemene voorwaarden te doen; en
(7) u bij deelname aan dit evenement alle toepasselijke wet- en regelgeving
heeft nageleefd.
8. Vrijwaring door de deelnemer
U dient MSI, haar gelieerde ondernemingen, rechtsopvolgers,
rechtverkrijgenden, bestuurders en vertegenwoordigers te verdedigen,
schadeloos te stellen en te vrijwaren van en tegen alle aansprakelijkheden,
schades, vonnissen, kosten, uitgaven en vergoedingen (inclusief redelijke
advocaatkosten) die voortvloeien uit claims, onderzoeken, rechtszaken of
andere juridische of administratieve procedures door derden die verband
houden met een daadwerkelijke of vermeende schending door u van enige
verklaring, garantie of verplichting in deze algemene voorwaarden.
9. Erkenning en toestemming van de deelnemer
U erkent en aanvaardt hierbij dat:
(1) MSI het exclusieve en discretionaire recht behoudt:
a) om op definitieve en bindende wijze te bepalen of een deelnemer de
evenementvereisten te goeder trouw heeft vervuld. Ter illustratie, zonder
beperking van andere voorwaarden, kan MSI deelnemers diskwalificeren: a) als
de evenementinschrijving of productregistratie onvolledig is; b) als niet wordt
voldaan aan de deelnamevereisten, zoals tijdige inschrijving, toepasselijke
productlijn of regionale beperkingen; c) als de verstrekte documenten zijn
gewijzigd, vervalst, frauduleus, verkeerd bezorgd of ongeldig zijn; d) als
geautomatiseerde codes, scripts, plug-ins of andere middelen zijn gebruikt om
deel te nemen aan of de evenementinschrijving te voltooien; e) als de
deelnemer niet de rechtsbevoegdheid heeft om deel te nemen aan dit
evenement; of f) als criminele of illegale handelingen zijn gepleegd of
vermoedelijk zijn gepleegd om deel te nemen aan dit evenement;
b) om de prijs zonder voorafgaande kennisgeving te vervangen door items van
vergelijkbare waarde;
c) om deze algemene voorwaarden te wijzigen, te schrappen of aan te vullen
indien daar een geldige reden voor bestaat, te begrijpen als:
− wijziging van de wetgeving die de regels en organisatie van het evenement
beheert, met gevolgen voor de rechten en verplichtingen van MSI en
deelnemers
− verlenging of verkorting van de duur van het evenement
− wijziging in de uitvoering van het evenement om technische, technologische
of commerciële redenen
In geval van een dergelijke wijziging worden de herziene algemene voorwaarden
door MSI gepubliceerd op de landingspagina van het evenement. Voor alle
duidelijkheid: wijzigingen in de algemene voorwaarden zijn, voor zover van
toepassing, niet van invloed op bestellingen die zijn geplaatst of aanbiedingen
die zijn uitgevoerd onder de vóór de wijziging geldende algemene voorwaarden.
(2) MSI is niet aansprakelijk en aanvaardt geen aansprakelijkheid jegens enige
persoon voor verlies, ontevredenheid of schade die voortvloeit uit de prijs en
het gebruik daarvan. Winnaars kunnen geen claims indienen tegen MSI.
(3) MSI wijst alle aansprakelijkheid af voor vertragingen, verkeerde bezorging,
verlies of het uitblijven van de bezorging van de winnaarskennisgeving of prijzen
als gevolg van logistieke, mechanische, technische, elektronische,
communicatie-, telefoon-, computer-, hardware-, internet- of softwarefouten,
storingen of defecten van welke aard dan ook. In een dergelijk geval doet de
winnaar onvoorwaardelijk afstand van zijn/haar recht op de prijs en eventuele
bijbehorende compensatie.
10. Uitsluiting van garanties door MSI
DE PRIJS/PRIJZEN VAN MSI WORDEN GELEVERD ""AS IS"" (ZOALS ZE ZIJN),
ZONDER ENIGE UITDRUKKELIJKE OF IMPLICIETE GARANTIE VAN WELKE AARD
DAN OOK, INCLUSIEF GARANTIES VAN VERKOOPBAARHEID, NIET-INBREUK OF
GESCHIKTHEID VOOR EEN BEPAALD DOEL.
11. Beperking van aansprakelijkheid
VOOR ZOVER MAXIMAAL TOEGESTAAN DOOR TOEPASSELIJKE WETGEVING IS
MSI JEGENS U NIET AANSPRAKELIJK OP GROND VAN ENIGE CLAIM (ONGEACHT
DE AANSPRAKELIJKHEIDSTHEORIE, OF DEZE NU GEBASEERD IS OP
CONTRACTUELE BEGINSELEN, GARANTIE, NALATIGHEID OF ANDERE
ONRECHTMATIGE DAAD, SCHENDING VAN EEN WETTELIJKE PLICHT OF
ANDERSZINS) VOOR BIJZONDERE, GEVOLGSCHADE, VERTROUWENSSCHADE,
INDIRECTE, INCIDENTELE, PUNITIEVE OF EXEMPLAIRE SCHADE, VOORZIENBAAR
OF NIET, INCLUSIEF MAAR NIET BEPERKT TOT GEDERFDE WINST, INKOMSTEN,
GOODWILL OF VERVANGINGSKOSTEN.
12. Overige bepalingen
Deze algemene voorwaarden worden beheerst door en uitgelegd in
overeenstemming met het recht van Taiwan, ongeacht de beginselen van
conflictenrecht. Alle geschillen die voortvloeien uit het evenement en deze
voorwaarden worden beslecht door de Rechtbank van Taipei in Taipei, Taiwan.

