Longines FEI My Dream Jump challenge (the “Competition”) – Terms and Conditions
1. Introduction
1.1 Any person who enters the Competition shall be referred to as a ”Participant” and any file submitted in connection with the Competition shall be referred to as a “Design”.
1.2 By entering the Competition you are deemed to have accepted these Terms and Conditions.
1.3 The organiser of the Competition is the Fédération Equestre Internationale (“FEI”).
1.4 No entry fee is required.
1.5 The language of the Competition is English.
2. Closing Date
2.1 The Competition will open for entries on 1 September and will close on 9 October 2022 (the “Closing Date”).
2.2 Entries received after the Closing Date will not be accepted.
2.3 Proof of entry is not proof of receipt.
2.4 The shortlist will be announced on 24 October and the voting phase shall start on the same date and continue until 13 November 2022. The FEI may change or extend the voting phase at its sole discretion.
3. Entry details / Design submissions
3.1 The Competition is open to all persons, regardless of age, subject to the limitations set out below.
3.2 Participants under the age of 18 must have a parent or legal guardian’s permission to enter.
3.3 All Competition entries must be submitted through https://mydreamjump.fei.org for this purpose. Exceptionally, designs may be sent by postal mail to “My Dream Jump Competition, HM King Hussein I Building, Chemin de la Joliette 8, CH-1006 Lausanne, Switzerland”.
3.4 All Designs submitted via https://mydreamjump.fei.org must be uploaded as, PDF or JPEG files of maximum 10 MB.
3.5 The Design can be any form of visual representation such as, but not limited to, a drawing, painting, photograph or collage.
3.6 The FEI reserves the right to examine the Design in order to confirm compliance with these Terms and Conditions.
3.7 Entries may be submitted in black and white or in colour.
3.8 The Design, in its entirety, must be a single work of original material made by the Participant. By entering the Competition, each Participant represents, acknowledges, and warrants that the submitted Design is an original work created solely by the Participant, that the Design does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, that no other party has any right, title, claim, or interest in the Design and that each Participant has the right, authority and capacity to make any assignments or grant any licenses in relation to the submitted Design to the FEI as required by Section 7.2 below.
3.9 Participants may not enter a Design that has been published elsewhere or has won a prize in any other related competition.
3.10 The FEI reserves the right to verify the validity and originality of any entry and/or Participant (including the identity and address of a Participant) and to disqualify any Participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the FEI to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Categories
4.1 The following is the list of the Competition categories:
Global: The Design with the highest number of “likes”
(b) Creativity: The most creative Design
(c) Elegance: The most elegant Design
5. Prizes and judging
5.1 Once the submission phase is over (i.e. Closing date), a Jury composed by representatives of Longines and the FEI, a selected Athlete and a course designer will make a pre-selection of the designs that will, ultimately, be posted on the official FEI’s Instagram channel, FEI global, and submitted for a vote by the fans (general public).
5.2 Only those fans with an Instagram profile will be able to vote (by “Liking”) for the pre-selected design(s) of their choice. In order for the vote to be valid, the fans will be requested to first “follow” the official FEI’s Instagram profile.
5.3 Once the voting phase is over, the Design with the highest number of “likes” from those posted in the official FEI’s Instagram channel will be declared the winner of the “Global” category.
5.4 The FEI and Longines may, but shall not be obliged to, publish a list with the pre-selected Designs and/or Participants. The decision of the Jury is final and not subject to appeal.
5.5 The Jury will decide and declare the winning Design for both the “Creativity” and “Elegance” category from all submitted Designs. The decision of the Jury is final and not subject to appeal.
5.6 All Participants will take part in a draw to win a FEI.tv annual subscription. There are five (5) subscriptions to be won. The five (5) winners will be contacted via email with instructions on how to activate their subscription.
5.7 The winners of the “Creativity” and “Elegance” category will receive one (1) “Longines” give-away kit.
5.8 The winner of the Longines FEI My Dream Jump challenge (i.e. “Global” category) will win a free trip to the FEI Jumping World Cup Final 2023 in Omaha, USA, plus one (1) Longines watch (“the Prize”). The trip includes return airfare (economy class), three (3) nights accommodation (including breakfast) in a preselected hotel and event tickets for the winner and one (1) companion (If the winner is a minor then the companion must be his/her legal guardian). In addition, Longines will use the winning Design as the basis/inspiration for the production of one (1) of the obstacles that could potentially be placed in the competition arena during the Longines FEI Jumping World Cup™ Final 2023 in Omaha from 4 to 8 April 2023 (“the Event”). The obstacle may also be produced as a merchandise item and sold at venues during equestrian events and used for venue dressing and/or just as a decorative element at venues.
5.9 Should the winner of the Global category, for any reason, not be able to attend the Event, the FEI reserves the right to award the Prize to another participant on a merit-based criteria.
5.10 There may be variations in the final design produced by Longines for the obstacle from the winning Design in order to accommodate production and/or legal requirements. The FEI and/or Longines reserve the right, at their sole discretion, to decide whether the obstacle is finally produced or not.
5.11 The winner(s) of all three categories, will be contacted shortly after the voting phase is over by email via the email address provided for confirmation of their identity. Furthermore, the winner will be informed of the following steps to be taken with regard to the next phases of the Competition. If there is no answer within 48 hours of the email having been sent, the FEI reserves the right to declare a new winner for each of the categories. With regard to the “Global” category, the new winner will be the pre-selected Design with the second highest number of “likes” from the official FEI’s Instagram channel. Should the new winner not answer within 48 hours, then the third most voted Design would be declared winner, and so on.
