Terms Of Use
1. Promotion
These Terms and Conditions apply to the Forum Snowboards Europe « FAMOUS – Join The Team” which consists of two different forms of contests (hereinafter Promotion(1) and Promotion(2)). These are only available at the following address: www.forumfamous.com and are organized by Burton Sportartikel GmbH, Hallerstrasse 111, A-6020 Innsbruck, Austria (hereinafter: “Forum Europe”). Participation in these Promotions means acceptance of these terms and conditions.
2. Participation
The Promotions are online contests only. Participation in these Promotions takes place exclusively online through the application on www.forumfamous.comand is voluntary and free of charge. Employees of Burton Sportartikel GmbH, project partners and their families are excluded from participation. To enter, the Participant must sign up with his / her private account on Facebook (Facebook Connect) on www.forumfamous.com. Eligible Participants must have a Facebook profile that complies with the Statement of Rights and Responsibilities (in particular point 4). If there is a conflict between the FAMOUS Terms and Conditions and Facebook’s terms and conditions, guidelines and privacy policies then as between the participant and Burton Snowboards, FAMOUS Terms and Conditions will prevail.
Forum Europe reserves the right to exclude individuals from participating in Promotion(1) and (2). False or incomplete entries are not accepted. Every user can only participate once in Promotion (1) and multiple times in Promotion(2).
Facebook Users must register for the game through Facebook Connect in order to be eligible to win.
The Promotions are available in all European countries. The participating countries will be determined when the competition entries are processed. A European postal address is required; no post office boxes accepted. Participants from non-European countries are not eligible to participate.
3. Duration
FAMOUS runs over a total length of five weeks, from 02-02-2012 to 22-03-2012.
Every Promotion(1) starts with the release of the new episode each week and runs until the release of the next episode the following week. Promotion(2) starts with the release of episode six on 01-03-2012 at 12:00pm CET and closes at 11:59am CET on 22–03-2012.
4. Contest
FAMOUS – Join The Team consists of two different forms of contests: There are five Promotions(1). Each of he five Promotions(1) starts running with the release of a new episode and ends with the release oft he next episode. To enter each of these five Promotions(1) the Participant needs to click on the link provided every week for the current episode. One prize per episode will be drawn at random from among all participants of Promotion(1).
Promotion(2) starts after all six episodes have been successfully completed by the Participant. To enter Promotion(2), the Participant must upload a video to an online platform (e.g. YouTube or Vimeo). This video must show the participant snowboarding. The link of the video must then be sent to an email address which will be revealed to everyone that has successfully completed all six episodes. Sending the video link, entering the full name, email address and country in the boxes provided, ticking the box to agree to the Terms and Conditions and clicking « Enter to win! » makes Participants entering the video contest. The contest will close at 11:59am CET on 22–03-2012, entries received after 11:59am CET on 22–03-2012 will not be accepted.
To be in with a chance of winning, the Participant’s video needs to be voted for by a group of selected judges consisting of the team manager and the Europe team at Forum Snowboards..
5. Prize & Notification
Winners of Promotion(1) and Promotion(2) will be notified via email. Participants declare their agreement with this form of notification and are furthermore responsible for ensuring the correctness of their email address. Prizes will be shipped by mail; winners agree to state their address per mail in order to receive the goods.
If the winners of either Promotion do not respond to the prize notification within 5 days, his or her entitlement to the prize will be forfeited and another winner will be selected. The prize may not be exchanged for any other prizes or services or for cash. Any recourse to courts of law is excluded. Forum Europe reserves the right, due to availability to change the type of prize in the course of Promotion(1) and (2) or to replace the prizes with a different prize of equal value. Under no circumstances shall this alternative lead to replacement or refund.
Only the prize listed below will be awarded in these Promotions:
Promotion(1)
There is one winner after each episode who will receive one package including all featured products of the respective episode. These featured products change every week and can be viewed on the left box at the bottom of www.forumfamous.com.