MSI は、対象参加者の中から無作為に抽選で選出した当選者を、2026 年
9 月 30 日までにイベントのプレゼントページにて発表します。MSI は当
選者に対し、登録住所の確認を求める場合があります。配送先住所が不
完全または不正確な場合、当選資格が失効する可能性があります。当選
者は MSI からのメールに 7 暦日以内に返信する必要があります。期限内
に返信がない場合、当選者は賞品を辞退したものとみなされ、MSI が新
たな当選者を選出します。これらの事項に関する最終判断は、MSI が単
独で行うものとします。
3. 共通イベント利用規約
（1）参加者は 18 歳以上であり、対象地域（以下の対象地域リストを参
照）の合法的な居住者である必要があります。"

につき 1 通の応募のみ受け付けます。MSI は応募時に提供された連絡先
情報を、必要に応じて参加者への連絡に使用します。
（5）本イベントは、対象となる一般エンドユーザーのみを対象としてお
り、法人・企業は対象外です。MSI、MSI の関連会社、子会社、製造業
者、ビジネスパートナー、販売代理店、卸売業者、再販業者、小売業
者、または代理店の従業員およびその直系家族は、本イベントへの参加
資格がありません。
（6）個人または組織による自動化・ロボットによる応募は無効となりま
す。応募は参加者本人が行う必要があります。複数または異なるメール
アドレス、氏名、登録情報、ログイン情報、その他の方法を使用して規
定数を超える応募を試みた場合、当該参加者の応募は無効となり、即時
失格となる場合があります。賞品受賞の最終的な資格は、以下に定める
資格確認の結果に基づきます。すべての応募はイベント期間終了までに
投稿される必要があります。MSI のデータベースの時刻が、本イベント
の公式タイムキーパーとなります。
4. プライバシーポリシー
イベントへの参加登録および製品登録の過程において、メールアドレ
ス、氏名、製品シリアルナンバー、引き換えコード、購入情報、その他
お客様が任意で提供するその他の情報を含む（ただしこれらに限らな
い）情報のご提供をお願いする場合があります。また、クッキーやウェ
ブサイトに組み込まれた分析ツールを通じて、間接的に情報を収集する
場合があります。収集した情報は以下の目的で使用されます：本イベン
トの運営、参加資格の確認、必要に応じたご連絡、賞品の発送、当社と
のお取引関係が継続する期間中の登録製品データの保管（保証サービス
やメールマガジンなどのサービスご利用時を含む）、ならびに製品・サー
ビスの改善を目的とした社内市場調査への活用。お客様の情報は第三者
と共有されません。ただし、以下の場合を除きます：i）本イベントの運
営のために必要なインターネットサービスプロバイダーやウェブサイト
運営会社などの第三者処理業者への提供、ii）適用法令の実際のまたは疑
われる違反を報告・対応するために、裁判所や警察などの法的・規制当
局に対して必要な範囲で開示する場合。
当社のビジネスの国際的な性質上、本利用規約に定める目的のために、
MSI グループ内および上記の第三者に対して情報を移転する場合があり
ます。そのため、お客様が所在する国とは異なる法律やデータ保護要件
を持つ国へ情報が移転される場合があります。
お客様の情報の使用および処理の詳細については、MSI のプライバシー
ポリシー（https://www.msi.com/page/privacy-policy）をご参照ください。
MSI プライバシーポリシーは本利用規約の一部を構成し、その全効力を
もって参照により本規約に組み込まれるものとします。
