PARTICIPATION TERMS TO THE COMPETITION
“MERRY GREECEMAS -
PLAY THE ONLINE GAME AND PARTICIPATE IN A DRAW OF SIXTEEN (16) SEPARATE CRUISE TRIPS FOR 2016”
SUBJECT OF THE COMPETITION
“CELESTYAL CRUISES S.A.”, a company incorporated in accordance with the laws of the Marshall Islands and having its registered address at Trust Company Complex, Ajeltake Road, Ajeltake Island, P.O. Box 1405, Majuro, Marshall Islands, MH 96960, with registered branch office in Greece in accordance with the Greek Law 27/1975, situated in 8 Antoniou Ampatielou Street, 18536, Piraeus, Greece (hereinafter referred to as the "Organizing Company"), organizes a competition titled “MERRY GREECEMAS – PLAY THE ONLINE GAME AND PARTICIPATE IN A DRAW OF SIXTEEN (16) SEPARATE CRUISE TRIPS FOR 2016” (hereinafter the “Competition”). The present terms (hereinafter the “Participation Terms”) are aimed to determine the terms of participation in the Competition and the terms of the draw and of the selection of the Competition’s winners.
RIGHT TO PARTICIPATE IN THE COMPETITION
Subject to article 3 below, the persons entitled to participate in the Competition, must fulfill cumulatively the following prerequisites:
(a) persons who are 18 years old,
(b) persons who have the legal capacity to participate in the Competition
(c) persons who have validly completed the procedure described in article 5 of the present.
For the purposes of the Participation Terms, “Participant” means anyone who fulfills cumulatively the above prerequisites and, therefore, has the right to participate in the Competition.
EXCLUSION OF PARTICIPANTS
The following persons shall be excluded from the Competition:
(a) employees of the Organizing Company,
(b) spouses and family members of first degree to the employees falling under subsection (a) above,
(c) any person connected in any other way with the Organizing Company or with any associated company or with any third party, connected with the above companies in relation to or by reasons of the Competition (including without limitation: suppliers, sponsors, advertising agencies).
The Organizing Company reserves the right to cancel at its own discretion any participation, which does not fulfill the conditions of articles 2, 3 and 5 of the Participation Terms.
DURATION OF THE COMPETITION.
The Competition begins on Thursday, December 10th 2015 and time 17:00 (hereinafter “Beginning of the Competition”) and will be terminated on Monday, January 11th 2016 time 11:00 (hereinafter “Termination of the Competition”).
The Organizing Company shall not accept any participation received after the above period of time.
HOW TO PARTICIPATE IN THE COMPETITION.
The Organizing Company is operating the website www.celestyalcruises.com and a microsite www.merrygreecemas.gr (the “Microsite”). The Microsite will host an online game titled “Merry Greecemas by Celestyal Cruises” (the “Online Game”). Those who are interested to participate in the Competition shall (a) enter the Microsite, (b) login to their account on Facebook, (c) fil in the contact details and (d) play the Online Game. Each time a Participant finds an element in the Online Game, earns one participation in the draw with a maximum limit of 32 participations.
Each Participant’s contact details shall be accrued in files kept by the Organizing Company and these files will constitute full proof in respect of the existence of any participation and its validity. The Participants hereby declare that their personal details filed in the Competition’s contact form are valid, complete, true and accurate. The contact details that each Participant is asked to fil in are: a) name, b) surname, c) email and d) mobile phone number. Personal details submitted by the Participants will be accrued in an automated electronic system (hereinafter, the “System”).
PRIZE
Each valid participation in the Competition grants the right to each Participant to win one (1) of the sixteen (16) cruise trips mentioned below for two (2) persons which include air tickets back and forth the country of residence of the winner and the initial port of call of the cruise (if necessary), transfer to and from the cruise vessel and:
One (1) seven day (7-day) cruise to ports of Cuba or;
One (1) seven day (7-day) cruise to ports of the Aegean (Greece and Turkey) or;
One (1) of the seven (7) four day (4-day) cruises offered to ports of the Aegean (Greece and Turkey) or;
One (1) of the seven (7) three day (3-day) cruises offered to ports of the Aegean (Greece and Turkey);
hereinafter the “Prizes”.
The Prizes may be used during year 2016 upon availability. Prizes include accommodation on board, full-board meals, on board shows, “Blue” drinks package and port taxes. Prizes do not include shore excursions, gaming at the casino, use of the salon and the spa as well as any services and products which are not included in the price of the cruise ticket according to the Booking Terms or the announcements made in www.celestyalcruises.com by the Organizing Company.
Prizes are personal and non transferable and the Participants cannot use it during a different period of time. The winners of the Competition or the alternate winners do not have the right to exchange the Prize with money or any other items.
SELECTION OF THE WINNERS OF THE COMPETITION – COMMUNICATION.
The winners of the Competition will be appointed through a draw made by the System, which will take place on Monday, January 11th 2016 and at 14:00 between the Participants who have validly participated in the Competition. The draw will take place at the offices of the Organizing Company at 8 Antoniou Ampatielou Str. 18536, Piraeus, Greece, in the presence of a lawyer. One (1) winner and one (1) alternate winner will be selected per Prize. The alternate winners will receive the Prizes in case that the winner does not accept his/her Prize or his/her participation is found invalid, due to breach of the Participation Terms.
The Organising Company will communicate with the winners within four (4) hours from the time that the draw took place in order to announce to them the place, time and procedure of receipt of the Prizes. Communication with the winners will take place via Facebook, telephone or email. The Organizing Company has the right to ask from the winners (or alternate winners) to disclose their personal data (name and surname, father’s name, birth date, identification card number, address, etc.) as well as any other personal data that the Organizing Company may deem necessary in order to verify their identity at the time of receipt of the Prizes.