Promotion(2)
The Participant with most votes will win a 1-year sponsorship deal with Forum Snowboards consisting of a professional rider set up (two Forum snowboards, one pair of Forum bindings, one pair of Forum snowboard boots, one Special Blend or Foursquare outfit with one jacket and one pair of pants, a pair of Anon goggles, a Red helmet and Red back protector, two palettes of Rockstar Energy drink) and a three days trip (including paid travel costs of up to 400Euro, 3 nights accommodation and 3 days lift pass) to the Spring Session at Laax in spring 2012 (dates to be announced) with the Forum Europe team riders.
Selection of hotel are solely within Forum Europe’s discretion. Meals, gratuities, luggage fees, incidental hotel charges and any other travel-related expenses not specified herein are the sole responsibility of the winner. All travel must be taken on dates specified or prize will be forfeited and may be awarded to an alternate; no alternative travel dates are available. Exact travel dates and arrangements subject to availability.
Winner must be sixteen (16) years of age or older and must have all necessary identification and/or travel documents (e.g. a valid passport, etc.), required for travel.
6. General
By accepting prize, winner accepts the inherently dangerous nature and risk in air travel, snowboarding, and the travel and activities associated with it including personal injury and/or death, acknowledges that his/her participation in the prize event is voluntary, acknowledges that there are natural factors and occurrences which may impact on or affect the safety of the activities he/she is participating in and he/she assumes the risk of such factors and occurrences and agrees that to the extent permissible by law, promotional parties shall not be in any way responsible for any resulting injury and/or death.
If, for any reason, Promotion(1) and Promotion(2) cannot be run as planned, or infection by computer viruses or bugs, tampering, unauthorized intervention, fraud, actions by Participants, technical failures, or any other causes that corrupt or compromise the administration, security, fairness, integrity, or proper conduct of the Promotion(1) and (2), Forum Europe reserves the right at its sole discretion to disqualify any entry or entrant and/or to cancel, terminate, modify, or suspend the Promotion(1) and(2), and, at its sole discretion, to award a prize from among all eligible non-suspect entries validly received prior to the action requiring such modification. Forum Europe is not responsible for network, computer hardware or software jamming or outages of any nature that restrict, delay or cause the loss of Participant forms or other data.
Forum Europe reserves the right to change the Terms and Conditions, prizes, definitions or other information, or to cancel the Promotion(1) and (2) at any time without prior notice. By registering, Participants agree that the Promotion(1) and (2) is governed by the laws of Austria, without regard to choice-of-law principles to the contrary, and agree to jurisdiction of the courts of Innsbruck for the resolution of all claims and disputes. All decisions issued by Forum Europe regarding these Promotion(1) and (2) shall be final and are not subject to appeal.
7. Collection and Use of Personal Data
By clicking agreement to the official Terms and Conditions, the Participant authorizes the use and collection of his or her personal data for the purpose as follows. All Participants agree that their information (Facebook ID, name, address, email address, profile photo) will be used for the drawing and for marketing purposes. This agreement can be revoked at any time by email (forumfamous@theprogram.eu.com).
8. Publicity Release

By providing a video, Participants entitle Forum Europe a non-exclusive, 10 year time-limited, materially and territorially unrestricted use of the videos; especially to copy, distribute, edit, exhibit, display and publish them in all currently known or emerging media in the future. The grant of rights is free of charge.
In case of winning, Participants explicitly agree with the unrestricted publication of their names and profile pictures online and in all releases (e.g. press releases) that are associated with the Promotion(1) and Promotion(2). Winners will be available for interviews and will provide to Forum Europe photographs of their collection of the prize for the purpose of publication.
All content on www.forumfamous.com is provided by Forum Snowboards. Therefore, please direct all inquiries, comments and complaints regarding this Promotion to forumfamous@theprogram.eu.com and not to Facebook.