5. メールマガジン（eDM）の購読
MSI の製品ニュースやサービス更新情報をお届けするメールマガジンへ
の登録をお願いする場合があります。購読をご希望でない場合は、購読
またはそれに類するチェックボックスにチェックを入れないでくださ
い。
6. 参加者ライセンス
応募を行うこと、または応募に同意することにより、お客様は以下の事
項を承認し、同意したものとみなされます。
（1）お客様は、MSI に対し、本利用規約に基づいて MSI にアップロード
された応募内容（「応募物」）の全部または一部について、現在知られて
いるか今後開発されるかを問わず、あらゆる形式、メディア、または技
術において、上記のマーケティング・広告・プロモーション活動に関連
して、使用、複製、修正、翻案、出版、販売、譲渡、翻訳、二次的著作
物の作成、配布および表示する非独占的、ロイヤリティフリー、全世界
的、永続的、取消不能かつ完全にサブライセンス可能な権利を付与する
ものとします。
（2）お客様は、応募物およびそのすべての要素に関する権利を所有また
は管理しているものとします。
（3）お客様は、応募物が知的財産権、著作権、商標権、パブリシティ
権・プライバシー権、特許権、営業秘密または守秘義務を含む（ただし
これらに限らない）第三者の権利を侵害または違反しないことを表明し
保証するものとします。
7. 参加者の表明および保証
お客様は以下の事項を表明し保証するものとします。
（1）MSI に提供するすべての情報は真実、正確であり、誤解を招くもの
ではないこと。
（2）お客様は MSI との本契約を締結し、応募物に関するライセンスの付
与、表明および保証を行う完全な権利を有すること。
（3）お客様は応募物に関するすべての権利（知的財産権を含むがこれに
限らない）の完全かつ合法的な所有者であること。
（4）お客様は、MSI が本契約においてお客様から付与された権利を行使
できるよう、必要なすべての許諾を取得し、必要な費用をすべて支払済
みであること。また、MSI が当該権利を行使するにあたり、追加の権
利、許諾もしくはライセンスの取得、または第三者への追加支払いが不
要であることを確認し保証すること。
（5）応募物に登場するすべての個人は、応募物への掲載に完全に同意し
ており、お客様は当該個人、グループ、関係者または場所から、本契約
に定める権利（応募物の使用、展示、配布、利用、複製および/または編
集する権利を含むがこれに限らない）を付与できるよう、必要なすべて
の同意、許可および肖像・出演に関するリリースを取得済みであるこ
と。
（6）お客様は、本イベントに参加し、本利用規約に基づく必要なライセ
ンスの付与、表明および保証を行う完全な権限、能力、権能および権利
を有すること。
（7）お客様は、本イベントへの参加にあたり、適用されるすべての法令
を遵守していること。"
8. 参加者による補償
お客様は、本利用規約における表明、保証または誓約の実際のまたは申
し立てられた違反に起因または関連して第三者が提起するあらゆる請
求、調査、訴訟、その他の法的または行政上の手続きから生じるすべて
の責任、損害、判決、費用、経費および手数料（合理的な弁護士費用を
含む）について、MSI、その関連会社、承継人、譲受人、取締役および代
理人を防御し、補償し、免責するものとします。
9. 参加者の承認および同意
お客様は以下の事項を承認し、同意するものとします。
（1）MSI は以下の事項について単独かつ裁量的な権利を留保します。
a）参加者がイベント要件を誠実に満たしているかどうかを最終的かつ確
定的に判断する権利。例示として（他の条項を制限するものではなく）、
