By entering the Competition, You accept all the Participation Rules below. We strongly encourage you to read them!

From June 29 until July 17, 2016, Baume & Mercier will organise the Baume & Mercier – Spirit Of Competition competition (the "Competition"). During this time Participants will be asked to share a text or a photograph or a video to express their vision of the claim “Spirit of Competition” in their everyday life using the hashtags #SpiritOfCompetition and #IacceptTC (as well as @baumeetmercier for those posting on LinkedIn) on the official Baume & Mercier Facebook page, or on Twitter, Instagram, Google+ or LinkedIn in order to win a Baume & Mercier Capeland Cobra 1963 Competition watch (ref. 10281).

The Competition is NOT open to Mainland China residents.

A jury composed of Baume & Mercier and Allen Grant, the legendary Shelby Cobra race car ex-driver, will select the best post to designate the winner.

PARTICIPATION RULES

1. These Participation Rules (“Rules”) apply to the Baume & Mercier – Spirit Of Competition competition (the "Competition"). By entering the Competition, Participants expressly agree to be bound by these Rules. However, this Competition shall be void where prohibited by local law.

2. The Competition is promoted and organised by BAUME & MERCIER, Branch of Richemont International SA, 50, chemin de la Chênaie, 1293 Bellevue, SWITZERLAND (hereinafter referred to as “Baume & Mercier”).

3. By entering the Competition, entrants expressly acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with Instagram and releases the aforementioned of any and all claims relating to or arising from the Competition.

4. The Competition is open for participation from June 29, 2016 at 9am (CET) until July 17, 2016 at 6pm (CET) and in order to participate in the Competition each Participant will post a text, a photograph or a video to express their vision of the claim “Spirit Of Competition” in his/her everyday life using the hashtags #SpiritOfCompetition and #IacceptTC (as well as @baumeetmercier for those posting on LinkedIn) on the official Baume & Mercier Facebook page, or on Twitter, Instagram, Google+ or LinkedIn.

5. These Rules are only available in English and are available at: http://www.baume-et-mercier.com/en-us/legal/spiritofcompetition-contest-rules. Participants are strongly advised to read the Participation Rules carefully before participating in the Competition. By entering the Competition, You accept all the Participation Rules. If you do not understand the Rules then you should not participate.

6. Baume & Mercier reserves the right to cancel the Competition and/or change the Rules at any time without prior notice to Participants. Any changes will be posted on the Baume & Mercier website and linked to on social media platforms (Facebook, Twitter, Google+, Instagram and LinkedIn).

Qualifying Participants

7. The Competition is NOT open to minors and to qualify to enter the Competition you must be of legal age in the country of your residence (for example, over 18 in most European countries) but at least 18 years old. Baume & Mercier assumes that by entering the Competition you warrant that you have the legal capacity to enter the Competition and accept the Rules (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract). Baume & Mercier reserves the right to request proof of age and capacity.

8. The Competition is NOT open to Mainland China residents due to specific local laws.

9. Employees and immediate family members of employees of Baume & Mercier and its associated companies, professional advisors, advertising and promotional agencies connected with the creation or administration of the Competition are not eligible to take part in the Competition. Baume & Mercier reserves the right to verify the eligibility of all Participants.

10. There is no purchase requirement to participate in the Competition, no contract to sign with Baume & Mercier and there is no charge to register for the Competition other than the usual Internet connection charges payable to your service provider and/or telephone company.

11. By participating in the Competition you hereby warrant that all personal details you might be required to submit are true, current and complete.

12. Participants will not post any defamatory, abusive, profane, threatening, offensive or illegal information or material and will not use the Competition or the official Baume & Mercier Facebook page, in any offensive or illegal manner. Attacks against other Participants or persons or entities affiliated with Baume & Mercier will not be tolerated. "Spamming" in any form is strictly forbidden.

13. Baume & Mercier reserves the right to disqualify any Participant if it has reasonable grounds to believe that the Participant has breached any of these Rules, has otherwise behaved in an unfair or fraudulent way, or has unduly used their influence to direct online traffic to the Competition.

The Competition – Entries

14.The Competition begins on June 29 at 9am (CET) until July 17, 2016 at 6pm (CET).

