Montblanc – Collection Princesse Grace de Monaco Sweepstake II (The LA Sweepstake) Rules
By completing this form with my personal details, I hereby expressly accept the following terms and conditions, which I have read and understood:
1. Prize: Invitation for winner and guest to attend the Montblanc LA Oscars * Gala to be held February 25, 2012 in Los Angeles CA (hereafter the “Event”), including round trip economy class airfare or winner and guest from hub city closest to winner’s domicile to Los Angeles, lodging in Hollywood, CA for two (2) nights, and guided city tour of Hollywood. Limit: one (1) prize per winner. Prize is non-transferable and no substitution will be made except as provided herein at Montblanc's sole discretion. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning an Invitation depend on the number of eligible entries received during the Registration Period (see below).
2. Eligibility:The Montblanc – Collection Princesse Grace de Monaco Sweepstake II (the “Sweepstake”) is open to any individual who is at least eighteen (18) years old at the time of entry, to the exclusion of employees of Montblanc and/or its related companies as well as their immediate family (spouse, parents, siblings and children) and household members of each such employee. Winning the invitation is contingent upon fulfilling all requirementsset forth herein.
3. Sponsor:the Sweepstake is organised by Montblanc International GmbH, Hellgrundweg 100, 22525 Hamburg, Germany ("Montblanc"). Montblanc reserves the right to limit or discontinue this Sweepstake at any time and without notification at its discretion.
4. Timing & Registration: Registration for the Sweepstake begins on December 16, 2011 at 12:00 pm Central European Time (CET) and ends January 31st, 2012 at 4:00 p.m. CET (the “Registration Period”). Montblanc's computer clock is the official time keeping device for the Sweepstake.
During the Registration Period, visit http://www.montblanc-tribute-to-grace.com and follow instructions to complete the registration. Complete and submit the registration. Multiple registrations by the same entrant will not be accepted and will lead to disqualification of the entrant. 5. Drawing: Montblanc's decisions as to the administration and operation of the Sweepstake and the selection of the potential winner are final and binding. Montblanc will randomly select the potential Sweepstake winner from all eligible entries received during the Registration Period, on or around January 31st, 2012. The potential winner will be notified by mail, email or phone within 2 (two) days after the completion of the drawing. The winner will be required to sign and return to Montblanc, within one (1) day of the date notice or attempted notice is sent, a statement confirming his/her willingness and that of their guest to accept the invitation, attend the Event in Los Angeles, CA in February and comply with these terms and conditions in order to claim his/her prize. It is understood by winner that winner and guest will also be required to comply with further elements regarding the arrangements for the trip to the Event all of which shall be supplied to winner upon his/her attendance acceptance.
Furthermore, the potential winner and guest must have their backgrounds checked and consequently must authorize Montblanc to perform said background checks. If a potential winner and/or guest cannot be contacted, fails to comply with these terms and conditions within the required time period or fails to pass the background check of Montblanc at Montblanc's discretion, then the potential winner forfeits the prize. In cases where the only “failing” is that the guest has failed to pass the background check then the potential winner will have one opportunity to select another guest. The potential winner and guest must continue to comply with all these terms and conditions, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Montblanc will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only five(5) alternate drawings will be held after which the prize will not be awarded.
6. Release: By receipt of the prize, the winner and guest agree to release and hold harmless Montblanc and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstake or travel to, attendance to and travel from the Event.
7. Publicity:Except where prohibited, participation in the Sweepstake constitutes winner's and the winner’s guest’s consent to Montblanc's and its agents' use of their names, likenesses, photographs, voices, and opinions for promotional purposes in any media, worldwide, without further payment or consideration.
8. General Conditions: Montblanc reserves the right to cancel, suspend and/or modify the Sweepstake, or any part of it, if any fraud, technical failures or any other factor beyond Montblanc's reasonable control impairs the integrity or proper functioning of the Sweepstake, as determined by Montblanc in its sole discretion. Montblanc reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstake or to be acting in violation of these terms and conditions or in an unsportsmanlike or disruptive manner.
9. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstake; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstake; (4) technical or human error which may occur in the administration of the Sweepstake or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstake or receipt or use or misuse of any prize. No more than the stated number of prizes will be awarded.
10. Disputes:Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this sweepstake or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the competent Courts in Hamburg, Germany; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstake, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions, or the rights and obligations of the entrant and Montblanc in connection with the Sweepstake, shall be governed by, and construed in accordance with, the laws of Germany without giving effect to any choice of law or conflict of law rules.