MSI は以下の場合に参加者を失格とする場合があります：a）イベントへ
の参加登録または製品登録が不完全な場合、b）適時の登録、対象製品ラ
イン、地域制限などのイベント参加資格要件を満たしていない場合、c）
提出書類が改ざん、偽造、不正、誤配または無効である場合、d）自動化
コード、スクリプト、プラグインその他の手段を使用してイベントへの
参加登録を行った場合、e）参加者が本イベントに参加する法的能力を有
しない場合、f）本イベントへの参加に際して犯罪行為または違法行為が
行われた、またはその疑いがある場合。
b）事前通知なしに、賞品を同等の価値を持つ品目に変更する権利。
c）以下の正当な理由がある場合に、本利用規約の条項を変更、削除また
は追加する権利。
- イベントの規則および運営を規定する法律の改正により、MSI および
参加者の権利・義務に影響が生じる場合
- イベント期間の延長または短縮
- 技術的、テクノロジー的または商業的な理由によるイベント実施方法
の変更
このような変更が生じた場合、改訂された利用規約は MSI によりイベン
トのランディングページに掲載されます。なお、利用規約の変更は、変
更前の利用規約に基づいて行われた注文または実施されたオファーには
影響しません。
（2）MSI は、賞品およびその使用から生じるいかなる損失、不満または
損害についても、いかなる者に対しても責任を負わず、一切の責任を負
いません。当選者は MSI に対していかなる請求も行わないものとしま
す。
（3）MSI は、物流、機械、技術、電子、通信、電話、コンピューター、
ハードウェア、インターネット、またはソフトウェアのエラー、誤作
動、あらゆる種類の障害に起因する当選通知または賞品の配送の遅延、
誤配、紛失または不達について、一切の責任を負いません。このような
事態が発生した場合、当選者は賞品および関連する補償に対する権利を
無条件に放棄するものとします。
10. MSI の保証の免責
MSI の賞品は、商品性、非侵害性、または特定目的への適合性の保証を
含む（ただしこれらに限らない）、明示または黙示を問わず、いかなる種
類の保証もなく「現状のまま」提供されます。
11. 責任の制限
適用法令が許容する最大限の範囲において、MSI は、契約、保証、過失
その他の不法行為、法定義務違反またはその他の責任理論に基づくかを
問わず、予見可能か否かにかかわらず、逸失利益、収益、のれん、また
は代替費用を含む（ただしこれらに限らない）特別損害、結果的損害、
信頼損害、間接損害、付随的損害、懲罰的損害または懲戒的損害につい
て、いかなる請求に基づいてもお客様に対して責任を負わないものとし
ます。
12. その他
本利用規約は、抵触法の原則にかかわらず、台湾の法律に準拠し、解釈さ
れるものとします。本イベントおよび本利用規約から生じるすべての紛争
は、台湾・台北の台北地方裁判所が管轄するものとします。管轄裁判所に
より無効と判断された条項は削除され、残りの利用規約は引き続き完全な
効力を有するものとします。MSI が本利用規約に基づくいかなる権利の行
使を怠った場合も、当該権利の放棄とはみなされません。MSI は、合理的
な支配を超える状況に起因する履行不能について責任を負いません。本利
用規約は、お客様から第三者へ譲渡またはその他の方法で移転することは
できず、無断による譲渡はすべて無効となります。本利用規約は、本イベ
ントに関する当事者間の完全な合意を構成し、口頭または書面を問わず、
それ以前のすべての合意、通信、表明または協議に優先するものとしま
す。

