8.6 Bavaria – Facebook
ARTICLE I : Organiser
The competition named 8.6 SHOTS is organised by Bavaria N.V., a Limited Company subject to Dutch law whose registered office is located at: De Stater 1, NL-5737 RV Lieshout, Netherlands (hereinafter: “Bavaria”).
ARTICLE II : The Competition
This competition, which comprises a photo competition, a compulsory skill-testing question and a final ranking, can be accessed from the following website http://www.facebook.com/86bavaria (hereinafter: 'the Competition').
In order to participate, the visitor must have a Facebook account.
This Competition is in no way sponsored, endorsed or administrated by, nor associated with, Facebook.
By participating in this Competition, participants explicitly release Facebook from any responsibility or liability regarding this Competition.
Participation in the Competition implies that the participant accepts these competition rules in their entirety, without restriction or reserve.
These competition rules, as well as further information regarding this Competition are available on the website http://www.facebook.com/86bavaria.
ARTICLE III : Duration of the Competition
Participation in the Competition is possible from October 14th at midnight CET (00:00 Central European Time) until November 4th 2013 at 23:59 CET.
ARTICLE IV : Persons allowed to participate
Participation in the Competition is exclusively reserved to persons legally residing in France, The Netherlands, Canada (Québec residents are excluded), Montenegro, the United States (residents of Arizona, Florida and New York are excluded) and Spain who are of a legal drinking age in their country of residence.
In case of dispute, the participant may be asked to provide Bavaria with proof of identity. Participants authorise any necessary verification of information provided. Bavaria reserves the right to disqualify any participant who refuses to comply with these competition rules or who disturbs the
operation of the Competition (particularly in the case of cheating or fraud), without prejudice to all other remedies.
Participation in the Competition is not open to employees of Bavaria or one of its affiliates, employees of distributors of Bavaria and direct relatives of employees of Bavaria or one of its affiliates.
Participation in this Competition is free with no obligation to purchase, no fees or costs will be charged by Bavaria.
ARTICLE V : How to participate
The participant must have a Facebook account in order to participate in the Competition. His/her age group will therefore automatically be recognised from the account. If the participant does not have an account, he/she will be invited to create one in order to participate in the Competition.
To participate:
- the participant connects to the application on the 8.6 Bavaria Facebook page at the following address: https://www.facebook.com/86bavaria?fref=ts
1. He/She must "like" the 8.6 Bavaria page if he/she is not already a fan.
2. He/She must accept the authorisations requested.
3. there are two ways to participate:
1/ the participant can upload his/her photo in jpeg format, with a maximum size of 400x400px from his/her computer;
2/ the participant takes a photo with his/her webcam.
4. He/She then fills out the following contact details: Title, Surname, First Name, email address and country of residence.
5. He/she must answer a skill testing question.
6. He/She then:
 checks the box "I have read and accept the competition rules";
 checks the box "I expressly accept that Bavaria NV collect, use and process my personal information in compliance with article XI of the competition rules".
7. He/She then confirms his/her submission and participation. Every participant can only submit one (1) photo and can only participate once.
8. He/She automatically receives an email informing him/her that his/her photo is being examined by the team of moderators before publication.
9. A second email will be sent informing the participant that: either the photo is compliant with the competition rules and will be published on the competition interface, or it has been rejected for one of the reasons listed in Article VIII.
10. The participant then invites his/her Facebook friends to vote and share his/her participation on Facebook, Twitter and/or Pinterest.
The participant's photo must illustrate his/her vision of 8.6 Original. An 8.6 Original must be visible in the photo.
All photos of the participants that are being published are then subject to visitors' votes. The 100 (one hundred) photos receiving the most votes will be declared as the winners and the respective participants will win the prizes specified in article VII.
In the case of a tie, a draw will take place among the participants concerned.
ARTICLE VI : Right to use and publish the photos
By submitting photos to Bavaria within the scope of the Competition (hereinafter; “the Photos”), participants hereby grant Bavaria a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute and publish the Photos in the ways specified below.
