PARTICIPATION TERMS TO THE COMPETITION "CRUISONALITY - ANSWER THE QUIZ AND PARTICIPATE IN A DRAW OF ONE (1) SEVEN DAY (7-DAY) 'IDYLLIC AEGEAN' CRUISE"
1. SUBJECT OF THE COMPETITION
"CELESTYAL CRUISES CENTRE LIMITED", a company incorporated in accordance with the laws of the Republic of Cyprus and having its registered office at 11 Limassol Avenue, 2112, Nicosia, Cyprus (hereinafter referred to as the 'Organizing Company') organizes a competition titled "CRUISONALITY – PLAY THE ONLINE GAME AND PARTICIPATE IN A DRAW OF ONE (1) SEVEN DAY (7-DAY) 'IDYLLIC AEGEAN' CRUISE" (hereinafter the "Competition"). The present terms (hereinafter the "Participation Terms") are aimed to determine the terms of participation in the Competition and the terms of the draw and of the selection of the Competition's winner.
2. RIGHT TO PARTICIPATE IN THE COMPETITION
Subject to article 3 below, the persons entitled to participate in the Competition, must fulfill cumulatively the following prerequisites:
(a) persons 18 years old and over,
(b) persons who have the legal capacity to participate in the Competition
(c) persons who have validly completed the procedure described in article 5 of the present terms.
For the purposes of the Participation Terms, "Participant" means anyone who fulfills cumulatively the above prerequisites and, therefore, has the right to participate in the Competition.
3. EXCLUSION OF PARTICIPANTS
The following persons are be excluded from the Competition:
(a) employees of the Organizing Company or employees of any company which is directly or indirectly subsidiary of the Organizing Company or is a holding company of the Organizing Company or is subsidiary of any holding company of the Organizing Company ("Associated Company");
(b) spouses and family members of first and second degree to the persons falling under subsection (a) above,
(c) any person connected in any other way with the Organizing Company or with any associated company or with any third party, connected with the above companies in relation to or by reasons of the Competition (including without limitation: suppliers, sponsors, advertising agencies).
The Organizing Company reserves the right to cancel at its own discretion any participation, which does not fulfill the conditions of articles 2, 3 and 5 of the Participation Terms.
4. DURATION OF THE COMPETITION.
The Competition begins on Wednesday, June 1 st , 2016 and time 17:00 (hereinafter "Beginning of the Competition") and will be terminated on Wednesday, June 29 th, 2016 and time 23:59 (hereinafter "Termination of the Competition").
The Organizing Company shall not accept any participation received after the Termination of the Competition.
5. HOW TO PARTICIPATE IN THE COMPETITION.
The Organizing Company is operating the website www.celestyalcruises.com and other affiliate websites with the element "celestyalcruises" (the "Websites") and is also operating the microsite cruisonality.celestyalcruises.com (the "Microsite"). The Microsite hosts a quiz titled "Cruisonality" (the "Quiz"). Those who are interested to participate in the Competition shall (a) enter the Microsite, (b) answer the Quiz, (c) fil in their contact details and (d) submit their participation. The Participants may participate in the Competition only once. The contact details of each Participant will be accrued in files kept by the Organizing Company and these files shall be considered as a proof of the existence and the validity of each participation. The Participants hereby declare that their personal details filed in the Competition's contact form are valid, complete, true and accurate. The contact details that each Participant is asked to fil in are a) full name and b) email. Personal details submitted by the Participants will be accrued in an automated electronic system (hereinafter, the "System").
6. PRIZE
Each valid participation grants the right to each Participant to win one (1) seven day (7-day) "Idyllic Aegean" cruise for two (2) persons (the "Prize"). The Prize may be used during 2016 and 2017 upon availability. The Prize includes accommodation on board, full-board meals, on board shows, shore excursion(-s) included in the cruise fare according to the announcements made by the Organizing Company from time to time, "Blue" drinks package and port taxes. The Prize does not include optional shore excursion(-s), which are not included in the cruise fare according to the announcements made by the Organizing Company from time to time, gaming at the casino, use of the salon and the spa as well as any services and products which are not included in the price of the cruise fare according to the Booking Terms or the announcements made by the Organizing Company.
Prizes are personal and non-transferable and cannot be used in a different period of time. The winners of the Competition or the alternate winners do not have the right to exchange the Prize with money or any other items.
7. SELECTION OF THE WINNERS OF THE COMPETITION – COMMUNICATION.
The winners of the Competition will be selected through an electronic draw made by the System on July 6 th , 2016 and at 11:00 am and at the offices of the Organizing Company at 8 Antoniou Ampatielou Str. 18536, Piraeus, Greece. Only those who have validly participated in the Competition may participate in the draw. One (1) winner and one (1) alternate winner will be selected for the Prize. The alternate winner will receive the Prize in case that the winner does not accept his/her Prize or his/her participation is found invalid, due to breach of the Participation Terms.
The Organizing Company will communicate with the winner via Facebook or email within four (4) hours after the time of the draw in order to announce to him/her the results of the Competition. The Organizing Company has the right to ask from the winners (or alternate winners) to disclose their personal data (name and surname, father's name, birth date, identification card number, address, etc.) as well as any other personal data that the Organizing Company may deem necessary in order to verify their identity at the time of receipt of the Prizes.
If the winner does not respond to the communication received by the Organizing Company within forty eight (48) hours after the draw, the Organizing Company will contact the alternate winner. If the alternate winner does not respond to the communication received by Organizing Company within forty eight (48) hours after the draw, the Prize will be cancelled.