MSI 는 2026 년 9 월 30 일까지 이벤트 경품 페이지를 통해 적격 참가자 중
무작위로 추첨된 당첨자를 발표합니다. MSI 는 등록된 배송 주소 확인을
위해 당첨자에게 연락할 수 있으며, 주소가 불완전하거나 잘못된 경우
당첨이 취소될 수 있습니다. 당첨자는 MSI 의 이메일을 수신한 날로부터

무효 처리됩니다. 응모는 반드시 참가자 본인이 직접 해야 합니다. 복수의
이메일 주소, 신원, 계정, 로그인 정보 또는 기타 방법을 통해 규정된 횟수

구독 또는 이와 유사한 명칭의 체크박스를 선택하지 마시기 바랍니다.
6. 참가자 라이선스
응모를 제출하거나 이에 동의함으로써, 귀하는 다음 사항을 인지하고
동의하는 것으로 간주됩니다:
(1) 귀하는 MSI 에 업로드하거나 본 이용약관에 따라 제출한 모든
응모물(""응모물"")의 전부 또는 일부를, 현재 알려져 있거나 향후 개발될
모든 형태, 미디어 또는 기술을 통해, 위에 언급된 마케팅·광고·홍보 활동과
관련하여 사용, 복제, 수정, 각색, 출판, 판매, 양도, 번역, 2 차 저작물 제작,
배포 및 전시할 수 있는 비독점적, 무상, 전 세계적, 영구적, 취소
불가능하며 완전한 재라이선스 부여 권리를 MSI 에 허여합니다.
(2) 귀하는 응모물 및 그 모든 구성 요소에 대한 권리를 소유하거나 이를
통제할 수 있는 권한을 보유합니다.
(3) 귀하는 응모물이 지식재산권, 저작권, 상표권,
퍼블리시티권/프라이버시권, 특허권, 영업 비밀 또는 기밀 유지 의무를
포함한 제 3 자의 권리를 침해하거나 위반하지 않음을 진술하고
보증합니다.
7. 참가자 진술 및 보증
귀하는 다음 사항을 진술하고 보증합니다:
(1) MSI 에 제공하는 모든 정보는 사실에 근거하며, 정확하고, 오해의
소지가 없습니다.
(2) 귀하는 MSI 와 본 계약을 체결하고, 응모물과 관련된 라이선스 부여 및
진술·보증을 이행할 완전한 권리를 보유합니다.
(3) 귀하는 응모물에 포함된 모든 권리(지식재산권 일체를 포함하되 이에
한정되지 않음)의 완전하고 합법적인 소유자입니다.
(4) 귀하는 MSI 가 본 약관에 따라 귀하로부터 부여받은 권리를 행사하는
데 필요한 모든 승인을 취득하고 필요한 비용을 지불하였으며, MSI 가 해당
권리를 행사하기 위해 별도의 권리, 승인 또는 라이선스를 취득하거나
제 3 자에게 추가 비용을 지불할 필요가 없음을 확인하고 보증합니다.
(5) 응모물에 등장하는 모든 개인은 응모물 포함에 대한 완전한 동의를

