Terms and conditions of participation – Fischer VACUUM photo contest
1. This competition is organised by Fischer Sports GmbH in Ried im Innkreis, Austria. By taking part in the competition, filling in the form and uploading a photograph you automatically accept our terms and conditions. You are not entitled to amend or exclude these terms and conditions, even in part.
2. Participation is free of charge. There is no participation fee.
3. This competition is open to anyone aged 18 or over. This competition is not open to employees of Fischer Sports GmbH and their relatives.
4. To be eligible for entry you must fill in the form and upload and edit a photograph from 27 October to 21 December 2014 (12 noon CET). Late entries, regardless of on what grounds, cannot be accepted. Multiple entries are permissible, but only the picture with the most votes can win.
5. With the uploading of the photograph the participant confirms that the photograph does not infringe any trademarks, copyrights or other protective commercial rights of third parties, hereby indemnifies Fischer Sports GmbH against any third-party claims and agrees to its publication by Fischer Sports GmbH. The participant agrees with the use of the photographs that are uploaded and taken within the scope of the app for communication purposes of Fischer Sports GmbH and agrees with the adaption of a submitted idea within the scope of a communication motive independent from the app.
Furthermore, Fischer Sports GmbH reserves the right to delete photographs and exclude participants at any time if the participation features content which is not in the interest of the competition or not in keeping with the image and standing of Fischer Sports GmbH. This applies in particular but not exclusively to comments or recordings which are offensive, racist, harmful to young persons or glorify violence.
6. Photographs and participants' information will appear in the Facebook App Fischer VACUUM photo contest.
7. On uploading a photograph the user grants Fischer Sports GmbH a non-exclusive right of use which is unrestricted in terms of content, time and space. This includes all forms of use which were apparent when the photograph was uploaded, in particular the inclusion of the photograph in the Facebook app and use for internal and external communication purposes.
Fischer Sports GmbH is granted the right to sublicense insofar as this is required for the use specified above. The same applies to any comments which are posted and other text contributions. The names and respective address of the winners may be published.
7. All Facebook users who authenticate themselves for the app can vote for their favourite from 12 noon CET on 27 October 2014 to 12 noon CET on 21 December 2014. Ten (10) participants, who have received the most votes via the user voting process are the winners.
The winners receive a pair of Fischer VACUUM boots. Each participant will receive 1 pair of Fischer VACUUM boots only. Winners will receive email notification by 24 December 2014. The participants are responsible for the validity of the email address specified. Should any of the winners not reply by 7 January 2015 a new winner shall be determined. Prizes cannot be exchanged for cash, nor can they be exchanged for other items. Any recourse to courts of law is excluded.
