Kinguin’s contest with Gotaga
1. These terms and conditions define the rules for participation in an online contest (the "Contest") run worldwide through https://deal.kinguin.net/fr/gotaga-new (the “Website”).
2. The Contest is organized by Kinguin Digital Limited with its registered seat in 8/F On Hing Building 1 On Hing Terrace, Central Hong Kong ("Kinguin").
3. The Contest shall start on 05/01/2022 at 09:00 CET and shall terminate on 17/01/2022 at 23:59 CET (the “Contest Termination Date”), (the “Contest Period”).
4. Each participant of the Contest (the "Participant") must be at least 18 years old.
5.The Contest is not open to employees of Kinguin or Kinguin’s associated entities’ employees or members of their families, which include spouses, grandparents, parents, children and grandchildren, whether by marriage, past marriages or adoption or other family extensions.
6. By entering the Contest, the Participant confirms that he/she agrees with the rules described herein.
7. To be eligible to win the prize (the ‘’Prize’’) the Participant needs to gather the promotional elements in the form of Entry points collected on the Gleam platform (the “Entry point”) during the Promotion Period.
8. Participants may gather Entry points by participating in the particular activities provided by the Gleam platform.
9. The Participant may follow current number of Entry points by entering the Gleam platform.
10. Within 7 (seven) days after the Contest Termination Date, a jury consisting of two (2) Kinguin’s employees of Kinguin’s choice (the “Jury”) shall proclaim one (1) winner of the Contest Prize (the “Winner”), who have gathered the biggest amount of Entry points. The Jury shall be the only one empowered to choose the Winner of the Contest.
11. The Prizes shall be distributed among top 1 scorer as follows:
1st Prize for the largest number of Entry points gathered during the Promotion Period: "Game of your choice!",
In case the exact same number of Entry points eligible for winning the Prize is collected by more than 1 Participant, Kinguin reserves the right to grant the Prize to the Participant who has gathered the largest amount of Entry points faster during the Promotion Period.
12. The Contest Prizes shall be funded by Kinguin.
13. The Contest Prize cannot be exchanged for the equivalent in cash, or prizes of another kind.
14. The Winners will be announced through:
a) the Gleam platform 7 days from the Promotion Termination Date.
b) Kinguin’s social media posts within 7 days from the Promotion Termination Date.
15. The Participant will be notified through an email message, provided during the log-in to the Gleam Platform, if he/she won the prize (the “Winner E-mail”).
16. The prize will be delivered to the Winner E-mail within 10 days from the Promotion Termination Date.
17. When it is discovered that the Winner is a person who does not meet the
conditions specified in these Terms and Conditions, the Participant, who have won the Promotion, shall be denied the right to the Prize. In the case of disclosure of this fact after receival of the Prize, the Participant will be obliged to return the Prize and will bear any costs incurred in relation with such a return.
18. Kinguin reserves the right to remove a Participant from the Promotion, in case of a doubt as to the veracity of his/her profile or in case of any breach by the Participant of these Terms and Conditions or any rights of third parties.
19. To the fullest extent permitted by law, Kinguin shall not be liable for any third party's performance or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the Promotion.
20. Kinguin reserve the right to suspend, change or cancel this Promotion at any time if circumstances arise outside of its control.
21. Kinguin shall have the right, at its sole discretion and at any time, to change or modify these Terms and Conditions, such change shall be effective immediately upon posting on the Website.
22. In relation to the Contest Kinguin is a personal data controller (the “Controller”). Personal data of Participants is processed in order to:
a) allow the participation in the Contest;
b) verify if the Participant meets the requirements of the Contest;
c) communicate with the Participant;
d) deliver the Contest Prize or the Daily Prize to the Participant;
e) for the marketing purposes of the Controller, as well as in connection with the legitimate interest pursued by the Controller, namely marketing of its own products and services.
23. Personal data will be processed by the Controller during the implementation of the above goals. Providing such personal data is voluntary but it is also a requirement necessary to enter into the Promotion. The personal data will not be processed in an automated way.
24. Each Participant has the right to request the access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing or to raise an objection before applicable authorities in relation to such processing.
25.Unless stated otherwise in the relevant regulation or laws each Winner is
solely responsible for reporting and paying any and all applicable taxes related to the Contest Prize.
26. These Terms and Conditions are governed by the laws of Hong Kong. Any disputes shall be brought in the courts of Hong Kong.
