GENERAL TERMS AND CONDITIONS - "HEAD TENNIS SENSOR SWEEPSTAKE"
I. DESCRIPTION "HEAD TENNIS SENSOR SWEEPSTAKE"
“HEAD Tennis Sensor Sweepstake” (“Sweepstake”) is a sweepstake organised by HEAD Sport GmbH, Wuhrkopfweg 1, 6921 Kennelbach, Austria ("HEAD") that runs from 04th of December until the 16th of January 2018 (“Term”).
You have to accept these terms and conditions in order participate in this Sweepstake.
II.SWEEPSTAKE PROCESS AND SELECTION OF WINNERS
Notwithstanding clause II. 2 of these general terms and conditions, anyone above the age of 16 can register for the Sweepstake.
The following people are excluded from participation in the Sweepstake:
HEAD employees and their families, and the employees and families of partners of HEAD, who are involved with the design, organisation and implementation of this Sweepstake, are excluded from participation in the Sweepstake. Also Italian and Canadian residents are not allowed to participate in this Sweepstake due to local restrictions.
Registration can be accomplished as follows:
On the website www.head.com/sensor (“Website”) the registration form has to be completed, by providing all required personal details such as title, name, date of birth, email, address, country and language. By submitting the registration you automatically take part in the Sweepstake.
During the Term of this Sweepstake one winner will be randomly drawn each Monday.
HEAD will inform the winners via the email address provided by him/her and any information required for HEAD to conduct this Sweepstake (e.g. delivery address of winner) shall be also provided via email.
This Sweepstake is a public competition. HEAD will also report publicly about the Sweepstake.
Once the winner is informed by HEAD, she/he will have to confirm that she/he accepts the price within 10 calendar days. If the winner does not confirm within this term, the information will be without effect and the prize will be withdrawn.
The decisions of HEAD are binding in all aspects of the Sweepstake. There is no entitlement to compensation for any costs arising or entitlement to payment of a cash prize.
It is not possible to cash the prizes. HEAD bears the cost of the prizes and its delivery to the winner by courier/mail. However, all other potential costs related to winning a price, such as any taxes or duties shall be borne by the winner.
III. DATA PROTECTION
HEAD hereby provides notice that your personal details will be collected during registration. By registration for this Sweepstake and accepting these terms and conditions you consents to the processing of your personal data (title, name, date of birth, email, country and language by all members of the Head Group (https://www.head.com/en-GB/about/locations/) inside and outside of the European Union (Controller: Head Sport GmbH, Wuhrkopfweg 1, 6921 Kennelbach, Austria).
Your personal data will solely be used for the purpose of organising, conducting and promoting the Sweepstake.
Your data will only be transmitted to official partners inside and outside of the European Union in order to support to performance of the competition (e.g. carrier for delivery of prize).
You have the right to information over your personal data stored, deletion and correction of the data saved concerning your person, withdraw your consent to processing of your personal data, data portability, object to processing of your personal data, to lodge a complaint with the competent supervisory authority. To exercise that right please send an inquiry to privacy@head.com.
IV. LIABILITY
Due to the technical particularities and properties of the Internet or World Wide Web, it is not possible to exclude technical glitches altogether. HEAD assumes no liability and guarantee for permanent availability and/or trouble-free function of the Website.
HEAD does not accept any liability for
errors in the submission and transmission of registrations;
registrations that are lost, arrive late, are illegible, incomplete, damaged, or invalid in any other way;
cancellation of the Sweepstake as a result of force majeure or due to an official decree for security, legal or other reasons is not attributable to HEAD;
any damage that might ensue from technical malfunctioning in connection with the accessibility and availability of the Website;
indirect or consequential damages, nor for profit or data lost, for whatever reason.
In the case, that in spite of the regulations stated above, it should happen that HEAD is legally liable, his liability is in any case restricted to damages resulting from wilful or culpable negligence. Liability for damage resulting from non-culpable negligence is excluded in any case.
V. PLACE OF JURISDICTION AND APPLICABLE LAW
These general terms and conditions are exclusively subject to the laws of the Republic of Austria, provided this does not contravene any compulsory legislation.
Any legal issues that arise in connection with the performance of and participation in this Sweepstake will exclusively be dealt with by the relevant courts in the place of jurisdiction of HEAD.
If any clauses of these terms and conditions should prove wholly or partially invalid, the validity of the remaining clauses will not be affected.