The Organizing Company, after having communicated with the winner (or the alternate winner) and after having verified the validity and accuracy of his/her personal details, is entitled to publish the results of the Competition and the image of the winner to any media and in any way that is considered appropriate by the Organizing Company.
8. PERSONAL DATA
(a) The Organizing Company and/or any third parties for and on behalf of the Organizing Company will be processing personal data of the Participants for the purposes of this Competition. Moreover, personal data of the Participants may be used in the future by the Organizing Company for promotional reasons. By means of their participation to the Competition, the Participants accept, agree and explicitly and without prejudice provide their consent to the Organizing Company for the processing of their personal data by the Organizing Company or by any other party designated by the Organizing Company for the purposes of this Competition and for the purposes of direct marketing and communication actions. The Participants, including the winners of the Competition, shall have the rights of information, access and objection under articles 11, 12 and 13 of the Greek Law 2472/1997 and may exercise their rights by mailing the Organizing Company at 8 Antoniou Ampatielou Str., 18536, Piraeus, Greece, c/o Celestyal Cruises Centre Limited, with a note "For the competition 'Cruisonality – Play the online game and participate in a draw of one (1) seven day (7-day) 'Idyllic Aegean' cruise'".
(b) By means of their participation to the Competition, the Participants, including the winners of the Competition, provide their consent to and authorize the Organizing Company to publish their personal data, their image and the results of the Competition which may include personal data in any media and in any way that is considered appropriate by the Organizing Company. This right may be exercised in the whole world, in perpetuity and with nothing in exchange. The Organizing Company is hereby entitled to use and publish any news in regards to the Competition, including without limitation, to announce in public the name and image of the Participants, including the winner and to make any promotional action, which is considered necessary by the Organizing Company in order to commercially exploit this event.
9. DELIVERY OF THE PRIZES
In order to secure delivery of the Prizes, the winner, after having been informed about the results of the draw, is requested to communicate with the Organizing Company via mail at 8 Antoniou Ampatielou Street, 18536, Piraeus, Greece c/o CELESTYAL CRUISES CENTRE LIMITED or e-mail at z.tsilimpounidou@celestyalcruises.gr or telephone at +30 210 458 3448. The winners must sign the acceptance form provided by the Organizing Company in order to receive the Prize. Before delivering the Prize, the Organizing Company may ask from the winner to present their identity card or passport in order to verify their personal details and date of birth.
If the winner does not accept to sign the above mentioned acceptance form, this person loses his/her right to receive the Prize and such right automatically is granted to the alternate winner. If the alternate winner does not accept to sign the acceptance form, the Prize is cancelled.
The winner must collect the Prize within ten (10) days from the date of the draw, otherwise the Prize shall be offered to the alternate winner. If the alternate winner does not collect the Prize within ten (10) days from the date of the draw, the Prize is cancelled.
The Participants and/or the winners are not permitted to proceed to any public statement and/or announcement of any information to the media regarding the Prize, without the prior written consent of the Organizing Company.
10. PUBLICITY
The Participation Terms have been submitted to the Notary Public Mrs. Zafiria Souri – Konstantinou (1 Skouze Str., Piraeus, Greece, telephone number +30 210 4295118-9) and have been uploaded on the Microsite. Any Participant to the Competition or any third party has the right at his/her own cost to receive true copy of the Participation Terms submitted to the above mentioned Notary Public. The Participation Terms of the Competition are exclusively valid and they annul any older terms submitted to a Notary Public.
11. ANULLMENT OF THE COMPETITION – AMENDMENTS.
The Organizing Company reserves the right to amend solely the Participation Terms and/or the procedures of the Competition (including the duration of the Competition), whenever this is deemed appropriate as per the Organizing Companies sole discretion. The Organizing Company shall announce such amendment through the Websites and/or the Microsite. Enforcement date for such annulment / amendment shall be the date that the announcement was made. According to the above, the Organizing Company reserves the right to amend the term of the Competition and/or alter the date and time of the draw for any reason whatsoever and at any time. The Organizing Company shall not be considered liable to any third party if amendments to the Participation Terms take place or if the Competition is postponed or cancelled.
12. ACCEPTANCE OF THE PARTICIPATION TERMS
By participating in the Competition, the Participants explicitly and without prejudice accept the Participation Terms and the official rules and decisions of the Organizing Company in respect of the Competition, which are deemed definite and binding and the Terms of Use of the Websites and the Microsite. Moreover, participation in the Competition is considered a waiver of any economical or any other claim and/or right whatsoever against the Organizing Company in regards to the Competition. By receiving the Prizes, the winners explicitly and without prejudice accept the "Booking Conditions" of the Organizing Company and of "Conditions of Carriage of Passengers and their Luggage" uploaded on the Websites.
13. GENERAL
(a) The Participants shall not have or acquire any right at all upon the Organizing Company's trademarks, names, indications, emblems and other distinctive Marks.
(b) If any of the provisions of the present is found unenforceable or invalid, the remaining provisions of the Participation Terms shall continue to have full force and effect.
(c) The Participation Terms are written in Greek and will be translated in English, French and Spanish. In case of any inconsistency between the Greek and the other texts, the Greek text will prevail.
14. APPLICABLE LAW – JURISDICTION
The present shall be governed by Greek law. All disputes arising from or in connection to the Competition, including any disputes for its existence, validity and Termination of the Competition, shall be exclusively and finally settled by the Courts of Piraeus.
