Terms and conditions for the Vodafone McLaren Mercedes Competition (the "Prize Draw")
By entering the Prize Draw, you agree to be bound by these terms and conditions (these "Terms and Conditions"). Promotional materials relating to the Prize Draw, including all information on how to enter the Prize Draw, also form part of these Terms and Conditions. In the event of any conflict between any terms referred to in such promotional materials and these Terms and Conditions, these Terms and Conditions take precedence.
1.The promoter of this Prize Draw is Team McLaren Limited ("McLaren") (company number 00772700) whose address is McLaren Technology Centre, Chertsey Road, Woking, Surrey, GU21 4YH, England.
2.Participants must be at least 16 years old. Employees of McLaren, its group companies, agents or affiliated companies ("McLaren Companies"), and their immediate families and members of their households and anyone otherwise connected with operation or fulfilment of the Prize Draw are not eligible to take part. McLaren reserves the right to require participants to prove that they are eligible. If the winner of the Prize Draw is found to be ineligible, McLaren reserves the right to award the prize to another participant.
3.The Prize Draw commences on 17th June 2011 and all entries must be received by 23:59 GMT on the closing date of 10 July 2011 ("Closing Date").
4.The Prize Draw will operate on the McLarenshop website at the following URL address: www.mclarenshop.com/eshopcompetitionpage(the "Website"). Entry to the Prize Draw is free; no purchase is necessary. To enter the Prize Draw you must enter your title, name, email address, date of birth and country number the relevant section of the Website.
5.The prize to be won is the opportunity for 1 winner to win the genuine race gloves worn by Lewis Hamilton over the race weekend at the 2011 Santander Silverstone Grand Prix. The gloves will be presented in a frame with a signed certificate of authenticity.
6.The winner of the Prize Draw will be the first name chosen at random from all correct, complete, eligible, properly submitted entries received before the Closing Date. The winner will be notified no later than 12:00 GMT on 15 July 2011 by email address included in their entry. The winner may be required to submit valid identification before receiving their prize. If McLaren is unable to contact the winner through the contact details provided with their entry, or the winner is unable to accept the prize on 22 July 2011 or such other date as specified by McLaren, McLaren reserves the right to award the prize to another participant.
7.By entering the Prize Draw, you consent that your e-mail address and other contact details will be automatically added to the McLaren database so that you receive the McLaren newsletter (the "Newsletter") packed with the latest McLaren information. Please note that you will be given the opportunity to unsubscribe from the e-mail newsletter at any time via the unsubscribe message in the e-mail. All information concerning you which is personal data and which is processed by McLaren for the purpose of data protection legislation for the time being in force shall be processed only in accordance with such legislation. By entering the Prize Draw, you consent to the processing and disclosure of such data by McLaren, both inside and where necessary, outside the European Economic Area for the purposes of processing such data for Prize Draw, Newsletter purposes and as otherwise stated herein.
8.McLaren will collect and process your personal information in order to conduct the Prize Draw and it will be shared with McLaren's agents to the extent necessary for the prize to be delivered to the winner. If you do not provide any of the information requested when entering the Prize Draw, you may not take part in the Prize Draw.
9.By entering the Prize Draw, you agree, where you win, to have your name and photograph featured in publicity materials relating to the Prize Draw without further reference, payment or other compensation by or from us.
10.McLaren reserves the right to modify, cancel, terminate or suspend the Prize Draw in whole or in part, at its sole discretion, if it believes the Prize Draw is not capable of being conducted as specified within these Terms and Conditions or in the event of a virus, a computer bug or unauthorised human intervention or any other cause that is beyond the reasonable control of McLaren that could corrupt or affect the administration, security, impartiality or normal course of the Prize Draw. Neither McLaren nor the McLaren Companies are responsible for any condition, circumstances, losses, failures or delays caused by events beyond its or their control such as (but not limited to) the acts or defaults of its suppliers.
11.Any illegible, incomplete or fraudulent entries will be rejected. Any participant who enters or attempts to enter the Prize Draw in a manner, which in McLaren's reasonable determination is contrary to these Terms and Conditions or by its nature is unjust to other entrants (including without limitation tampering with the operation of the Prize Draw, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other entrants or McLaren and/or any of its agents or representatives) may be rejected from the Prize Draw at McLaren's sole discretion. Furthermore, where such actions have significantly impaired the Prize Draw, McLaren may, at its sole discretion, add further stages to the Prize Draw as it deems reasonably necessary in order to resolve any problems arising as a result of such actions.
12.By participating in the Prize Draw, you agree to release and hold McLaren, the McLaren Companies, together with their respective employees, officers, directors, agents and representatives, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with participating in the Prize Draw or resulting from your acceptance or use of the prize, provided that nothing in these Terms and Conditions shall in any way limit McLaren's liability for death or personal injury caused by its negligence or for any other matter where liability may not as a matter of law be limited.
13.All decisions of McLaren in relation to the Prize Draw are final in all matters and McLaren will not enter into any correspondence with participants other than the winner/s.
14.These Terms and Conditions are governed by English law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Prize Draw or these Terms and Conditions.