8. 참가자 면책

절차로부터 발생하는 모든 책임, 손해, 판결, 비용, 경비 및

9. 참가자 확인 및 동의

타이베이 지방법원에서 해결됩니다. 관할 법원에 의해 무효로 판단된

이용약관상의 권리를 행사하지 않더라도 이는 권리 포기로 간주되지

所有相關個人、群體、當事方或場地的必要同意、許可及肖像／外觀授權，使
您得以授予本文所述之權利，包括但不限於 MSI 對參賽內容不受限制地使用、

（6）您具備完整的授權、能力、權力及資格參加本活動，並依據本條款與條件

8. 參與者賠償責任
您應就任何第三方因您實際或涉嫌違反本條款與條件中任何聲明、保證或承諾

承人、受讓人、董事及代理人進行抗辯、賠償，並使其免受任何及一切責任、
損害、判決、費用、支出及費用（包括合理的律師費）的損害。
9. 參與者確認與同意
您特此確認並同意：
（1）MSI 保留以下最終裁量權：

如發生上述任何變更，MSI 將於活動登陸頁面公布修訂後的條款與條件。為免
疑義，在適用情況下，條款與條件的變更不影響在變更前依原條款所下的訂單
或已執行的優惠。"
（2）MSI 對於因獎品及其使用所引起的任何損失、不滿或損害，不承擔任何責

使本條款與條件下任何權利，不應視為放棄該權利。MSI 對於因其合理控制範
圍以外的情況所導致的履行失敗，不承擔任何責任。本條款與條件不得由您轉
讓或以其他方式移轉予任何第三方；一切未經授權的轉讓均屬無效。本條款與

Endereços incompletos ou incorretos poderão resultar na desqualificação do

identidade do participante, além do nome do Evento. Será permitida apenas uma
inscrição por participante. A MSI também utilizará as informações de contato
fornecidas na inscrição para entrar em contato com o participante quando

(5) Este Evento é destinado exclusivamente a consumidores finais elegíveis e não é
válido para empresas. Funcionários da MSI, suas afiliadas, subsidiárias, fabricantes,
parceiros de negócios, distribuidores, atacadistas, revendedores, varejistas ou
agências, bem como seus familiares imediatos, não são elegíveis para participar
deste Evento.
(6) Inscrições automatizadas ou realizadas por robôs, enviadas por indivíduos ou
organizações, serão desqualificadas. A inscrição deverá ser realizada pelo próprio
participante. Qualquer tentativa de um participante de obter mais inscrições do que