Each participant represents and warrants that:
a) he/she owns the copyrights vested in the Photo or otherwise has the right to grant the rights and licenses set forth in this article;
b) the Photo and use of the Photo does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, publicity rights, copyrights, trademark and/or other intellectual property rights;
c) the Photo does not depict any individuals who have not granted permission to be featured;
d) has the legal right and capacity to enter into these competition rules in his/her jurisdiction.
The license includes:
The right to use, reproduce, distribute, prepare derivative works of, display, and perform the photos in connection with the Competition and Bavaria's (and its affiliates) business, including without limitation for promoting and redistributing part or all of the photos (and derivative works thereof) in any media formats and through any media channels.
ARTICLE VII : Prizes
The following Prizes can be won:
1st Prize: 1 iPhone 5S worth €679 tax incl. with an iPhone 5S case worth €15 tax incl.
2nd Prize: 1 iPad Mini worth €339 tax incl.
3rd au 13th prize: a rock photo print, format 75 X 60 cm worth €162 tax incl.
14th au 34th prize: a rock photo print, format 30 X 24 cm worth €87 tax incl.
Du 35th au 65th prize: a rock album worth €12.99 tax incl.
Du 66th au 100th prize: an 8.6 Bavaria goody worth between €5 and €12 tax incl.
Bavaria will be responsible for notification and payment of any tax on games of chance. The 1st prize is an European iPhone 5S suitable for European use. If the winner of the 1st prize is a legal resident of Canada (Québec residents are excluded), or the United States (residents of Arizona, Florida and New York are excluded), the winner will receive a similar prize having an equal or higher value.
ARTICLE VIII : Moderation and conditions of participation
The moderators decide whether to publish the participant's Photo or not.
In order to be published, the Photo must include a Bavaria 8.6 Original and comply with the following instructions:
- It must not encourage excessive or irresponsible consumption of alcohol and must not present moderate consumption or abstinence of alcohol in a negative way.
- It must not suggest violent, aggressive, dangerous or antisocial behaviour.
- It must neither depict or refer to intoxicated persons.
- It must not depict minors, i.e. "those who have not reached the legal age for the consumption of alcoholic drinks in their country of residence".
- It must not associate the consumption of alcohol, either directly or indirectly, with the act of driving of any vehicle whatsoever.
- It must not associate the consumption of alcohol with potentially dangerous operations or activities, represent an act of consumption before or during an activity, in potentially dangerous locations.
- It must not be implied that 8.6 Bavaria is capable of preventing, treating or curing an illness or a hinted illness.
- It must not create confusion related to the nature and strength of the beer.
- The alcohol content must not be presented as positive quality or a reason to choose 8.6 Bavaria.
- It must not give the impression that beer consumption increases mental capacity or physical performance, notably sports, social or sexual performance.
- It must not have an advertising, promotional or commercial stance, be deemed as vulgar, pornographic, racist, defamatory, hateful, attack human or animal dignity or break the laws currently in force.
- It must not represent elements which are subject to intellectual or industrial property rights of any third party (copyrights, trademark rights, design rights, etc.)
Invalid participations:
- Participation forms carrying incorrect information will be considered as invalid.
Generally speaking, any submission and participation in the Competition which includes anomalies (e.g.: incorrect age, incomplete form, erroneous information, fraud or attempted fraud) will be rejected.
- Bavaria reserves the right to carry out necessary verifications concerning the identity and the address of participants. Any error or fraudulent indication will result in cancellation of the participation
- Any interrupted participation (e.g. interrupted internet connection) will be considered as null and void.
ARTICLE IX : Nomination and notification of winners
For the nomination of winners, the following participations will be taken into account:
(A) Valid participations from the participating countries;
(B) Photos that are submitted between October 14th at midnight CET (00:00 Central European Time) until November 4th 2013 at 23:59 CET;
(C) Photos which are compliant with the competition rules and have been published on the competition interface.
The nomination of winners will take place on November 15th 2013. Bavaria will inform the winners by email within 3 days after the nomination.
Any potential winner who cannot be contacted within 14 days following the date that the email was sent and/or fail to confirm/supply all information requested within a period of 30 days from the date of the first notification, will be disqualified, and his/her prize will be allocated to one of the subsidiary winners.