15.Texts and/or photographs and/or videos submitted to the Competition must be posted on the official Baume & Mercier Facebook page, or on Twitter, Instagram, Google+ or LinkedIn using the hashtags #SpiritOfCompetition and #IacceptTC (as well as @baumeetmercier for those posting on LinkedIn) before July 17, 2016 6pm (CET). Submissions after this time and date will be ignored. Any postings made on a Participant’s personal Facebook profile, etc. or lacking the #SpiritOfCompetition and/or #IacceptTC (and @baumeetmercier for those posting on LinkedIn) will be ignored and invalid and not included in the Competition.

16. Each Participant must submit one submission either with text or photograph or video expressing his/her vision of the claim “Spirit Of Competition”. Submissions with photographs should also contain a text to facilitate its understanding, but is not mandatory. Only one entry per Participant is authorised. Furthermore, anyone found to be using multiple accounts will be ineligible. Please note that Twitter users who try to enter the competition more than once may have their accounts suspended by Twitter and should more generally ensure that they follow all the Twitter rules.

17. Each Participant accepts that his/her entry may be cross posted to Facebook, Twitter, Google+, LinkedIn or Instagram or other platforms over which Baume & Mercier has no control or copied by individuals not participating in the Competition.

18. At the end of the Competition the Jury composed of representatives of Baume & Mercier and Allen Grant (the legendary Shelby Cobra race car driver) will meet on 20th July 2016 to designate the best text and/or photograph and/or video from among those submitted by the Participants and thus the winner.

19. Baume & Mercier will then contact the selected Participant on the same channel where he/she entered the Competition to validate his/her entry. On Facebook, Google+, Twitter and Instagram, Baume & Mercier will ask the Participant to provide his/her e-mail address through the platform's direct private message system. On LinkedIn, Baume & Mercier will ask the selected Participant to accept a “connection” request from a designated Baume & Mercier employee and provide him/her with his/her e-mail address in a LinkedIn private message. The conversation will then continue via e-mail.

20. The winner of the Competition will be announced on 27th July, 2016.

21. Baume & Mercier cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission or mail delivery, communications line failure, theft, destruction, corruption, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.

Parameters

22. Before posting his/her text and/or photograph and/or video on the official Baume & Mercier Facebook page, or on Twitter, Insagram, Google+ or LinkedIn using the hashtags #Spirit Of Competition and #IacceptTC (as well as @baumeetmercier for those posting on LinkedIn), Participants must ensure that:

• The text and/or photograph and/or video do not promote any brand other than Baume & Mercier;

• The text and/or photograph and/or video must be original – in other words, the Participant created the text and/or photograph and/or video her/himself, is the only author and nobody else has worked on them;

• The Participant is the exclusive holder of all rights in particular intellectual property rights related to the text and/or photograph and/or video and they do not contain any element whatsoever that might infringe a third party’s rights in any way;

• The text and/or photograph and/or video does not contain material embodying the names, images, likeness or voices identifying another person without permission;

• The text and/or photograph and/or video do not in any way reflect negatively on anyone’s image or reputation;

• The text and/or photograph and/or video are not in any way violent or pornographic, and will not in any way whatsoever harm the dignity or any other rights of any third party;

• The text and/or photograph and/or video do not contain any computer virus or other code designed to destroy, divert, interrupt or limit any computer system in any way;

• Photographs and videos will be submitted in the following format: JPEG for the photograph and .mov or mpeg for the video.

• And, overall, that the submitted text and/or photograph and/or video do not in any way contravene any of the social media platforms’ current rules (i.e. Facebook page, Twitter, Instagram, Google+ or Linkedin) or current legislation.

23. Baume & Mercier reserves the right not to accept any text and/or photograph and/or video submitted for the Competition that does not in its opinion and at its entire discretion comply with the above-mentioned conditions.

24. By posting their texts and/or photographs and/or videos on the official Baume & Mercier Facebook page, or on Twitter, Instagram, Google+ or LinkedIn using the hashtags #SpiritOfCompetition and #IacceptTC (as well as @baumeetmercier for those posting on LinkedIn) , Participants expressly authorise Baume & Mercier to reproduce, display and more generally use the texts and/or photographs and/or videos both on and off-line, on the Baume & Mercier and other websites on which it communicates and publications it may at any time choose to produce without restriction or limitation.To this end and on submission of their texts and/or photographs and/or videos to the Competition, Participants expressly waive their moral rights in and to the texts and/or photographs and/or videos and will not in any way do anything to invoke such rights to the detriment of Baume & Mercier. In spite of the foregoing, Baume & Mercier will where possible credit the author of text and/or photograph and/or video posted.