https://www.msi.com/page/privacy-policy. A Política de Privacidade da MSI constitui
parte integrante destes Termos e Condições e é aqui incorporada por referência com
plena força e efeito.
5. Assinatura de eDM.
Você poderá ser convidado a se inscrever na lista de e-mails eDM da MSI para
receber novidades sobre produtos ou atualizações sobre os serviços da MSI. Caso
não deseje se inscrever nessa lista, não marque a caixa de seleção de assinatura ou
outra caixa com denominação semelhante.
6. Licença do Participante.
Ao realizar ou concordar com uma inscrição, Você reconhece e concorda com o
seguinte:
(1) Você concede à MSI um direito não exclusivo, isento de royalties, mundial,
perpétuo, irrevogável e totalmente sublicenciável de utilizar, reproduzir, modificar,
adaptar, publicar, vender, ceder, traduzir, criar obras derivadas, distribuir e exibir
qualquer inscrição que Você envie à MSI ou de acordo com estes Termos e Condições
(""Inscrição""), no todo ou em parte, em qualquer formato, mídia ou tecnologia
atualmente conhecida ou desenvolvida futuramente, em relação às atividades de
marketing, publicidade e promoção mencionadas acima.
(2) Você é proprietário ou detém os direitos sobre sua Inscrição e todos os seus
elementos.
(3) Você declara e garante que a Inscrição não infringe nem viola direitos de
terceiros, incluindo, entre outros, direitos de propriedade intelectual, direitos
autorais, marcas registradas, direitos de publicidade/privacidade, patentes, segredos
comerciais ou obrigações de confidencialidade.
7. Declarações e Garantias do Participante.
Você declara e garante que:
(1) todas as informações fornecidas por Você à MSI são verdadeiras, precisas e não
enganosas;
(2) Você tem pleno direito de celebrar este acordo com a MSI e de realizar as
concessões de licença, declarações e garantias relacionadas à Inscrição;
(3) Você é o proprietário pleno e legal de todos os direitos, incluindo, entre outros,
quaisquer direitos de propriedade intelectual relacionados à Inscrição;
(4) Você obteve todas as autorizações necessárias e realizou todos os pagamentos
necessários para que a MSI possa exercer os direitos concedidos por Você,
confirmando e garantindo que a MSI não precisará obter quaisquer outros direitos,
autorizações ou licenças separadamente, nem realizar pagamentos adicionais a
quaisquer partes para exercer os direitos aqui concedidos;
(5) todos os indivíduos presentes na Inscrição forneceram consentimento pleno para
sua inclusão, e Você obteve todos os consentimentos, permissões e autorizações de
imagem/aparência necessários de quaisquer indivíduos, grupos, partes ou locais, de
modo que possa conceder os direitos aqui estabelecidos, incluindo, entre outros, o
direito de utilizar, exibir, distribuir, explorar, reproduzir e/ou editar, sem limitação ou
restrição, a Inscrição;
(6) Você tem plena autoridade, capacidade, poder e direito de se inscrever neste
Evento e de realizar a concessão de licença, declarações e garantias exigidas por
estes Termos e Condições; e
(7) Você cumpriu todas as leis aplicáveis ao se inscrever neste Evento.
8. Indenização pelo Participante.
Você deverá defender, indenizar e isentar a MSI, suas afiliadas, sucessores,
cessionários, diretores e agentes de quaisquer responsabilidades, danos, sentenças,
custos, despesas e honorários, incluindo honorários advocatícios razoáveis,
resultantes de quaisquer reclamações, investigações, litígios ou outras ações legais
ou administrativas de terceiros decorrentes ou relacionadas a qualquer violação real
ou alegada por Você de quaisquer declarações, garantias ou compromissos previstos
nestes Termos e Condições.
9. Reconhecimento e Consentimento do Participante.
Você reconhece e concorda que:
(1) A MSI reserva-se o direito exclusivo e discricionário:
a) de determinar, em caráter final e conclusivo, se um participante cumpriu de boa-fé
os requisitos do Evento. A título de exemplo, sem limitar quaisquer outros termos, a
MSI poderá desqualificar participantes:
a) se a inscrição no Evento ou o registro do produto estiver incompleto;
b) se os requisitos de elegibilidade do Evento, como inscrição dentro do prazo, linha
de produtos aplicável ou restrições regionais, não forem atendidos;
c) se os documentos fornecidos forem alterados, falsificados, fraudulentos, enviados
incorretamente ou inválidos;
d) se códigos automatizados, scripts, plugins ou outros meios forem utilizados para