5.12 The winner of the “Global” Category releases the FEI from any responsibility or liability in case, for any reason, (i) the obstacle is not produced, (ii) the obstacle is not placed in the competition arena of the Longines FEI Jumping World CupTM Final 2023, (iii) the obstacle produced does not look exactly the same or is not similar to the winning Design.
5.13 By participating in the Competition and accepting the Prize, the winner agrees to participate in some activities (i.e. interviews, promotional videos, etc) with the FEI for content creation purposes related to the Competition and/or the Event.
6. Participants’ responsibilities
6.1 Each Participant is responsible for informing the FEI of any changes to the information entered, in particular of any change of the contact details.
6.2 Entrants shall not submit any Design that can be considered obscene, vulgar, pornographic, hateful, threatening, racist, sexist, discriminatory, or which otherwise violate any national or international laws. No nudity is allowed. Children and babies must be wearing at least a nappy and, if a Design does feature a picture showing children, the Participant must have obtained the parents’/guardian(s)’ legal consent for the Design to be published. The FEI will ultimately decide if a Design is appropriate or not and whether it is eligible to be entered into the Competition.
7. Copyright and usage
By submitting Designs to the Competition, each Participant confirms and warrants that:
(a) He/she is the sole author of each submitted Design and that it is an original work;
(b) He/she owns the copyright and any other intellectual property rights of each submitted Design;
(c) He/she has obtained, prior to the submission of the Design, the permission of those pictured in the Design, if any, (or, where the Design shows any persons under 18, the consent of their parent or guardian) for the usage rights required in the section on licensing below and will indemnify the FEI against any claims made by any third parties in respect of such infringement;
(d) He/she has not licensed or disposed of any rights in the Design that would conflict with uses to be made in the licensing section below;
(e) He/she has obtained the consent of the owner of any private property featured in a Design; and
(f) He/she agrees to take part in any post-Competition publicity, documentary and/or interview.
7.2 By entering the Competition, each Participant is deemed to grant the FEI and Longines a non-exclusive, perpetual, worldwide, irrevocable license to reproduce, enlarge, publish, exhibit or create derivative works, on any media (now or hereafter known) and in whatever forum the FEI may choose, the Designs. This may include, but is not limited to:
News coverage of the Competition;
FEI and Longines websites;
FEI and Longines social media, including Facebook, Twitter, Instagram, Tik Tok, etc;
Exhibitions;
Publications – such as leaflets, calendars and reports; and
Press releases to be distributed to international, national, regional and specialist press giving information about or promoting the Competition.
7.3 The FEI reserves the right to request each potential winner to sign and return, within a specified period following notification, a legally binding written confirmation (in a form to be provided to the relevant Participants) in which the Participant warrants that he/she is the owner of the Design (and all the intellectual property rights in the photograph submitted) and grants to FEI, Longines and their licensees the irrevocable, perpetual, worldwide non-exclusive license to reproduce, distribute, display, and create derivative works of the entry (along with a name credit) in connection with the Competition and promotion of the Competition without additional compensation. Failure to execute and deliver any required documents to FEI by the specified deadline may result in disqualification from the Competition and selection of an alternate potential winner.
7.4 Subject to Section 7.3 above each Participant will retain full copyright for their Design (s) and, wherever possible, the Participant’s Design will be credited to the Participant.
7.5 Failure to publish a credit due to error or oversight shall not be deemed a breach of this condition.
8. Limitation of Liability
8.1 By entering the Competition, all Participants agree to release, discharge, and hold harmless FEI, Longines and their partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Competition or any Competition-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.
8.2 Neither FEI nor Longines assumes any responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorised access to Competition entries or entry forms; or alteration of entries or entry forms. Neither FEI nor Longines is responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials related to in this Competition.
9. Personal Data
9.1 Participants agree that personal data, especially names and addresses, may be processed, shared, and otherwise used for the purposes and within the context of the Competition and any other purposes outlined in these Terms and Conditions.
9.2 The data may also be used by the FEI and Longines in order to verify the Participant’s identity, postal address, and telephone number or to otherwise verify the Participant’s eligibility to participate in the Competition.
10. Right to Cancel or Suspend the Competition
10.1 FEI reserves the right, at its sole discretion, to disqualify any Participants who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Competition for any reason such as, for example, if for any reason the Competition is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of FEI that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Competition,
10.2 If the FEI and/or Longines decide to cancel or terminate the Competition, they will not retain any rights in the submitted Designs.
11. Miscellaneous Conditions
11.1 By entering the Competition, Participants also agree:
(a) To be bound by these Terms and Conditions;
(b) That the decisions of the judges are final and binding with respect to all matters relating to the Competition;
(c) That the FEI and/or Longines may use the winning Designs and each winner's name, photograph, likeness, and/or voice in any publicity or advertising relating to the Competition or future promotions without compensation or approval.
11.2 If any provision contained in these Terms and Conditions shall be prohibited by law or judged by a court to be unlawful, void or unenforceable, such provision shall, to the extend required, be severed from these Terms and Conditions and rendered ineffective as far as possible without modifying or affecting the validity or enforcement of the remaining provisions.
11.3 The Competition and these Terms and Conditions are governed by Swiss law and the competent courts of Lausanne.
Switzerland shall have exclusive jurisdiction over any dispute (whether contractual or non-contractual) arising out of, or in connection with the Competition.
11.4 The FEI and/or Longines may at any time decide to change, cancel, amend, vary, delete, add to and/or otherwise alter the terms and conditions of entry, the prizes and/or any other part of the Competition. The FEI shall not be required to send a separate notification to each person who has and/or may enter the Competition. It shall be sufficient that details shall be available on the website at https://mydreamjump.fei.org.