Prizes will be sent by registered post within 8 weeks from the date of nomination. Bavaria cannot be held responsible and is not obligated to carry out further investigation if the postal details do not match those provided by the winner, if they are erroneous or if the winner remains unavailable or cannot be contacted. In that case, the winner will not receive his/her prize nor any compensation or indemnity.
ARTICLE X : Claims related to prizes
Prizes allocated within the scope of this Competition cannot, in any case, be exchanged with other prizes, and cannot be subject to any claim or dispute. Bavaria reserves the right to replace a prize with other prizes having an equivalent or higher value in the case of non-availability of one or several prizes, and these decision cannot be subjected to any claim from participants.
ARTICLE XI : Privacy and personal information
Personal information of persons visiting the website or participating in the Competition may be collected by Bavaria, directly (when the visitor or the participant is asked for his/her personal data) or indirectly.
Persons visiting the website and participants explicitly accept that the following personal data may be collected, processed, used and distributed by Bavaria N.V., and that Bavaria N.V. may communicate this data to its European subsidiaries:
For visitors of the website, for Competition participants and for winners:
 gender (title)
 surname and first name
 email address
 country of residence
 image of participants
 home address (only winners)
The personal data mentioned above will be used within the framework of the Competition and will be provided to third parties if this is necessary for the performance of the Competition or to benefit from or to obtain prizes.
Each participant expressly authorises Bavaria N.V. and its European subsidiaries to check, use, publish and exploit, either wholly or partially, personal data provided within the framework of the Competition (e.g. surname and first name, whether or not in combination with a Photo) for advertising, commercial, marketing or promotional purposes having a direct link with the Competition, via any existing or future media.
Such use of personal data will not give rise to any rights.
In addition, personal data may be collected and analysed within the scope of research into site visits, notably IP addresses, domain names, number of visits, pages visited, sites visited before/after and session lengths. This information can be collected through the use of cookies. It is possible to allow or prevent the use of cookies by changing the browser settings.

ARTICLE XII : Modification or cancellation of the Competition
Bavaria reserves the right, if circumstances require, to shorten or to extend the competition period, to modify, stop, bring forward or cancel the Competition. Bavaria cannot be held liable, in any case, of any prejudice or damage suffered by participants resulting thereof.
Bavaria reserves the right to stop or suspend the Competition in case of fraud, or in the case that, for any reason, the computer system allocates prizes which were not provided in the current competition rules. In that case, messages informing winners will be considered null and void. Under no circumstances will the number of prizes exceed the number stated in the current competition rules.
ARTICLE XIII : Limitation of liability
Bavaria cannot be held liable for:
1. incorrect or inexact information due to typing errors, or malfunctions in computer hardware or software used in connection with the Competition.
2. technical failure of any kind including, but not limited to, breakdowns, interruptions or disconnections of telephone lines or the internet, or malfunctions related to hardware, software, scripts or data.
3. unauthorised human intervention at any stage of the submitting process of the Competition.
4. technical or human error occurring in the administration of the Competition or the processing of submissions.
5. bugs, viruses, Trojan horses or equivalents which may have been transmitted to or via the website.
6. any injury, or damage suffered by persons, property or goods resulting, directly or indirectly, totally or partially, from the participation of a person in the Competition or from the receipt or use of a prize.
More specifically, Bavaria cannot be held liable for material or immaterial damage caused to participants, to their IT equipment and data recorded therein, nor for consequences which may be affect their personal, professional or commercial activities.
Moreover, Bavaria cannot be held responsible if participants are unable to connect to the website or unable to participate in the Competition due to a technical breakdown or a problem related to the number of network connections (traffic density), even when this problem results from an error on the part of Bavaria or a third party acting on behalf of Bavaria.
Bavaria cannot be held liable for damages, including but not limited to physical and material damage occurring during or as a consequence of the use or consupmtion of a prize.
If, for any reason whatsoever, a participation is erased by accident, lost, destroyed or falsified, the participant can only remedy this problem by repeated participation in the Competition.
ARTICLE XIV : Governing law
The current competition rules, the Competition and all matters arising from or related with it, are exclusively governed by the laws of the Netherlands.
ARTICLE XV : additional terms for participants residing in the Netherlands
The provisions of the current competition rules comply with the Dutch Code of Conduct regarding Promotional Games of Chance (Gedragscode Promotionele Kansspelen).