realizar ou concluir a inscrição no Evento;
e) se o participante não tiver capacidade legal para se inscrever neste Evento; ou
f) se atos criminosos ou ilegais forem cometidos ou supostamente cometidos para
participar deste Evento;
b) de substituir o prêmio por itens de valor semelhante sem aviso prévio;
c) de alterar, excluir ou acrescentar quaisquer destes Termos e Condições, desde que
haja motivo válido, entendido como:
− alteração das leis que regem as regras e a organização do Evento, afetando os
direitos e obrigações da MSI e dos participantes;
− extensão ou redução da duração do Evento;
− alteração na forma de realização do Evento por motivos técnicos, tecnológicos ou
comerciais.
Em caso de qualquer alteração, os Termos e Condições revisados serão publicados
pela MSI na página do Evento. Para evitar dúvidas, quando aplicável, as alterações
nos Termos e Condições não afetarão pedidos realizados ou ofertas implementadas
de acordo com os Termos e Condições vigentes antes da alteração."
(2) A MSI não é responsável e não assume qualquer responsabilidade perante
qualquer pessoa por quaisquer perdas, insatisfações ou danos decorrentes do
prêmio ou de sua utilização. Os vencedores não deverão apresentar quaisquer
reclamações contra a MSI.
(3) A MSI isenta-se de toda responsabilidade por quaisquer atrasos, entregas
incorretas, perdas ou falhas na entrega da notificação de premiação ou de quaisquer
prêmios devido a erros, falhas ou mau funcionamento de qualquer natureza
relacionados a logística, sistemas mecânicos, tecnologia, eletrônicos, comunicações,
telefonia, computadores, hardware, internet ou software. Nessa eventualidade, o
vencedor renuncia incondicionalmente ao seu direito ao prêmio e a qualquer
compensação relacionada.
10. Exclusão de Garantias da MSI.
O(S) PRÊMIO(S) DA MSI É/SÃO FORNECIDO(S) ""NO ESTADO EM QUE SE
ENCONTRA(M)"", SEM QUALQUER GARANTIA EXPRESSA OU IMPLÍCITA DE
QUALQUER TIPO, INCLUINDO GARANTIAS DE COMERCIALIZAÇÃO, NÃO VIOLAÇÃO
OU ADEQUAÇÃO A UMA FINALIDADE ESPECÍFICA."
"11. Limitação de Responsabilidade.
NA MÁXIMA EXTENSÃO PERMITIDA PELAS LEIS APLICÁVEIS, A MSI NÃO SERÁ
RESPONSÁVEL PERANTE VOCÊ POR QUALQUER RECLAMAÇÃO,
INDEPENDENTEMENTE DA TEORIA DE RESPONSABILIDADE, SEJA ELA BASEADA EM
PRINCÍPIOS CONTRATUAIS, DE GARANTIA, NEGLIGÊNCIA OU OUTRO ATO ILÍCITO,
VIOLAÇÃO DE QUALQUER DEVER LEGAL OU DE OUTRA NATUREZA, POR QUAISQUER
DANOS ESPECIAIS, CONSEQUENTES, DE CONFIANÇA, INDIRETOS, INCIDENTAIS,
PUNITIVOS OU EXEMPLARES, PREVISÍVEIS OU NÃO, INCLUINDO, ENTRE OUTROS,
LUCROS CESSANTES, PERDA DE RECEITA, PERDA DE FUNDO DE COMÉRCIO OU
CUSTOS DE SUBSTITUIÇÃO.
12. Disposições Gerais.
Estes Termos e Condições são regidos e interpretados de acordo com as leis de
Taiwan, independentemente dos princípios relacionados a conflitos de leis, e todas
as disputas decorrentes do Evento e destes Termos serão julgadas pelo Tribunal
Distrital de Taipei, em Taipei, Taiwan.
Qualquer disposição considerada inválida por um tribunal competente será
suprimida, permanecendo os demais Termos e Condições em pleno vigor e efeito. A
omissão da MSI em fazer cumprir qualquer direito previsto nestes Termos e
Condições não será considerada uma renúncia a esse direito.
A MSI não será responsável por qualquer falha no cumprimento de suas obrigações
decorrente de circunstâncias fora de seu controle razoável.
Estes Termos e Condições não poderão ser cedidos ou transferidos por Você a
terceiros. Todas as cessões não autorizadas serão consideradas nulas e sem efeito.
Estes Termos e Condições constituem o acordo integral entre as partes em relação ao
Evento e substituem quaisquer acordos, comunicações, declarações ou discussões
anteriores, sejam elas verbais ou de qualquer outra natureza."
A MSI anunciará os vencedores, sorteados aleatoriamente entre os participantes
elegíveis, na página do sorteio do Evento (https://gleam.io/GcEwF/excellencerefined-giveaway) até 30 de setembro de 2026. A MSI poderá entrar em contato com
Você para confirmar o endereço cadastrado. Endereços de entrega incompletos ou
incorretos poderão resultar na desqualificação do vencedor. O vencedor deverá
responder ao e-mail da MSI dentro de sete (7) dias corridos. Caso não responda
dentro desse prazo, poderá ser considerado como tendo renunciado ao prêmio, e um
novo vencedor será selecionado pela MSI. A MSI terá total discricionariedade para
determinar tais questões.