The deadline for the communication with the winners shall not exceed the time period of forty eight (48) hours. After the expiry of the above deadline, the Organizing Company will contact the alternate winner. In case that the alternate winners could not be contacted within forty eight (48) hours, the Prize will be cancelled.
Upon completion of the communication between the Organizing Company and the winners or alternate winners and the verification of the validity and the accuracy of their personal details, the Organizing Company is entitled to upload their names at the website www.celestyalcruises.com and at Celestyal Cruises Facebook Fanpage.
PERSONAL DATA
(a) The Organizing Company announces that itself and/or third parties that conduct the processing of personal data, under the orders and on behalf of the Organizing Company, will process personal data of the Participants in order to appoint the winners of the Competition, to publish the results of the Competition and to take all necessary actions in order for the delivery of the Prizes. The Participants provide explicitly and without prejudice their consent to the Organizing Company for the processing by the Organizing Company or by any other party designated by the Organizing Company, of their submitted personal data only for the conducting of the Competition, of the draw and of the delivery of the Prizes according to the Participation Terms.
The Participants to the Competition and the winner have the rights of information, access and objection under articles 11, 12 and 13 of the Greek Law 2472/1997 and may exercise their rights by mail at the corresponding address CELESTYAL CRUISES S.A., 8 Antoniou Ampatielou Street, 18536, Piraeus, Greece, tel.: +30 210 4583403. Winner’s personal data shall be used only for the present promotional action.
(b) The Participants to the Competition give their consent and authorization to the Organizing Company and any third party acting on its behalf to promote the Competition and its results through printed and electronic press (internet etc.) during years 2016 and 2017. In light of the above, the Organizing Company is entitled to use and publish any news related to the Competition, such as to announce in public the name and image of the winner and to proceed to any promotional activity which is deemed necessary by the Organizing Company for the commercial promotion of the Competition and the products and services offered by the Organizing Company.
DELIVERY OF THE PRIZES.
In order to secure delivery of the Prizes, each winner, after having been informed for the results of the draw, is requested to communicate with the Organizing Company via mail at CELESTYAL CRUISES S.A, 8 Antoniou Ampatielou Street, 18536, Piraeus, Greece or e-mail at z.tsilimpounidou@celestyalcruises.gr or telephone +30 210 458 3448. Winners shall sign the relevant declaration of acceptance in order to secure their Prize. A pre-requisite for securing delivery of the Prize, is the submission, at the Organizing Company’s absolute discretion, of identification card or passport evidencing that the winner is 18 years old or more.
In case the winner of the Prize does not accept to sign the above mentioned declaration of acceptance of his/her Prize, this person loses his/her right to receive the Prize and such right automatically is granted to the first alternate winner and, if the first alternate winner does not accept to sign the declaration of acceptance of his/her Prize, the Prize is cancelled.
The winner shall collect the Prize within ten (10) days from the date of the draw, otherwise the Prize shall be offered to the alternate winners.
The Participants and/or the winners are not permitted to proceed to any public statement and/or announcement of any information to the media regarding the Prize, without the prior written consent of the Organizing Company.
PUBLICITY
(a) The Participation Terms have been submitted to the Notary Public Mrs. Zafiria Souri – Konstantinou (1 Skouze Str., Piraeus, Greece, telephone number +30 210 4295118-9) and have been uploaded in the website www.celestyalcruises.com. Any Participant to the Competition or any third party has the right at his/her own cost to receive true copy of the present Participation Terms submitted to the above mentioned Notary Public. The Participation Terms of the Competition are exclusively valid and they annul any older terms submitted to a Notary Public.
ANULLMENT OF THE COMPETITION – AMENDMENTS.
The Organizing Company reserves the right to amend solely the Participation Terms and/or the procedures of the Competition (including the duration of the Competition), if this amendment is deemed necessary by the Organizing Company, by announcing such amendment through the website www.celestyalcruises.com. Enforcement date for such annulment / amendment shall be the date that the announcement was made. According to the above, the Organizing Company reserves the right to change the time of the draw. The Organizing Company reserves the right to extend or shorten by any reason whatsoever the term of the Competition, only after informing the Participants of such amendment within a reasonable time and by reasonable means, as per the Organizing Company’s discretion. The Organizing Company is not liable to any third party in case of postponement or cancellation of the Competition.
ACCEPTANCE OF THE PARTICIPATION TERMS
By participating in the Competition, the Participants explicitly and without prejudice accept the Participation Terms and the official rules and decisions of the Organizing Company in respect of the Competition, which are deemed definite and binding, the Terms of Use of the website www.celestyalcruises.com and the Microsite and the general terms and policy of Facebook (http://www.facebook.com/legal/terms?ref=pf). Moreover, participation in the Competition is considered a waiver of any relevant economical or any other claim and/or right whatsoever against the Organizing Company. By receiving the Prizes, the winners explicitly and without prejudice accept the “Booking Conditions” of the Organizing Company and of “Conditions of Carriage of Passengers and their Luggage” uploaded in www.celestyalcruises.com.
GENERAL
(a) The Participants shall not have or acquire any right at all upon the Organizing Company’s trademarks, names, indications, emblems and other distinctive Marks.
(b) If any of the provisions of the present is found unenforceable or invalid, the remaining provisions of the Participation Terms shall continue to have full force and effect.
APPLICABLE LAW – JURISDICTION
The present shall be governed by Greek law. All disputes arising from or in connection to the Competition, including any disputes for its existence, validity and Termination of the Competition, shall be exclusively and finally settled by the Courts of Piraeus.