25. Each Participant agrees to indemnify and hold harmless Baume & Mercier and their respective parent companies and affiliates from and against any and all claims arising out of or resulting from valid claims from third parties whose work they have copied or otherwise infringed.

Prize

26. The winner of the Competition will receive a Baume & Mercier Capeland Cobra 1963 Competition watch, reference 10281 (recommended retail price of CHF 4’200) (the “Prize”). The Prize will be sent to the winner by mail.

27. If the winner is unable to claim his/her Prize for any reason, no compensation or substitution will be provided in lieu thereof and Baume & Mercier will have no further obligation to said winner. The Prizes are personally attributed and not transferable. There is no cash alternative for the Prize. No Prize will be awarded as a result of improper actions by or on behalf of any Participant. No substitution is allowed except that Baume & Mercier may in its sole discretion substitute a prize of equal or greater value. The winner is subject to the income reporting and (if applicable) required tax payments in his or her country of residence.

28. The winner will further be asked to provide additional contact information and details for him/herself and the person travelling with him/her in order to enable the delivery of the Prize. If the winner fails to reply as specified within the time stated therein or if he/she is unable to claim the Prize, then said winner will be disqualified.

29. The winner agrees that his/her video together with his/her name can be used for promotional and/or marketing and/or communication purposes by Baume & Mercier including the further spread by sharing in any and all media such as, but not exclusively, digital media, Baume & Mercier websites including the Baume & Mercier YouTube Channel, and official Facebook, Twitter, Google+, Instagram, LinkedIn and Pinterest pages.

Liability

30. Baume & Mercier does not accept liability for any damage, loss, pain or suffering incurred by any Participant entering the Competition. Baume & Mercier is not responsible for any problems with local postal services or technical faults, be they in networks or telephone lines, computer systems, servers or suppliers, mobile telephones or computer equipment or software failing of any email system or entry form received due to technical problems or to congestion related to the Internet, telephone lines or any website, or any combination thereof, including any damage or prejudice to the Participant’s telephone computer or to any other person or mobile linked with or related to participation in or downloading of material on Baume & Mercier’s internet site, be it related to the Competition or not.

Data Protection and Publicity

31. Baume & Mercier reserves the right to use, and the winner expressly agrees that Baume & Mercier may use his/her name and all photographs and films taken of him/her at any event that may be organised at the discretion of Baume & Mercier at no cost to Baume & Mercier. This use may include use on the Internet, such as Baume & Mercier's website, its social network pages including Facebook, Twitter, Google+, Instagram You Tube etc., mobile applications and all advertising and publicity collateral.

32. The winner grants Baume & Mercier, the non-exclusive right to use, disseminate and reproduce his/her picture, voice or any other attribute of his/her personality as it appears in any film, photograph etc. taken at any event that may be organised free of charge for ten (10) years from the end of the Competition in any media whatsoever, at the discretion of Baume & Mercier. The winner also consents to his/her personal data including his/her picture, voice or any other attribute of their personality being transferred out of the country in which the data was originally collected.

33. Baume & Mercier will collect and process the entrants’ personal data in connection with the Competition solely for the purposes of fulfilling its obligations in respect of the Competition and will store said data in accordance with applicable data protection laws. IP addresses of entrants having participated in the Competition may also be collected solely for the purposes of preventing fraud in connection with the Competition. Other than as stated in these rules, any personal data provided by entrants will be used solely in accordance with Baume & Mercier’s Privacy Policy which can be viewed http://www.baume-et-mercier.com/en/legal/privacy-policy.html. Applicable law

34. In the event of any dispute whether such dispute concerns the conduct or eligibility of Participants, results or any and all other matters relating to the Competition, Baume & Mercier's decision shall be final and no correspondence or discussion shall be entered into.

35. For all other matters the Participation Rules shall be governed and construed in accordance with Swiss law. Disputes arising in connection with these Participation Rules shall be subject to the exclusive jurisdiction of the competent Swiss courts.
